    Nature and scope of the financial advice given.

    I am qualified to give you advice about financial products such as Vehicles, Trucks and Equipment Finance, Consumer Finance and Business Finance. I specialise in sourcing finance for businesses and consumers by first understanding their needs and then negotiating on their behalf with multiple financiers.

    I do not provide advice on mortgages, insurance or investments.

    Any financial advice provided on our behalf will only take account of the information you have given us about your particular needs, financial situation or goals.

    Reliability History

    Neither Finance HQ Ltd nor I have been subject to a reliability event. A reliability event is something that might materially influence you in deciding whether to seek advice from me or from Finance HQ. As an example, it would include legal proceedings against me, or if I had been discharged from bankruptcy in the last four years.

    Our duties

    Finance HQ Ltd, and anyone who gives financial advice on our behalf, have duties under the Financial Markets Conduct Act 2013 relating to the way that we give advice. We are required to:

    • give priority to your interests by taking all reasonable steps to make sure our advice isn’t materially influenced by our own interests.
    • exercise care, diligence, and skill in providing you with advice.
    • meet standards of competence, knowledge and skill set by the Code of Professional Conduct for Financial Advice Services (these are designed to make sure that we have the expertise needed to provide you with advice)
    • meet standards of ethical behaviour, conduct and client care set by the Code of Professional Conduct for Financial Advice Services (these are designed to make sure we treat you as we should, and give you suitable advice).

    How we get paid

    For Business Finance, Vehicles, Trucks and Equipment Finance and Consumer Finance, Finance HQ and the financial adviser receive commissions from the various lenders we use.  If you decide to take out a loan, the lender will pay a commission to Finance HQ and your financial adviser. The amount of the commission is calculated through an agreed base rate between the lender and Finance HQ. The advisor will then add a margin above the base rate to reflect the commission paid.

    Fees and charges

    Finance HQ charges a broker fee for every deal we process. This fee can vary between $100 and $1000 and is included in your loan structure/repayments. The fee charged relates to providing specialized assistance with sourcing the right finance solutions to meet your needs and objectives. If you do not enter the credit contract you will not be charged. Please note the Lender will also have fees and charges relating to the processing of your deal and loading security on the PPSR. All fees and charges will be disclosed to you upfront upon approval from the lender.

    How we manage conflicts of interest and/or incentives

    To ensure that our financial advisers prioritise the client’s interest above their own, we follow an advice process that ensures our recommendations are made on the basis of the client’s goals and circumstances.

    All our financial advisers undergo annual training about how to manage conflicts of interest. We undertake a compliance audit, and a review of our compliance programme annually by a reputable compliance consultancy firm.

    Internal complaints process

    We always work hard to build strong and lasting relationships with our valued customers. By listening to your feedback, not only can we address any immediate concerns you may have, we will also continually improve our products and services.

    If for any reason, you do not feel that you have received the highest standard of care from us, we likewise encourage you to share this with us. We have developed a process that we believe makes it easy for you to tell us of your concerns and for them to be addressed quickly and fairly.

    Need an update on your complaint?

    If you have lodged a complaint with us, you can contact us at any time to ask for an update on its status. Contact us through any of the methods listed above and please be sure to refer to your earlier communication so that we can respond effectively.

    Resolution

    We will try to deal with your complaint on the spot. However, if this is not possible, we will write to you to acknowledge your complaint within 5 days. We will ensure we treat you fairly and will work to resolve your complaint as soon as possible. In the rare event we are still investigating your complaint after 30 days we will write to you to explain why and to let you know when we expect to have completed our investigation. When we have completed our investigation we will write to let you know the outcome and the reasons for our decision.

    Taking it further

    We hope that you will be satisfied with how we deal with your complaint. However, if your concerns remain unresolved, or you have not heard from us within 45 days, then you can have your complaint heard by an independent party, the Financial Services Complaints Limited (FSCL). This service will cost you nothing and will help us resolve any disagreements.

    That unless agreed in writing, FHQ will not charge me for the service but may receive a commission from any lender providing the loan or any other service. I agree that in the event that due to early loan termination, any lender requires FHQ to refund any commission paid to it, FHQ may at its discretion require me to identify FHQ for the amount of such refund. I understand that any party who has referred me to FHQ may receive commission from FHQ.

    I authorize:

    • FHQ and any lender or related organisation to collect personal information about me/us from any persons they consider appropriate including, but not limited to, credit reporting agencies, banks and employers and for those persons to disclose information to FHQ, the lender or any related party for the purpose of considering my/our application, and the administration and protection of any credit provided.
    • Any lender to disclose information relating to my/our loan and my/our personal information to FHQ during the term of the loan in order to answer my/our queries or assist me/us with ongoing finance arrangements and for the purpose of administering and monitoring any commission or payments due to FHQ.
    • FHQ and the lender to make all necessary enquiries regarding my/our credit rating.to disclose and share my/our personal information with credit reporting agencies and to make enquiries and share my/our personal information with any person for identity verification purposes. I/We understand that the credit reporting agencies may hold the information provided on their systems and disclose it to authorized users of the credit reporting agencies services. I/we also understand that information about my/our creditworthiness and credit history may be disclosed to any credit provider named in a credit report relating to me/us.
    • Any lender to use the services of a credit reporting agency for any purpose related to the provision of credit to me/us, including using any monitoring services to receive updates if any of the personal information held on me/us should change.
    • Any lender to pass information to credit reporting agencies about any default by me/us of any payment obligations.
    • Credit reporting agencies to provide information about my/our default in any payment obligations to other users of their services.
    • FHQ to use all personal information held about me/us now or in the future to provide me/us with details of products, offers and services from time to time
    • To give the Financial Markets Authority (FMA) consent to view my personal information and records when conducting a review on FHQ
    • To give auditors consent to view my personal information and records when conducting a compliance reviews on FHQ.
