Client Agreement/Contract/Waiver
CUSTOMER AGREEMENT & ART RELEASE: I have read and agree to the following statement: I commission PUMPED UP BALLOONS LLC, the balloon artist, to decorate my party and photograph/video for business purposes. I hereby grant PUMPED UP BALLOONS LLC and her legal representatives and assigns, the irrevocable and unrestricted right to use and publish photographs for website, social media, portfolio, and advertising materials. The Client grants the Artist the irrevocable and unrestricted right to use these photographs without any compensation or approval.*

A non-refundable deposit is due upon booking in order to secure your professional balloon install. All remaining Balances including 9.31% sales tax is due at the time of session. No part of any order, including proofs will be delivered until the balance is paid in full. Your desired session is not reserved until the deposit is received full and clear. Therefore, the deposit is non-refundable. If you cancel with less than 7 days notice, you forfeit your deposit. Re-scheduling may occur to save your deposit if you give at least 7 days notice and the session is rescheduled within 2 weeks of the original reserved date or if there is a family emergency or serious illness. I cannot always guarantee an available date two weeks out but will try my best to accommodate. Re-scheduling of the events due to bad weather is at the balloon arts discretion only.*

In the event that the Client fails to provide timely access to the venue, resulting in delays or insufficient time for setup, the Artist shall not be held responsible for any resulting limitations or compromises in the Services.*

The Client agrees that during the agreed-upon event date and time, they will not engage or hire any other third-party contractors or providers for balloon decorating services at the same venue or location without prior written consent. The Artist reserves the right to leave the job site if a breach of contract occurs.*

Any changes to the event date, venue, or Services must be requested in writing and agreed upon by both parties. Additional fees may apply for significant changes to the Services. This booking arrangement cannot be changed once the Artist arrives at the event.*

If the Client requests outdoor balloon decorations, the Artist will make reasonable efforts to ensure their durability and stability in normal weather conditions. However, the Client acknowledges that outdoor environments are subject to unpredictable factors, such as wind, rain, and sunlight, which may impact the lifespan and integrity of the balloon decorations. To maintain the integrity of the decor, please keep the decor in the location and position they are ordered for. Do not place indoor decor outdoors, and vice versa.*
