  • RELEASE, WAIVER, INDEMNIFICATION, HOLD HARMLESS, 

    AND  ASSUMPTION OF RISK AGREEMENT

  • WHEREAS, for valuable consideration, including the receipt of firearms instruction provided by Common Sense Safety LLC, located in Loudoun Count, Virginia, and its instructors (hereinafter collectively referred to as "CSS"), the undersigned participant (hereinafter referred to as "Student") agrees to the following terms and conditions:

  • 1. Indemnification and Hold Harmless: The Student, and on behalf of the Student’s heirs, executors, administrators, agrees to indemnify, hold harmless, and defend CSS, and its directors, officers, employees, members, staff, and all individuals assisting in instructing and conducting these activities, against any and all claims, demands, losses, damages, liabilities, costs, and expenses, including reasonable attorney’s fees, arising from the Student’s participation in the training, use of premises, or any activities conducted under the auspices of CSS.

    2. Waiver of Rights: The Student waives any right to bring claims against CSS for any injuries, damages, or losses sustained to person or property, arising out of or in connection with the training, use of firearms, ammunition, and facilities.

    3. Assumption of Risk: The Student expressly assumes all risks associated with participation in firearms training, including but not limited to the risks of personal injury, death, or property damage.

    4. Firearms Safety Rules: The Student acknowledges and agrees to adhere to the fundamental rules of firearms safety, range rules, and any additional safety protocols as directed by CSS instructors.

    5. Physical and Legal Eligibility: The Student represents that he/she is a United States Citizen or Permanent Resident (“Green Card Holder”), physically and legally eligible to handle firearms and is not prohibited by federal, state, or local laws from receiving firearms training, possessing, receiving, owning, or using a firearm.

    6. Understanding and Voluntary Execution: The Student affirms that he/she has fully read and understands the terms of this agreement and voluntarily agree to its terms and conditions.

    7. Binding Effect: This agreement shall be binding upon the Student, his/her heirs, executors, administrators, and assigns.

  • Inherent Risks:

    The participant acknowledges the inherent risks involved in firearms training, including, but not limited to, damage to property and serious physical or emotional injury, including partial or total disability, dismemberment, paralysis or death. Possible known and unknown injuries may include, but are not limited to, being injured in any manner by myself or others, shooting others, partial or total loss of eyesight or hearing, inhalation or other harmful contact with lead or contaminants, being struck by flying or falling debris, projectiles, or ricochets and possible equipment failure and/or malfunction of my own or others’ equipment.  I agree to assume the full risk, including risk which is not specifically foreseeable, of any injuries, including death, damages or loss, regardless of severity, which I may sustain as a result of participating in any and all activities connected with or associated with the Activity.

  • When handling a gun, follow these fundamental rules:

    ALWAYS keep the gun pointed in a safe direction.
    ALWAYS keep your finger off the trigger until ready to shoot.
    ALWAYS keep the gun unloaded until ready to use.

    Know your target and what is beyond.
    Know how to use the gun safely.
    Be sure the gun is safe to operate.
    Use only the correct ammunition for your gun.
    Wear eye and ear protection as appropriate.
    Never use alcohol or drugs that may impair you before or while shooting.
    Store guns so they are not accessible to unauthorized persons.

  • Participant Acknowledgment:

    By signing below, I, the undersigned participant, acknowledge that I have read and understand this Release, Waiver, Indemnification, Hold Harmless, and Assumption of Risk Agreement. I agree to its terms and conditions and sign it voluntarily.
