AUTHORIZATION TO TOW

Tow operators and tow truck drivers must follow the requirements of the Towing and Storage Safety and Enforcement Act, 2021 . This Act sets out responsibilities for the operation of a tow truck, conduct toward the public and at the scene of an accident, and the rates that can be charged for towing a motor vehicle. The act also sets out rights you have when requesting and receiving towing services. 

You have the right to:

1. Decide who can to tow your vehicle, and where your vehicle will be towed to
2. Receive and review the consent form and maximum rate sheet prior to towing begins; do not sign a blank form
3. Receive an unaltered copt of your signed Consent Form
4. Receive an itemized invoice prior to paying and a receipt when you pay
5. Choose your payment method
6. Contact the Ministry of Transportation if you have any concerns about the towing services you received or the conduct of the tow driver/operator

Tow truck drivers and operators must:

1. Notify you if your vehicle is taken to a location that is different from the location you identified
2. Not charge more than the rates published on the Government of Ontarios website on the Towing and Storage Safety and Enforcement Act, 2021
3. Accept multiple forms of payment
4. Not solicit you to consent to other services, including vehicle storage
5. Not refer you to any medical or legal services and can only refer to other towing, storage, or vehicle repair at your request
6. disclose any interest they have or benefit they may receive from a referral at the time of the referral
7. Tow Drivers and Operators must be identified by name and certificate number, and numbers must match the documentation provided
8. Follow the code of Conduct. See the Government of Ontario's website on the Towing and Storage Safety and Enforcement Act, 2021

By Signing this waiver

• You are confirming that you have read and understood your rights
• You are authorizing your vehicle to be towed by Duffs Towing
• You have been given Duffs Towing's business phone number, address and contact at the top of this waiver

Duffs Towing reserves the right to refuse any services that put any individual or property at risk. Duffs Towing will not be responsible for any damage that may occur including recovery, loading, transportation, and unloading of the vehicle. Should the condition of your vehicle not be accurate to the description at the time of tow arrival you may be provided with a new quote for service that may differ from your original quote, this must be agreed upon prior to any and all towing services.
