Kidsboro Academy Inc. (“Academy”) uses video surveillance cameras as an additional safety and security tool to assist in protecting children, staff, families, visitors, and Academy property and to assist with reviewing incidents that may occur at the facility.
The camera system is intended to supplement, and not replace, active staff supervision, staff observations, eyewitness accounts, incident reports, required child-to-staff ratios, or any other supervision and safety requirements.
Camera System
Academy cameras record video only. Audio is not recorded. Cameras are motion-activated and generally record when motion is detected. Cameras are located in designated areas of the Academy for safety, security, and operational purposes. Cameras are not intended to guarantee that every area, person, event, interaction, or incident will be visible or recorded. Camera coverage may contain blind spots, obstructions, interruptions, or portions of an event that occur outside the camera’s field of view.
Video Storage and Retention
Video recordings are stored on the Academy’s recording system/receiver.
Under normal operating conditions, video footage is retained for approximately five (5) days on average. Actual retention time may be shorter or longer depending on motion/activity, recording volume, available storage capacity, equipment operation, and other technical factors.
The Academy does not guarantee that any particular recording will remain available for exactly five days.
Automatic Overwriting and Deletion
The Academy’s recording system uses available storage capacity to maintain recordings. As storage capacity is reached, older recordings may be automatically overwritten by newer recordings.
The Academy does not routinely or manually delete individual recordings as part of its normal recording process. The normal deletion process occurs through the recording system’s automatic overwrite/storage-management function.
Recordings that have been separately preserved because of an incident, investigation, licensing matter, legal requirement, or other legitimate Academy purpose may be retained longer than the normal retention period.
Incidents and Preservation of Video
When the Academy becomes aware of an incident involving a child, the Academy will make reasonable efforts to identify and preserve relevant footage before it is automatically overwritten.
However, the Academy cannot guarantee that footage exists, that the camera captured the entire incident, that the recording is clear or unobstructed, or that footage can be successfully retrieved or preserved.
The absence of video footage does not mean that an incident did or did not occur. The Academy may also rely upon staff observations, eyewitness statements, incident reports, physical evidence, child statements when developmentally appropriate, and other available information when reviewing an incident.
Camera or Recording System Outages
The camera system is an additional safety and security tool and is not a condition or substitute for the Academy’s required supervision of children.
Cameras, recording equipment, storage devices, network connections, software, power sources, or other components may occasionally become unavailable because of equipment failure, damage, maintenance, power outages, network interruptions, repairs, or other circumstances.
When the Academy becomes aware of a significant system outage or malfunction affecting video surveillance, parents or legal guardians will be notified as reasonably practicable. The Academy will also provide notice when the Academy becomes aware that the affected system has been repaired or returned to normal operation.
Temporary camera failure does not necessarily require suspension of child care operations when the Academy can otherwise safely operate and meet applicable supervision and licensing requirements.
Review and Requests for Video Footage
Parents or legal guardians may request that the Academy review footage relating to an incident involving their child.
A request does not guarantee that footage exists or that the requesting individual will receive or be permitted to view the original recording.
The Academy will evaluate requests individually, considering:
the privacy and confidentiality of other children, families, and staff; applicable licensing requirements; applicable laws; safety and security concerns; whether relevant footage remains available; whether disclosure could interfere with an investigation; and other legitimate Academy interests.
The Academy may deny, limit, delay, or modify access when reasonably necessary to protect privacy, confidentiality, safety, legal obligations, or the rights of other individuals.
Privacy of Other Children and Families
Video footage may contain images of children, parents, guardians, employees, visitors, or other individuals who are not involved in the incident being reviewed.
The Academy will make reasonable efforts to protect their privacy.
When appropriate and reasonably possible, the Academy may crop, zoom, blur, mask, redact, shorten, mute/remove irrelevant portions, or otherwise modify a copy of video footage before it is shown or provided to a parent or guardian.
Any such modification is intended to protect privacy or focus on the relevant event and does not necessarily alter the Academy’s original preserved recording.
If the Academy cannot reasonably protect the privacy of other individuals through these methods, the Academy may use another reasonable method of reviewing or communicating the incident, including an in-person supervised review, providing a written or verbal explanation, or declining to release a copy when disclosure would compromise another individual’s privacy or otherwise be inappropriate or prohibited.
Procare and Electronic Sharing
When appropriate, the Academy may upload or share an incident-related video through Procare or another Academy-approved communication method so that the parent or legal guardian of the involved child can review the relevant information.
Electronic sharing is not guaranteed. The Academy may instead arrange another method of review when necessary because of privacy, confidentiality, technical limitations, the involvement of other children, or other circumstances.
Providing access to footage does not authorize a parent or guardian to publish, distribute, post, reproduce, or use the footage to identify, contact, confront, harass, or otherwise communicate with another child or that child’s family.
Incidents Involving Another Child
When footage or an incident involves another enrolled child, the Academy generally will not disclose the identity, name, personal information, disciplinary action, behavioral history, or confidential information of the other child or family, except when disclosure is authorized or required by law.
Parents and guardians should not attempt to identify, question, confront, discipline, contact, or resolve the matter directly with another child or family based upon Academy footage or information concerning an Academy incident.
The Academy will address the matter with the other child’s parent or legal guardian when appropriate and will take reasonable steps consistent with Academy policies to address the behavior, reduce the likelihood of recurrence, and protect the children involved.
Authorized Access and Disclosure
Academy video footage may be accessed by authorized Academy personnel for legitimate purposes, including:
child safety and security; incident investigation; staff training or performance review when appropriate; facility security; responding to parent concerns; compliance with Child Care Licensing requirements; responding to law enforcement, court orders, subpoenas, governmental authorities, or other lawful requests; and protecting the legal rights and interests of the Academy, children, staff, or others.
The Academy reserves the right to preserve footage for a longer period when reasonably necessary for an incident, complaint, licensing review, insurance matter, investigation, legal claim, or anticipated legal proceeding.
Limitations of Video Evidence
Video recordings represent only what was within the camera’s field of view and successfully recorded by the equipment.
Video footage may not show what occurred immediately before or after an event, may not capture activity outside the camera’s view, and, because the Academy does not record audio, cannot establish everything that was said or heard.
For these reasons, video footage is only one source of information considered by the Academy when reviewing an incident.
The Academy will consider available video together with staff observations, eyewitness accounts, incident reports, statements, physical evidence, and other relevant information.
Changes to the Camera System or Policy
Kidsboro Academy will provide written notification to parents or legal guardians of enrolled children regarding material changes to the Academy’s video surveillance camera system or this Camera & Video Surveillance Policy as required by applicable Child Care Licensing requirements.
Notice of Video Surveillance
Parents and guardians acknowledge that Kidsboro Academy uses video surveillance cameras at the facility.
Clear and visible notice that the premises are under video surveillance will also be posted at the facility as required by applicable Child Care Licensing requirements.
PARENT/GUARDIAN ACKNOWLEDGMENT
By signing or electronically accepting the Kidsboro Academy initial registration or annual renewal registration, I acknowledge that:
I have received, read, and understand the Kidsboro Academy Camera & Video Surveillance Policy.
I understand that the Academy uses video surveillance without audio recording as an additional safety and security tool.
I understand that the camera system does not replace staff supervision and that the Academy cannot guarantee that every incident will be recorded, that footage will always be available, or that I will be entitled to receive a copy of any recording.
I understand that the Academy may restrict, redact, modify, or use an alternative method for reviewing footage when necessary to protect the privacy and confidentiality of other children, families, employees, or individuals.
I understand that information or footage provided concerning an incident does not authorize me to identify, confront, contact, question, discipline, or otherwise address another child or family directly and that Kidsboro Academy will handle communication with other involved families as appropriate.
