The party using the vehicle is hereafter referred to as “User,” and Stringer Investment Group LLC, is hereafter referred to as “Company.” The user agreement states the agreement of the parties as follows:

VEHICLE SUBJECT TO THIS CONTRACT: The Company shall use the vehicle listed above.

PAYMENT TERMS: Usage is included with rental of Seaside Haven for same period of rental dates.

RISK OF LOSS OR DAMAGE: The User assumes all risks of loss or damage to the vehicle from any cause, and agrees to return it to the Company in the condition received from the Company, with the exception of normal wear and tear. The Company or their appointed agent will determine normal wear and tear. All determinations made by the Company are final.

USER TERM: This User shall begin on the vacation start date and shall terminate on vacation end date in fully working condition to the Company vacation home. If extra fuel is needed, it will be paid for by user and not company. Non Ethanol 87 Gas

CARE AND OPERATION OF VEHICLE: The vehicle may only be used and operated in a careful and proper manner. User shall keep vehicle locked up when not in use or overnight in vacation home garage.

DRIVERS: Any drivers of the vehicle will be listed below.

INSURANCE: User and any authorized driver, during operation of the vehicle, be covered by an automobile insurance policy.

NON TRANSFERABILITY: User may NOT sublease or rent the vehicle. This agreement is non transferable and non assignable.

INDEMNITY OF COMPANY FOR LOSS OR DAMAGES: If the vehicle is damaged or lost, the Company shall have the option of requiring the User to repair the vehicle to a state of good working order, or replace the golf cart. Which the vehicle shall become the property of the Company and subject to this contract.

LIABILITY AND INDEMNITY: Liability for injury, disability, and death caused by operating and handling, of the vehicle during the term of this Rental is the obligation of the Renter, and the Renters shall indemnify and hold the Company harmless from and against all such liability. 

ENTIRE AGREEMENT AND MODIFICATION: This contract constitutes the entire agreement between the parties. No modification or amendment of this contract shall be effective unless in writing and signed by both parties. This contract replaces any and all prior agreements between the parties.

 USE OF VEHICLE:

 Minimum age: User shall be at least 21 years of age at time of signing this agreement and hold a valid, current drivers license. 

EQUIPMENT & OPERATION OF VEHICLE:

User agrees that the vehicle is subject to the same laws and regulations pertaining to motor vehicles and therefore agrees to operate the vehicle in accordance with the laws of the State of Alabama and the local laws of Mobile County and Town of Dauphin Island, including, without limitation, to the requirement that persons using or operating the vehicle must not be under the influence of alcohol and/or drugs. Moreover, Renter acknowledges that no alcohol is to be consumed, and no texting is allowed, by any driver or passenger during the operation or use of the vehicle.

User acknowledges and agrees that there shall be no more than six (6) people (including children) in the vehicle at any one time.

LITIGATION & DAMAGES

This agreement is controlled by the laws of the State of Alabama. In the event of litigation concerning any aspect of this agreement, the venue shall be in Mobile County AL.
