WAIVER AND RELEASE OF ALL CLAIMS. PLEASE READ CAREFULLY AND BE AWARE THAT IN REGISTERING YOURSELF OR YOUR MINOR CHILD/WARD FOR PARTICIPATION IN THE LAKE COUNTY LIGHTNING OR ILLNIOIS LIGHTNING PROGRAMS, YOU WILL BE WAIVING AND RELEASING ANY AND ALL CLAIMS FOR INJURIES YOU OR YOUR CHILD/WARD MIGHT SUSTAIN FROM PARTICIPATING IN THE PROGRAM. 

I/WE understand that there are certain risks of injury inherent in my/our child/ward's participation in the game of baseball, baseball practice and baseball tryouts.  Having full knowledge of such risks, I/we voluntarily assume them on my/our own accord. I/we further agree to hold JERROLD FOX, LAKE COUNTY LIGHTNING, ILLNIOIS LIGHTNING, FREMONT TOWNSHIP, VILLAGE OF HAWTHORNE WOODS, AND ALL PARTICIPATING communities, facilities, organizations and their representatives harmless of any responsibility, financial or otherwise, due to any injuries received while playing or participating or traveling to and from events excepting in the case of gross negligence or an illegal act. In such case I/We will seek remedy only against the offending party. 

In the event of any emergency, I authorize LAKE COUNTY LIGHTNING, ILLNIOIS LIGHTNING, FREMONT TOWNSHIP, VILLAGE OF HAWTHORNE WOODS, or other communities, facilities or organizations to secure from any licensed hospital, physician and/or medical personnel any treatment deemed necessary for me or my minor child/ward’s immediate care and agree that I will be responsible for payment of any and all medical services rendered. 

I/WE hereby grant and authorize LAKE COUNTY LIGHTNING, ILLINOIS LIGHTNING, FREMONT TOWNSHIP, VILLAGE OF HAWTHORNE WOODS the right to take, edit, alter, copy, exhibit, publish, distribute and make use of any and all pictures or video taken of my/our child/ward to be used in and/or for legally promotional materials including, but not limited to, the LAKE COUNTY LIGHTNING, ILLNIOIS LIGHTNING, FREMONT TOWNSHIP, VILLAGE OF HAWTHORNE WOODS websites, newsletters, flyers, posters, brochures, advertisements, fundraising letters, press kits and submissions to journalists, social networking sites and other print and digital communications without payment or any other consideration.  This authorization extends to all languages, media, formats and markets now known or hereafter devised.  This authorization shall continue indefinitely, unless I/We revoke said authorization in writing.  

I/We understand and agree the at these materials shall become property of the LAKE COUNTY LIGHTNING, ILLNIOIS LIGHTNING, FREMONT TOWNSHIP, VILLAGE OF HAWTHORNE WOODS and will not be returned. 

I/We hereby hold harmless, and release JERROLD FOX, LAKE COUNTY LIGHTNING, ILLNIOIS LIGHTNING, FREMONT TOWNSHIP, VILLAGE OF HAWTHORNE WOODS from all liability, petitions, and causes of action which I/We, my/our heirs, representatives, executors, administrators, or any other persons may make while acting on my/our behalf or on behalf of my/our estate. 

I/We also understand that LAKE COUNTY LIGHTNING, ILLNIOIS LIGHTNING, FREMONT TOWNSHIP, VILLAGE OF HAWTHORNE WOODS may submit Game Summaries to local newspapers for publication or that LAKE COUNTY LIGHTNING, ILLNIOIS LIGHTNING, FREMONT TOWNSHIP, VILLAGE OF HAWTHORNE WOODS may post the Game Summaries on the websites.

COVID-19

In consideration of being allowed to participate in any way with the Lake County Lightning / Illinois Lightning, an Illinois not-for-profit corporation, athletics/sports program (the “Lightning”), including all related events and activities, the undersigned acknowledges, appreciates, and agrees that:

1.  The risk of injury and/or illness from the activities involved in the program is significant, including the potential for permanent paralysis and death, and while particular rules, equipment, and personal discipline may reduce the risk, the risk of serious injury does exist;

2. The risk to have contact with individuals, who have been exposed to and/or have been diagnosed with one or more communicable diseases, including but not limited to COVID-19 or other medical conditions, diseases, or maladies does exist, and it is impossible to eliminate the risk that I could be exposed to and/or become infected through contact with or close proximity with an individual with a communicable disease.  You fully understand the nature of those risks, and you have had the opportunity to discuss them with us.   You assume all risks involved in your participation with the Lightning and other Releasees.  That includes any risks that may arise from negligence or carelessness. 

3. I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES or others, and assume all full responsibility for my participation.  You are responsible for your health and certify to us that you do not have a health condition that a medical professional has recommended not participating;

4. I willingly agree to comply with the stated and customary terms and conditions for participation. If, however, I observe any unusual significant hazard during my presence or participation, I will remove myself from participation and bring such to the attention of the nearest official immediately; and

5.  I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, HEREBY RELEASE AND HOLD HARMLESS Jerrold Fox, Founder of the Lake County Lightning, Lake County Lightning, an Illinois not-for-profit corporation, THE LAKE COUNTY LIGHTNING LLC, Illinois Lightning, a subsidiary of Lake County Lightning, Fremont Township, Fremont Township Parks and Recreation Department, and their respective officers, officials, agents and/or employees, other participants, sponsoring agencies, sponsors, advertisers, and if applicable, owners and lessors of the premises used to conduct the event (collectively, the "Releasees"), WITH RESPECT TO ANY AND ALL INJURY, ILLNESS, DISABILITY, DEATH, or loss or damage to person or property, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE.
