I, the undersigned participant, intend to, and will, participate in a outdoor private sporting activity (the “Event”), conducted by Great Lakes Guided Outdoors, LLC (“Great Lakes”) and guided by a Guide selected and designated to me by Great Lakes (the “Guide”). I acknowledge and agree that the Event involves inherently dangerous activities, including use of weapons, utilization of watercraft, sport fishing, outdoor activity involving physical exertion, and outdoor activity in an environment which cannot be controlled by Great Lakes nor by the Guide. I acknowledge and agree that no specific result has been, nor will be, promised or provided in connection with the Event. 

I hereby certify, agree, and acknowledge that: (i) I am of full, adult age; and (ii) I intend to, and will, participate in the Event in a careful manner; and (iii) I am physically fit to participate in the Event, and I have not been otherwise informed by a physician; and (iv) I am aware of all the risks inherent in participating in the Event, including risks such as substantial injury, permanent disability, and death, and I assume all of those risks. 

AS A CONDITION OF MY PARTICIPATION IN THE EVENT AND ANY ACTIVITIES INCIDENT TO THE EVENT, ACKNOWLEDGING THAT MY PARTICIPATION IN THE EVENT IS CONDITIONED ON MY ENTERING INTO, AND SIGNING, THIS CERTIFICATION,AGREEMENT ANDRELEASE, AND INTENDING TO BE LEGALLY BOUND, I forever release and discharge: (i) Great Lakes; and (ii) the Guide; and (iii) each person assisting (in any manner) Great Lakes and the Guide, and assisting me, in the conduct and supervision of the Event; and (iv) their respective heirs, administrators, executors, insurers, successors, representatives, agents, and assigns (each, a “Released Person”) from any and all liability, expenses, claims, demands, damages, loss, cost, actions, causes of action, liens, security interests, and mortgages, whether known or unknown, whether or not at any time enforceable, and whether arising at any time on, before, or after the date of this Certification, Agreement, and Release (which date is the date that Isigned this document), resulting from, in connection with, or arising out of my participation in the Event, and any act, action, inaction, and failure to act, whether or not intended, intentional, malicious, negligent, or not negligent, and whether performed (or not performed) before, on, or after the date of this Certification, Agreement, and Release. 

I agree and acknowledge that I am responsible for following the rules of the Event, conduct of the event, and my participation in the event, each of which are, or may be, established (at any time) by Great Lakes and by the Guide.  I agree that I will carefully follow all directions from the Guide and from each representative of Great Lakes, before, during, and after the Event. I agree that I will use good judgment in the conduct of the Event 

Missed/Wounded Turkeys Policy:

GLGO guides work extremely hard to put you on a turkey hunt you won't soon forget, however, even more important is a clean and efficient kill of our bounty. It is critical you understand your firearm's capability with your choke and shell combination. There will be a $1,000 penalty for a missed or wounded bird. Turkeys are not an expendable resource, and we intend to treat it that way. This money will go to the property owner and cover continued expenses necessary to keep hunting if you should so choose. If you have questions regarding setting up and preparing your firearm for your hunt, please contact a GLGO guide and they would be happy to help.

I acknowledge that I must be prepared to take an ethical shot while hunting with GLGO. I understand that I am allotted one opportunity and if a bird is missed or opportunity is given, that is the extent of outfitting services provided. The fee for a missed turkey is $1,000. In witness of my certification, my acknowledgments, my agreements, and my release of the Released Persons, I have signed this Certification, Agreement, and Release document.

PARTICIPANT’S RELEASE OF GUIDE COMPANY AND GUIDE 

(2020 - 09 - a) PARTICIPANT’S CERTIFICATION AND AGREEMENT

In consideration of participating in gun club or hunting activities, and for other good and valuable consideration, I hereby agree to release and discharge from liability arising from negligence Miller North L C dba Lost Arrow Ranch and its owners, directors, officers employees, agents, volunteers, participants, and all other persons or entities acting for them (hereinafter collectively referred to as "Releases"), on behalf of myself and my children, parents, heirs, assigns, personal representative and estate, and also agree as follows:

1. I acknowledge that gun club or hunting activities involve known and unanticipated risks which could result in physical or emotional injury, paralysis or permanent disability, death, and property damage. Risks include, but are not limited to, death or serious injury as a result of being shot or as a result of equipment malfunction; hearing loss; loss of vision; broken bones, bruises and other bodily injuries caused by falls; medical conditions resulting from physical activity, and damaged clothing or other property. I understand such risks simply cannot be eliminated,

despite the use of safety equipment, without jeopardizing the essential qualities of the activity.

2. I expressly accept and assume all of the risks inherent in this activity or that might have been caused by the negligence of the Releases. My participation in this activity is purely voluntary and I elect to participate despite the risks. In addition, if at any time I believe that event conditions are unsafe or that I am unable to participate due to physical or medical conditions, then I will immediately discontinue participation.

3. I hereby voluntarily release, forever discharge, and agree to indemnify and hold harmless Releases from any and all claims, demands, or causes of action which are in any way connected with my participation in this activity, or my use of their equipment or facilities, arising from negligence. This release does not apply to claims arising from

intentional conduct. Should Releases or anyone acting on their behalf be required to incur attorney's fees and costs to enforce this agreement, I agree to indemnify and hold them harmless for all such fees and costs.

4. I represent that I have adequate insurance to cover any injury or damage I may suffer or cause while participating in this activity, or else I agree to bear the costs of such injury or damage myself. I further represent that I have no medical or physical condition which could interfere with my safety in this activity, or else I am willing to assume - and bear the costs of - all risks that may be created, directly or indirectly, by any such condition.

5. In the event that I file a lawsuit, I agree to do so solely in the state where Releases' facility is located, and I further agree that the substantive law of that state shall apply.

6. I agree that if any portion of this agreement is found to be void or unenforceable, the remaining portions shall remain in full force and effect.
