Site Service Agreement

1. Parties. This is a site service agreement (“Agreement”) between SPAT AP LLC /dba/ SPAT MANAGEMENT I (“Campground”) and TBD (“User”).
2. RV Site. Campground hereby provides services on Lot No. (“RV Site”) of Campground’s property. The Campground has the right upon twenty-four (24) hours’ notice to relocate User to a substantially equivalent Lot on Campground’s property.
3. Term. The term of this Agreement shall commence on the date written below (“Effective Date”) and end on: (the “Initial Term”). Unless terminated by either party, after the expiration of the Initial Term, this Agreement shall automatically continue on an extended stay.
4. Cancellation Policy: The User will incur a 30% cancellation fee at any given point if early termination is needed. NO EXCEPTIONS. Any User who checks in and terminates early will NOT receive a refund. NO EXCEPTION.
5. Park Rates and Other Charges. User shall pay Campground for use of the RV site: Weekly: $TBD Daily: $TBD Extended Stay: $TBD. This rate shall be paid in advance and without demand beginning on the Effective Date of this Agreement and thereafter per day. All payments are due and to be made payable to Campground at the address provided below. The rate for use of the RV Site may be increased by giving advance notice to User. 
   Late fee applies on the 3rd day past due at 5:00pm and will incur a 10% of the total balance past due. Partial payments do not waive late fees.
   
   Rules and Regulations. User and their guests, invitees and all occupants shall comply with the written rules and regulations provided to User. User agrees to comply with all state and federal laws, rules, ordinances, and regulations applicable to Campground’s property.
6. Campground’s Right to Terminate Agreement. Campground may terminate this Agreement for any or no reason by providing User a notice for User to leave the RV Site (“Agreement Termination Notice”). User agrees to render peaceful possession of the RV Site to Campground within three (3) days of the date provided on the Agreement Termination Notice. The three (3) days’ notice shall not be required if termination is the result of an Act of Default (as defined below). Upon User’s peaceful surrender of the RV Site to Campground, Campground will refund to User the proportionate amount of any unused amounts previously paid by User to Campground.
7. Early Termination by User. Campground may recover as damages for User’s early termination of this Agreement an amount equal to the amount that remains outstanding for the term of this Agreement.
8. Default by User. The following acts constitute defaults by User (“Acts of Default”):
   Failing to timely pay the RV Site use rate, outlined in Paragraph 4, above, or other lawful charges when due under this Agreement;
   Giving false information to Campground;
   User, User’s guests and/or occupants failing to comply with this Agreement, such as violating provisions of this Agreement or committing serious misconduct or criminal acts;
   Remaining on the Property after giving notice of termination and intent to vacate; and/or
   Remaining on the Property after Campground gave notice of termination at the end of the term or an Agreement Termination Notice, outlined in Paragraph 7, above.
9. Condition of RV Site. By executing this Agreement, User acknowledges and agrees that the RV Site is in good condition and is adequate for User’s use. Upon termination or expiration of this Agreement, User agrees to surrender the RV Site to Campground in a similar, good condition. If User fails to leave the RV Site in good condition, Campground will assess reasonable charges to User for returning the RV Site to good condition.
10. Assignment. User shall not have the right to assign or sublet the RV Site hereunder to any person or persons.
11. Attorneys’ Fees. In the event any legal proceedings of any kind are instituted to collect unpaid rates, as outlined in Paragraph 4, above, or electrical charges, Campground may collect from User all reasonable costs and attorneys’ fees incurred by Campground in pursuing such action.
12. Waiver. Campground’s failure to insist on strict compliance with the terms or conditions of this Agreement shall not be deemed a waiver of that term or condition, nor shall any waiver or relinquishment of any right or power at any one time or times be deemed a waiver or relinquishment of the right or power for all or any other times.
13. Notices. All written notices and communications regarding this Agreement, including notices sent pursuant to TEX. PENAL CODE § 31.04(c), should be sent to the designated undersigned persons at the addresses as set forth below unless notified in writing to the contrary by the receiving party. The notice shall become effective as of the date of mailing by certified mail.
14. Pets. If Campground allows User to have pets on the property, User is responsible for the pet’s behavior, waste, and noise level. User agrees to clean up after his or her pet and to be considerate of other RV park guests. User is liable for any damage or injury caused by his or her pet.
15. Credit Card on File. User will provide Campground with information for a valid credit card to keep on file. The credit card information will be used by Campground in the event that Campground must charge User for cleaning or repairing the RV Site, as outlined in Paragraph 10, above, or if User vacates the RV site without paying Campground the total amount due under this Agreement. If Campground uses the credit card information for the reasons described above, Campground will provide User a statement of account listing the charges at the address noted below.
16. Severability. If any provision of this Agreement is held illegal, void, or unenforceable in a judicial proceeding, such provision shall be severed and shall be inoperative, and the remainder of this Agreement shall remain operative and binding on the parties.
17. NO LIABILITY. TO THE EXTENT PERMITTED BY LAW, USER HEREBY INDEMNIFIES, RELEASES, AND AGREES TO PROTECT AND HOLD HARMLESS CAMPGROUND, ITS OFFICERS, OWNERS, EMPLOYEES, AND AGENTS (“CAMPGROUND PARTIES”), FROM AND AGAINST ALL CLAIMS, CAUSES OF ACTION, AND/OR LIABILITY ARISING OUT OF OR RELATED TO USER’S USE OF THE RV SITE, CAMPGROUND’S PROPERTY, AND/OR ANY CONDITION THEREON, WITHOUT LIMIT AND WITHOUT REGARD TO THE CAUSE OR CAUSES THEREOF OR THE GROSS NEGLIGENCE OF CAMPGROUND PARTIES.
18. THEFT OF SERVICE AND CRIMINAL TRESPASS
    ACCORDING TO TEXAS PENAL CODE SECTON 31.04, a person commits theft of service if, with intent to avoid payment for service that the actor knows is provided only for compensation, the actor intentionally or knowingly secures the performance of the service by agreeing to provide compensation and, after the service is rendered, fails to make full payment after receiving notice demanding payment. “Intent to avoid payment” is presumed if the actor absconded without paying for the service or expressly refused to pay for the service in circumstances where payment is ordinarily made immediately upon rendering of the service, as in recreational vehicle parks. That is, any guest who leaves without paying for site services or who refuses to pay for site services when due may be subject to criminal prosecution. We will prosecute any violations under the “THEFT OF SERVICE LAW.”
    ACCORDING TO TEXAS PENAL CODE SECTON 30.05, a person commits an offense if the person enters or remains on or in property of another, including a recreational vehicle park, without effective consent and the person had notice that the entry was forbidden, or received notice to depart but failed to do so. That is, any guest who receives notice to leave and refuses to do so may be subject to criminal prosecution. If we ask you to leave, you must vacate Campground’s property. We will prosecute any violations under the “CRIMINAL TRESPASS LAW.”
19. RIGHT TO TOW. The User gives the Campground full unrestricted authority to tow or have their vehicle and the recreational vehicle towed out of the property for any reason.
20. This Agreement provides User with a revocable license to the property, which may be revoked at any time for any reason.
21. This Agreement becomes effective only when Campground has signed the Agreement and returns it to User.
22. THIS AGREEMENT DOES NOT CREATE A LANDLORD/TENANT RELATIONSHIP.

    1. Late fee of 10% of the total past due amount applies after the 3rd day payment is due. If the payment is due the 1st, late fees apply on the 3rd at 5:00PM.

    **CANCELLATION POLICY**
    1. All reservations are subject to a 30% cancellation fee at any point upon reserving the site. NO EXCEPTIONS.
    2. Guest who check out early will not be provided a refunded. NO EXCEPTIONS.

Rules and Regulations

 

• Each site is limited to one (1) RV and one (2) vehicles. Additional vehicles require an additional fee and permit.
• 
  The RV must be well maintained and in excellent overall condition.
• 
  SPAT MANAGEMENT I mandates the use of sewer gaskets/seals. Sewer hoses on long-term rigs should be raised off the ground.
• 
  Commercially made wheel covers are allowed. No storage is allowed under the RV.
  You may have your car and/or RV washed by an outside mobile washing service. You may wash your items once per month yourself.

• Park staff will escort and guide RVs in and out of the parking lot. Please notify the office if you want to move to another site or if your RV needs to be repositioned, as the park staff escort must be present.

Personal Vehicles

• Vehicles must be well maintained (no oil leaks) and operate in a safe manner. Speed limit in the park is 5 MPH (miles per hour).

• No repairs or maintenance may be done in the park, except by approved park mobile services. Inoperable or unlicensed vehicles are not permitted in the park.
  Vehicles are to be parked only in the space intended. The common areas are not for parking.
• Never park in an empty site or on the street.
• Drive only on the roadways and never through an empty site.
• All vehicular noise is to be kept to a minimum. Please be mindful of your neighbors when warming your diesel engines — they can be very loud.
• Recreational use of motorized bikes, motorcycles or ATVs within the park is not permitted. Please notify office for exceptions.

 

Sites

• Our park staff work hard to keep sites clean and free of debris. Please help by avoiding clutter and eyesores such as boxes, tools, wood, empty flower pots, etc.
  Only furniture and items intended for outside use are allowed and must be kept to a minimum.
• 
  The following are NOT allowed on sites (including under the RV):
  No clotheslines or hanging of laundry.
  No appliances outside the RV.
• 
  Open storage containers. (Plastic storage containers are permitted under your rig, if kept orderly.)
• 
  No concrete blocks to form structures or brace awnings. Campfires are PROHIBITED at sites. There is a communal fire pit near the Ramada area for all to use. Gas or charcoal barbecues may be used for outdoor cooking on site. Please dispose of cooled ashes in a SEALED bag in a dumpster. During times of extreme FIRE DANGER, charcoal grills will not be allowed. Please confirm with the office prior to arrival.

  No walking through occupied sites or vacant sites.
• 
  Alcohol consumption is allowed inside your camper only.

Pets

• All pets must be registered with us. Maximum of 2 pets per site. Pet rules will be issued, and compliance is mandatory. Remember — cats are pets too, and the rules apply to them. They are not to be let out to run loose.
• 
  The following breeds are NOT allowed in the park: Doberman Pinschers, Pit Bulls, Pit Bull Mixes, and Rottweilers. 
• 
  Pets must always be on a leash with the owner when outdoors. Pets cannot be tied outside and left unattended.
• 
  No pets are allowed at food functions or on the grass areas.
• 
  Guests must pick up after their pets. The pet park is equipped with doggie bags for your convenience. Please make sure the bag is securely sealed and placed in the trash disposals located in the front entrances of the park.
  Visitors
• Visitors must be accompanied by the registered guest always.
• 
  Visitors under the age of 18 must be accompanied by the guest ALWAYS while in the park.
• 
  Please notify the office if you are expecting a guest prior to them arriving, so they will be allowed to enter the park.

Emergency and Safety

• If you need to call 911, and time allows, please call the office so the maintenance staff can be prepared to escort the emergency personnel to your site.
• 
  If you observe any activity you believe to be of concern, call 972.210.3742 24 hours a day. (No soliciting is allowed.)
• 
  Emergency Contact Information forms are required from all monthly guests. This information remains private and used only when a situation arises when we need to contact someone in the event of an emergency or is sought by law enforcement agencies. We never give personal information out to others.

Miscellaneous

• All monthly guests must have a current contact number on file in the office.
• WiFi use is permitted and can be revoked at any time for breaking our Wi-Fi / Network Terms of Use.

By using our internet service, you hereby expressly acknowledge and agree that there are significant security, privacy, and confidentiality risks inherent in accessing or transmitting information through the internet, whether the connection is facilitated through wired or wireless technology. Security issues include, without limitation, interception of transmissions, loss of data, and the introduction or viruses and other programs that can corrupt or damage your computer.
Accordingly, you agree that the owner and/or provider of this network is NOT liable for any interception or transmissions, computer worms or viruses, loss of data, file corruption, hacking or damage to your computer or other devices that result from the transmission or download of information or materials through the internet service provided.
The use of the wireless network is subject to the general restrictions outlined below. If abnormal, illegal, or unauthorized behavior is detected, including heavy consumption of bandwidth, the network provider reserves the right to permanently disconnect the offending device from the wireless network.

Spamming and invasion of privacy - Sending of unsolicited bulk and/or commercial messages over the Internet using the Service or using the Service for activities that invade another's privacy.
Intellectual property right violations - Engaging in any activity that infringes or misappropriates the intellectual property rights of others, including patents, copyrights, trademarks, service marks, trade secrets, or any other proprietary right of any third party.
Accessing illegally or without authorization computers, accounts, equipment or networks belonging to another party, or attempting to penetrate/circumvent security measures of another system. This includes any activity that may be used as a precursor to an attempted system penetration, including, but not limited to, port scans, stealth scans, or other information-gathering activity.
The transfer of technology, software, or other materials in violation of applicable export laws and regulations.
Export Control Violations
Using the Service in violation of applicable law and regulation, including, but not limited to, advertising, transmitting, or otherwise making available ponzi schemes, pyramid schemes, fraudulently charging credit cards, pirating software, or making fraudulent offers to sell or buy products, items, or services.
Uttering threats;
Distribution of pornographic materials to minors;
and Child pornography.
Examples of Unacceptable Uses
The following are representative examples only and do not comprise a comprehensive list of unacceptable uses:
High bandwidth operations, such as large file transfers and media sharing with peer-to-peer programs (i.e.torrents)
Obscene or indecent speech or materials
Defamatory or abusive language
Using the Service to transmit, post, upload, or otherwise making available defamatory, harassing, abusive, or threatening material or language that encourages bodily harm, destruction of property or harasses another.
Forging or misrepresenting message headers, whether in whole or in part, to mask the originator of the message.
Facilitating a Violation of these Terms of Use
Hacking
Distribution of Internet viruses, Trojan horses, or other destructive activities
Distributing information regarding the creation of and sending Internet viruses, worms, Trojan horses, pinging, flooding, mail-bombing, or denial of service attacks. Also, activities that disrupt the use of or interfere with the ability of others to effectively use the node or any connected network, system, service, or equipment.
Advertising, transmitting, or otherwise making available any software product, product, or service that is designed to violate these Terms of Use, which includes the facilitation of the means to spam, initiation of pinging, flooding, mail-bombing, denial of service attacks, and piracy of software.
The sale, transfer, or rental of the Service to customers, clients or other third parties, either directly or as part of a service or product created for resale.
Seeking information on passwords or data belonging to another user.
Making unauthorized copies of proprietary software, or offering unauthorized copies of proprietary software to others.
Intercepting or examining the content of messages, files or communications in transit on a data network.
