  1. Statement of Wishes
  It is helpful if the settlor provides the trustees with guidance on the administration of the Trust in a statement of wishes. This statement might include suggestions in respect of the administration of the Trust, the appointment of potential beneficiaries, the distribution of income and capital or possibly identifying members of the family or closely connected persons who could guide and assist the Trustees in the event of the incapacity or death of the settlor. It is important that this Statement of Wishes is properly drafted so it does not defeat the benefit of a discretionary trust.
  
  2. Bank Account
  As and when required we will establish a trust bank account. Unless otherwise agreed, we will establish it with a bank of our choice and provide a panel of signatories to operate the account.
  
  3. Annual Financial Statements
  We have a duty to keep trust records and accounts. We will prepare financial statements on an annual basis. If the trust fund comprises only the shares of an underlying company there will be no extra charge.

  1. Statement of Wishes

  I/We, the person(s) below hereby jointly and severally declare and by our signatures below confirm:
  
  i. We request that the Company and/or Services be provided to us by Westwinds Offshore Services (‘Westwinds’) Limited in the Isle of Man or by such other company as it may designate.
  
  ii. that we are the beneficial owners of the Company ordered from Westwinds under the name given in section 6 above or such other name as may be approved and agreed (referred to from now on as “the Company”);
  
  iii. Our permanent addresses are properly and accurately provided in Personal Questionnaire form;
  
  iv. that we have read the Standard Terms of Business which is attached hereto and in consideration of Westwinds' approving this Request and supplying the Company and/or Services requested, we agree to be bound by those conditions as if they were incorporated into and made a part of this our Declaration;
  
  v. that the Company will not be used for money laundering, terrorist activities, bribery, receiving the proceeds of drug trafficking, trading in arms, munitions or other weapons, soliciting funds from the general public, offering investment advice to the general public, the management of investments other than the property of the Company, the operation and administration of collective investment schemes, trading with countries subject to any embargo authorised by the Security Council of the United Nations, or for any other purpose which is illegal under the law of the place of incorporation or management;
  
  vi. that we have neither been offered nor have received legal or tax advice from Westwinds;
  
  vii. that we will at all times irrevocably and unconditionally hold harmless and indemnify Westwinds and any parent, subsidiary or affiliate thereof and their directors, officers and employees, agents and consultants against all proceedings, suits, damages, fines, expenses, penalties and liabilities arising or brought against any of them by reason of any breach of the above declarations.
  
  viii. that any dispute arising out of this Request or the provision of the Company or Services pursuant to it shall be governed by the law of the Isle of Man and submitted to the exclusive jurisdiction of its Courts.
