1. PROHIBITED ITEMS
Absolutely no hazardous waste which includes but not limited to: liquids, paints, and solvents. Additional fees will apply if any of these items are found in your load, and JSX Hauling reserves the right to refuse the load.
2. COMINGLING LOADS
Comingling/Mixing loads is strictly prohibited. Customer is responsible for all resulting sorting, handling, transportation, disposal and additional facility charges. Please refer to our website for a list of allowable/prohibited items.
3. CLEAR ACCESS
You are responsible for providing clear access for drop off and pick up. If access to dumpster is unavailable, you will be charged a dry run fee.
4. ACCEPTANCE OF EQUIPMENT
You agree to carefully examine the dumpster upon drop off, and hereby accept the dumpster as being in good order, condition, repair and is satisfactory to you.
In the event no one is on-site to receive the dumpster upon arrival, by signing below, you accept full responsibility of said dumpster and agree to adhere to all terms of this agreement.
5. WEEKEND WORK
Unless scheduled by JSX Hauling, any work requesting to be done on Saturdays, Sundays and/or holidays is considered a special request and shall be an additional charge.
6. PAYMENTS
Unless credit terms have been established and approved by JSX Hauling LLC, payment is due prior to delivery. If paying by credit card, a 3.5% surcharge will be added to the invoice.
If the load exceeds the included tonnage or incurs any additional charges, including but not limited to excess tonnage, prohibited materials, special waste, dry runs, relocation, or other applicable fees, JSX Hauling LLC will issue a separate invoice. Addtional invoices are due upon receipt.
Late Payment: Any amount not paid when due is considered past due. A late charge of 1.5% of the unpaid balance per month may be assessed on past due amounts, or the maximum amount permitted by applicable law, whichever is less.
Customer agrees to pay reasonable costs of collection, including attorneys' fees and collection agency fees, to the extent permitted by law.
7. CUSTOMER CONDUCT
Customer is responsible for contacting JSX Hauling LLC to request pickup. Customer shall not move, relocate, load, unload, modify, alter, or permit others to move or use the dumpster without prior authorization from JSX Hauling LLC. JSX Hauling LLC may charge applicable fees for unauthorized relocation, additional trips or delays.
8. DAMAGES OR LOSS
Customer is responsible for damage to or loss of the dumpster while it is in the customers possession or at customer's site, except for ordinary wear and tear and damage caused by JSX Hauling LLC. Customer agrees to pay the reasonable cost of repair or replacement, as applicable.
9. LIMITATION OF LIABILITY
To the fullest extent permitted by law, JSX Hauling LLC shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in any way connected with the use of our services and dumpsters.
JSX Hauling LLC shall not be responsible for damages to ground surface including but not limited to concrete curbs, driveways, walkways or grass lawns, including enclosures, gates, and any other structures surrounding JSX Hauling LLC vehicles and/or dumpsters.
In the event of any accident involving said dumpsters, you agree to furnish JSX Hauling LLC with complete reports of same, including names and addresses of all parties involved, including witnesses and photos, within 24 hours.
10. CANCELLATION OF CONTRACT AND DELIVERY CLAUSE
JSX Hauling LLC has reserved the right to cancel or suspend service and/or retrieve its equipment if the customer fails to comply with these Terms and Conditions, fails to make required payments, provides unsafe or inadequate access, places prohibited materials in the dumpster, or if circumstances beyond JSX Hauling LLC's reasonable control prevent performance.
11. INDEMNIFICATION
Customer agrees to indemnify and hold harmless JSX Hauling LLC, its owners, employees, agents and representatives from claims, damages, losses, liabilities and reasonable expenses arising from the sutomers negligence, intentional misconduct, violation of the Terms and Conditions, or use, loading, placement or handling of the dumpster, except to the extent caused by negligence or willful misconduct of JSX Hauling LLC.
12. GOVERNING LAW
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Hawaii.
13. CHANGES TO TERMS AND CONDITIONS
JSX Hauling LLC reserves the right to update or modify these Terms and Conditions from time to time. Any changes will apply to future orders and services and will not modify the terms of an order or service already accepted by JSX Hauling LLC.
14. REPRESENTATION AND AUTHORIZATION
The individual signing below hereby represents and warrants that s/he is duly authorized to execute and deliver this agreement on behalf of named company.
