    1. Definitions
    • Assignment – means a period during which I am required by Hirestaff to perform duties for a Client.
    • Client – means the company or organisation that Hirestaff has agreed to supply temporary workers to perform duties.
    • Duties – means that work I am required to perform for the Client as part of any given Assignment.
    1. Client Candidate Engagement

    HireStaff will endeavour to find me temporary work Assignments which will be on an ‘as required’ basis with no expectation that Hirestaff will find me ongoing employment. Once an Assignment is offered to me, I will respond to Hirestaff within 48 hours of the initial correspondence about the Assignment.

    Hirestaff will give reasonable notice when asking me to work, and I may choose whether to accept or decline the Assignment. If the offer of work is accepted, I must complete the Assignment unless either Hirestaff or myself ends this agreement.

    Each time I accept an offer of work, it is considered a new Assignment. The terms of this agreement will apply to each new Assignment unless Hirestaff and I agree to any changes in writing.

    1. Obligations

    I agree that:

    1. All information supplied to Hirestaff about my skills, pervious work experience and any other details are correct
    2. I will comply with any policies and rules of the Client’s business or organisation which have been shared with me by the Client, but understand that these are not included in this agreement
    3. I will comply will all health and safety policies of the Client and will take all appropriate steps to ensure the safety of myself and others when working on an Assignment
    4. I will complete the health and safety quiz prior to starting any Assignment to show my understanding of health and safety requirements

     

    1. Drug Test

    I agree that HireStaff may, at its expense, prior to the commencement of this agreement and/or at any other time prior to an Assignment commencing, taking account of the safety-sensitive nature of Assignments, require me to undergo a medical examination by a registered medical practitioner or practitioners nominated by HireStaff, to test for illicit or non-prescribed drugs, prohibited stimulants and/or alcohol and a copy of any medical report furnished by such medical practitioner shall be available to both parties.

    I agree that this agreement and any Assignment is conditional on the above test giving a negative result to the presence of non-prescribed drugs and prohibited stimulants.

     

    1. Nature of Assignment

    Each Assignment is independent of any other Assignment and the nature of work required will be outlined prior to acceptance of the Assignment.

    I acknowledge and agree that:

    1. Hirestaff is not obliged to find me ongoing work Assignments and does not guarantee the length of any given Assignment
    2. For each Assignment I accept I will fulfil all duties and obligations for that Assignment
    3. If for any reason I cannot carry out my duties for the Assignment, I must notify Hirestaff as soon as practically possible
    4. In order to be paid for an Assignment, I must send Hirestaff a signed timesheet at the end of each week, which has been signed by the appropriate supervisor or representative of the client who the Assignment is with
    5. If I fail to submit a signed timesheet, I will not be paid until the timesheet has been submitted
    6. If a Client offers me a permanent position or any additional Assignment at any time, I must notify Hirestaff immediately

     

    1. Payment Details

    For each individual Assignment I will be advised of my hourly rate. The agreed hourly rate will apply for the duration of the Assignment unless otherwise agreed by myself and Hirestaff. Any changes to my hourly rate will be agreed in writing.

    Wages will be paid into my nominal bank account every week, subject to a signed timesheet being sent through to Hirestaff at the end of each week.  All wages paid into my account will be based on the hours worked in the previous week, at the agreed hourly rate, less any applicable taxes required by New Zealand legislation.

    As I am employed on a casual basis, my hourly rate will account and allow for holiday pay calculated at 8% as per the Holidays Act 2003. I understand that I will not accrue holiday pay as it is included in my hourly rate.

    On the occasion that there is either an under or over payment, due to an administration or system error, I understand that Hirestaff will endeavour to rectify and correct any errors as soon as possible. I agree to give my full cooperation to rectify any errors. Any corrections to my wages will be accounted for in the next pay run after the initial error has been identified and a solution has been found.

    Given the nature of the Assignment, Kiwisaver is only available to me for Assignments of more than 28 days.

    If I work for Hirestaff on Assignment which is more than 28 days, I have the right to participate in Kiwisaver and will provide all necessary forms. If I agree to participate in Kiwisaver, deductions will be made from my wages at the contribution rate specified (3%, 4% or 8%). If I do not specify the rate, the default rate of 3% will be used. If I do not wish to contribute to Kiwisaver, I must fill in the Kiwisaver opt out form.

    1. Hours of work

     As I am employed on a casual ‘as required’ basis, I understand that my hours will be communicated to me prior to starting each Assignment. There is no obligation by Hirestaff to offer me a minimum number of hours for any given Assignment. I also understand that the number of hours I am required to work, will vary between each Assignment.

     I am entitled to rest and meal breaks in accordance with the Holidays Act 2003.

    1. Christmas Closedown

     HireStaff traditionally closes for a period between 23 December and 3 January the following year.  For the avoidance of doubt only, as there is no expectation of new Assignments at any time, HireStaff are unlikely to provide any new Assignments, and existing Assignments will not continue, unless otherwise notified by Hirestaff, during this closedown period and Hirestaff may not necessarily be contactable during this time.

    1. Cancellation of shift or Assignment

     Hirestaff will give me reasonable notice, at least 1 hour before the start of an Assignment, if I am no longer required to work. 

    1. Health & Safety

    The Client and I will meet our obligations under the Health and Safety at Work Act. I agree to follow the Clients health and safety rules and procedures. I will take reasonable care to look after my own health and safety at work, my fitness for work, and the health and safety of others. I agree to report any potential risks, incidents and near misses so the Client and Hirestaff can investigate and eliminate or minimise harm or risk of harm. Failure to follow reasonable health and safety rules may result in termination of an Assignment.

    I acknowledge and declare that upon accepting an Assignment I am in good health and do not have any injuries or medical conditions that would affect my abilities to carry out my duties of the Assignment. If this is not the case, I agree I will not accept any Assignment until I am deemed fully fit to carry out an Assignment.

    If a Client requires a medical certificate as part of the requirements of the Assignment, I agree that I will supply this to Hirestaff and I authorise HireStaff to provide the certificate to the Client.

    Regarding the Health and Safety Act 2015, I acknowledge and accept that I will undertake all necessary steps required to ensure that the safety of myself and others, on any given Assignment and will ensure that no action, as part of or outside of my duties, will not cause harm to others.

    I agree that;

    • I will follow all instructions given to me by the Client relating to health and safety practices, policies, procedures and carry out any training provided
    • I will attend any inductions required before starting the Assignment and complete any pre-work required
    • If an incident and/or accident occurs whilst working on an Assignment, I will notify Hirestaff as soon as reasonably possible
    • I will cooperate with Hirestaff to understand the details of the accident or incident and how it occurred, and fill in an incident form within 48 hours of the incident if practically possible
    • All PPE gear required to be worn as part of the Assignment will always be worn
    • I will decline to use equipment or tools I am not familiar with or am not qualified to use
    1. Dispute Resolution

    Schedule A to this Agreement contains a guide to the services available for resolving employment relationship problems.

    1. Personal Protective Equipment

    Any Assignment I accept may involve risks to my health and safety from time to time for which personal protective equipment (PPE) must be used or worn.

    Hirestaff will provide suitable PPE as and when required dependent on the nature of the Assignment. I agree that I am to return any PPE provided to me by Hirestaff at the end of the Assignment. I understand and agree that if I do not return the PPE, Hirestaff will hold back a portion of my final pay until the PPE is returned. If Hirestaff advises in advance, I can choose to provide my own PPE for the duration of the Assignment.

    I understand and agree that I must always take reasonable care when dealing with any risks or hazards as part of the Assignment and must wear any PPE when appropriate. At all times, I must follow the Client’s health and safety policies and use safe and appropriate practices to carry our all duties of the Assignment. I agree that I will not hold Hirestaff liable if I fail to use or wear PPE as instructed on any Assignment.

    1. Abandoned Assignment

    I understand that if I am away from a work Assignment for 3 working days in a row without telling Hirestaff or getting their permission, and Hirestaff has made reasonable efforts to contact me to clarify the reason for my absence and whether I intend to work, Hirestaff may regard the employment as abandoned.

    Hirestaff will notify me by email and/or text message to the email address and/or phone number I last provided to HireStaff, that they deem me to have ended my employment. The employment will be deemed to have finished at the end of the last day I worked.

    1. Ending employment

    I agree that this is a casual only employment relationship with no expectation of ongoing work and no commitment by HireStaff to provide ongoing work and no employment relationship between any periods of work.

    Accordingly, HireStaff has no responsibility to provide work and can remove me from any roster on an Assignment, or refrain from putting me on any further Assignment, without giving a notice period (subject to compliance with the cancellation provision at clause 9 above).

    Likewise, I can notify HireStaff that I will no longer work on an Assignment and/or be considered for further Assignments, provided I agree to complete the remaining hours of the shift I have commenced and/or agreed to perform.

    1. Return of property

    I understand that I must immediately return any Hirestaff or Client property on or before the end of any Assignment. This includes any PPE or tools provided.  If I fail to immediately return HireStaff's property, I authorise HireStaff, after consulting with me, to deduct the replacement cost or current value of the property from any amount owing to me.

    1. Indemnity

    I agree that I will indemnify Hirestaff against any loss, expense, damages or compensation which Hirestaff incurs or is required to pay, or pays by way of settlement) in relation to any claim which is threatened, notified or commenced against Hirestaff and which arises directly or indirectly out of any alleged wilful or negligent act or omission by myself in the course of performing any duties on an Assignment and/or acting outside Hirestaff and/or the Client's instructions on an Assignment. This indemnity will continue to apply after the termination of this agreement and regardless of any dispute.

    I agree that I will also indemnify HireStaff against any costs incurred by HireStaff, including full solicitor-client costs, resulting from any claim or action brought by a third party against HireStaff, where the claim or action arises from or relates to any alleged act and/or omissions of myself in the course of performing any duties on an Assignment and/or acting outside the instructions of HireStaff and/or the Client on an Assignment.

    1. Sick leave & bereavement leave

    I am entitled to 5 days sick leave per annum after being in continuous employment for a period of 6 months, provided I have worked for HireStaff for an average of 10 hours a week; and no less than 1 hour in every week or no less than 40 hours in every month. If I am sick for 2 consecutive days, I may be required to provide a sick note from a qualified practitioner. If I cannot provide the appropriate proof of sickness, Hirestaff is not liable to pay me until this is provided. If I am sick, I must notify Hirestaff at least 2 hours before I am due to start my Assignment.

    Regarding bereavement leave, I need to be in continuous employment for a minimum of 6 months before being eligible for bereavement leave. If I suffer a bereavement and need to take leave, I will notify Hirestaff a minimum of 2 hours before I am due to start my Assignment. Any sick or bereavement leave, will be paid out at the agreed hourly rate for each day of leave taken.

    1. Confidential Information

    The Employee agrees that the Employee will hold all HireStaff and/or the Client's confidential information, being information not in the public domain and including but not limited to financial information, business methods and management systems and know-how ("Confidential Information"), in confidence and will not without the written consent of HireStaff and the Client directly or indirectly at any time during the term of this agreement or following its termination for any reason (for so long as the information continues to be Confidential Information) use, disclose and/or copy any Confidential Information.

    1. Right to work in New Zealand

    I confirm that I have the legal right to work in New Zealand and shall inform HireStaff at least one month in advance if that right is set to expire.  The parties agree that this Agreement will automatically cease to have effect upon expiry of my right to work lawfully in New Zealand.

    1. Declaration

    In signing this agreement, I accept the terms and conditions of my employment as detailed within this offer and declare that:

    • I have read, and fully understood the terms and conditions of this agreement.
    • I was told about my right to get independent advice on the terms and conditions of this agreement and I have been given time to take that advice.
    • I have raised any issues I have about the terms and conditions of this agreement and Hirestaff has responded to these issues.
    • I understand I am being employed on a casual “as required” basis, which means Hirestaff will only offer work as and when it is available. I also understand my annual holiday entitlement will be included and accounted for in my hourly rate.
    • I have told Hirestaff about any existing physical and/or health conditions that might be worsened by doing the job or might affect my ability to do the job.
    • I confirm there are no contractual or other legal reasons that could stop me from working.
    • The information I have given is true and correct to the best of my knowledge and belief, and I have not left out anything that could affect the decision to employ me.
    • I am, and will remain, able to work legally in New Zealand for the term of this agreement.
  • I confirm that I have asked Hirestaff Limited to find me permanent or temporary employment and that all information provided (such as information about my experience, previous roles and qualifications/certificates) are true and correct to the best of my knowledge.  I authorise Hirestaff to pass on my details to any potential client Hirestaff deems suitable based on the information provided. I authorise Hirestaff to carry out any necessary checks in regards to my qualifications, working VISAs and give consent to approach my listed referees for the purpose of obtaining a reference about me. I give Hirestaff consent to disclose information contained in any references carried out from previous employers to any Hirestaff clients. I also give Hirestaff consent to pass on information obtained from the Ministry of Justice about my criminal convictions record, including the report itself.
