1. Prohibited Items
Absolutely no hazardous waste which includes but not limited to: liquids, paints, and solvents. Additional fees will apply if any of these items are found in your load, and JSX Hauling reserves the right to refuse the load.
2. Comingling Loads
Comingling/Mixing loads is strictly prohibited. Additional handling fees will apply should JSX Hauling LLC have to manually sort the trash and dispose at different facilities. Please be sure to review the "Additional Fees" schedule that will be attached to the confirmation email you will receive upon signing this agreement.
3. Clear Access
You are responsible for providing clear access for drop off and pick up. If access to dumpster is unavailable, you will be charged a dry run fee.
4. Acceptance of Equipment
You agree to carefully examine the dumpster upon drop off, and hereby accept the dumpster as being in good order, condition, repair and is satisfactory to you.
In the event no one is on-site to receive the dumpster upon arrival, by signing below, you accept full responsibility of said dumpster and agree to adhere to all terms of this agreement.
5. Weekend Work
Unless scheduled by JSX Hauling, any work requesting to be done on Saturdays, Sundays and/or holidays shall be an additional charge.
6. Payments
Unless credit terms have been established and approved by manager, payment is due prior to delivery. If paying by credit card, a 3.5% surcharge will be added to your invoice.
If your load is over the included tonnage, or has incurred additional charges, you will receive a second invoice and payment shall be due upon receipt.
A late fee of 3% per month will be charged on overdue accounts. Customer agrees to pay reasonable collection costs and attorneys fees in the event that the account is placed in collections or to an attorney for collection.
7. Customer Conduct
It is your responsibility to contact our office to schedule a pick up.
8. Damages or Loss
You hereby assume all responsibility for any and all damages or loss to dumpster, and agree to pay the full cost of repairs. In case of loss of possession, you agree to pay for the complete and full value of said dumpster. Furthermore, you agree not to permit any other person or persons whomsoever to use, operate, move or control said dumpster.
9. Limitation of Liability
To the fullest extent permitted by law, JSX Hauling LLC shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in any way connected with the use of our services and dumpsters.
JSX Hauling LLC shall not be responsible for damages to ground surface including but not limited to concrete curbs, driveways, walkways or grass lawns, including enclosures, gates, and any other structures surrounding JSX Hauling LLC vehicles and/or dumpsters.
In the event of any accident involving said dumpsters, you agree to furnish JSX Hauling LLC with complete reports of same, including names and addresses of all parties involved, including witnesses and photos, within 24 hours.
10. Cancellation of Contract and Delivery Clause
JSX Hauling LLC has reserved the right to cancel this contract at any time and retake possession of said dumpster. You agree to release and discharge JSX Hauling LLC from any and all liability and damage which may be caused by failure to deliver said equipment within the agreed time if such failure to deliver is caused by an act of God, weather conditions, accident, breakdown, acts of third persons or any other circumctances or situations beyond the control of JSX Hauling LLC.
11. Indemnification
You agree to indemnify and hold JSX Hauling LLC, its affiliates, officers, directors, employees, and agents harmless from and against any and all claims, liabilities, damages, losses, or expenses arising out of or in any way connected with your use of our services and dumpsters.
12. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of Honolulu, Hawaii, without regard to its conflict of law provisions.
13. Changes to Terms and Conditions
JSX Hauling LLC reserves the right to update or modify these Terms and Conditions at any time without prior notice. Your continued use of our services after any such changes constitutes your acceptance of the new Terms and Conditions.
14. Representation and Authorization
The individual signing below hereby represents and warrants that s/he is duly authorized to execute and deliver this agreement on behalf of named company.
