in favor of The Salish Sea School, Inc. a nonprofit corporation organized and existing under the laws of Washington State. The Salish Sea School, Inc. include their respective directors, officers, governing board, agents, staff, employees, agents, shareholders, affiliates, successors and assigns (collectively "TSSS").
The Minor desires to participate as a student participant for TSSS and engage in the activities and understands the nature of such work and activities. In consideration for participating as a student at TSSS worksite and/or boat-based programs, both Minor and Guardian hereby freely and voluntarily, without duress, execute this Agreement under the following terms:
1. Guardian Status. By my signature below, I attest that I am the parent or legal guardian of the Minor named in this Waiver and Release, and that I have the authority to execute this Waiver and Release on behalf of the Minor.
2. Student Conduct. The Minor agrees to abide by all rules and regulations of TSSS, Washington State Parks, WDFW, US Forest Service, laws of Washington state and the United States of America, and understands that failure to act in accordance with the rules may result in expulsion from TSSS.
3. Insurance. The Guardian and Minor understand that TSSS does not provide any accident or health insurance for student participants and it is Guardian's responsibility to provide such coverage. I expressly waive any such claim for compensation or liability on the part of TSSS beyond what may be offered voluntarily and freely by a representative of TSSS, in its sole discretion, in the event of such injury or medical expense.
4. Property Loss. The Guardian and Minor understand that TSSS is not responsible for personal property lost, damaged, or stolen while participating in TSSS programs.
5. Medical Release. The Guardian and Minor authorizes TSSS, as the agent, to give consent to medical treatment by a licensed physician or hospital when such treatment is deemed necessary by the physician, and the Guardian is unable to give such consent. The Guardian authorizes a qualified TSSS member to administer CPR or first aid if necessary. The Guardian and Minor each hereby release and forever discharge TSSS from any claim whatsoever which arises or may hereafter arise on account of any first-aid treatment or other medical services rendered to Minor in connection with an emergency during Minor's time with TSSS. The Guardian and Minor certify that the Minor is physically fit and has not been advised to not participate by a qualified medical professional. The Guardian and Minor certify that there are no health-related reasons or problems which preclude my participation in this TSSS program.
6. Waiver, Accident, and Release. The Guardian and Minor and each of their personal representatives, assigns, heirs, and next of kin each release, waive, forever discharge and covenant not to sue and hold harmless TSSS and their respective shareholders, directors, officers, employees, agents, affiliates, successors and assigns from any and all liability, claims, and demands of whatever kind or nature, either in law or in equity, which arise or may hereafter arise from the Minor's participation with TSSS and the TSSS programs to include boat-based programs on TSSS and/or with partner organizations. The Guardian and Minor hereby assume all of the risks associated with participating in TSSS programs, whether or lond or onboard vessels, including by way of example and not limitation, any risks that may arise from negligence or carelessness on the part of the persons or entities being released, from dangerous or defective equipment or property owned, maintained or controlled by them, or because of their possible liability without fault, to include the time spent at off-site facilities, marinas, or use of equipment. This includes the Guardian/Minor's death, disability, personal injury, bodily injury, illness, property damage, property theft, or actions of any kind which may hereafter occur including traveling to and from TSSS programs. It is also understood that TSSS does not assume any responsibility for or obligation to provide financial assistance or other assistance to me, including but not limited to medical, health or disability insurance, in the event of injury, illness, death or property damage.
7. Assumption of the Risk, Indemnification, and promise not to sue entities or persons mentioned in this paragraph from any and all liabilities or claims made as a result of participation in TSSS programs and/or onboard vessels whether caused by
negligence or otherwise. The Guardian and Minor recognize and understand that the Minor's activities at TSSS and/or aboard vessels may, in some situations, involve activities which can pose risk of harm or injury to the Minor with the potential for death, serious injury, and personal loss. The risks may include, but are not limited to, those caused by terrain, facilities, temperature, water, weather, heat stress, heat exhaustion, heat stroke, muscle sprains, muscle strain, broken limbs, teeth, etc. As the Guardian for the said Minor, I, and the Minor, also hereby expressly and specifically assume the risk of injury or harm in these activities and release TSSS from all liability for injury, illness, death, or property damage resulting from Minor's activities and time at the TSSS site, on vessels, or in programs. Guardian and Minor agree that if anyone makes a claim against TSSS, Inc. or TSSS on behalf of Guardian or Minor, that Guardian and Minor agree to indemnify, save and hold harmless TSSS Inc., and Guardians of the Sea from any claim, including without limitation, loss, liability, damage or cost which may occur as a result of any such claim.
