2.1 Safe Behavior Around Horses. To help prevent injuries and/or death, Client agrees to ensure that self and/or Youth will carefully follow any instructions that may be given to them by Stables and Trainer regarding horse behavior and handling. Client agrees to ensure that self/Youth carefully follows all of the Stables' and Trainer's barn rules.
2.2 Safe Riding Attire. Client agrees to ensure that self and/or Youth wears heeled boots, long pants, a long-sleeved shirt, and gloves designed for riding when visiting Stables, and an ASTM/SEI certified safety helmet fastened securely under the chin while riding. If Client does not ensure that self and/or Youth wears these items, Client assumes the increased risk of injury or death associated with failing to wear such protective attire. Client agrees that Stables and Trainer has no duty to provide safety attire for self and/or Youth.
2.3. Client's Representations and Warrenties. Client makes each of the following representations and warrenties on behalf of Client, Youth, and their respective guardians, heirs, assigns (collectively, the "Client/Youth Parties").
- Client has the prerequisite authority to enter into this Agreement upon behalf of the Client/Youth Parties and all other person(s) who may have custody rights or authority with respect to Youth.
- Client will either be present during Youth's visit to Stables, or in Client's absence, Client grants Stables and its owners, employees, agents, and contractors (collectively the "Stables Parties") full authority to make all decisions on behalf of Youth and Client, including medical care, and Client agrees to hold the Stables Parties harmless for any injuries or death to self and/or Youth that may result from such decisions made by Stables Parties.
- Client and/or Youth needs to disclose any physical or mental conditions that may prevent themself from safely participating in horse-related activities.
2.4. Risk of Injury or Death to Client and/or Youth. Client understands that horse-related activities are inherently dangerous and expressly assumes the risks associated with self and/or Youth visiting Stables and handling, caring for, and riding horses. Client understands that horses are inherently unpredictable animals and even the most docile horse may occassionally bolt, spook, buck, rear, bite, kick, pull back, or otherwise act in such a way that may injure self, Youth, or others. Stables' property may contain defects. For example, footing at Stables, including arena, round pen, and pasture footing, can contain holes, rocks, uneven portions, or can otherwise be unpredictable. Client expressly assumes all the risks of Client and/or Youth visiting Stables and engaging in horse-related activities, including the risk that the Stables Parties may be negligent. Accordingly, Client agrees on behalf of themself and/or Client/Youth Parties not to sue the Stable Parties or otherwise make a claim against the Stable Parties in connection with any injury or death.
2.5 Trail Riding Risks. Client understands that riding horses outside of the designated riding areas such as arenas and round pens ("Trail Riding"), including riding horses in an open pasture where other horses are loose, is inherently dangerous. In particular, horses may become spooked by traffic, wild animals, other horses, or other hazards, causing self and/or Youth to fall off or otherwise become injured or die. Horses may also stumble or trip over natural or manmade obstacles, injuring horses, self, and/or Youth. Client understands that Stables does not inspect or maintain any trails or paths, on or off of the Stables' property, and Stables make no warranty whatsoever regarding the safety of paths and trails. Client understands and expressly assumes all risks associated with Trail Riding, including the risk that the Stable Parties may be negligent.
2.6. Client's Indemnification Agreement. Client agrees to defend, indemnify, and hold the Stable Parties harmless against all claims, demands, and causes of action, including court costs and attorney's fees, directly or indirectly arising from any action or other proceedings brought by or prosecuted for the benefit of any of the Client/Youth Parties or brought by others in connection with any action or inaction taken by the Client and/or Youth.
2.7 Waiver of Unknown Claims. Upon behalf of the Client/Youth Parties, Client expressly waives any rights that the Client/Youth Parties might otherwise have with regard to unknown claims. For the purpose of this section, "claims" shall include all actions, claims, and grievances, whether actual or potential, known or unknown, and specifically but not all exclusively, all claims arising in connection with this Agreement.
