I, First Name* Last Name* , agree to allow Mid Sound Fisheries, or its assigned contractors, to survey for and treat invasive knotweed (Polygonum bohemicum, P. cuspidatum, P. Sachalinense, P. polystachyum) that is found on my property near Bear Creek and its tributaries (to include but not limited to: Cottage Lake Creek, Mackey Creek and Evans Creek)with a state-approved and permitted aquatic herbicide. This permission pertains to only the designated property which I own: Street Address* City* State* Zip* I understand this work will be carried out safely, efficiently, and as completely as possible. Further, I understand that funding for this work is being provided at no cost to me by the King County Flood Control District (collectively, the “Program Funders”). I understand that this free service is only available for the duration of this allocated funding. I understand that the risks involved with application of this herbicide include potential unintended exposure to nearby plants, which may result in the death of ornamental or native plants on my property. I understand that it takes multiple years of annual treatment to completely eradicate the knotweed, and that knotweed may return if I do not continue treatment. I understand that despite granting this permission, treatment is prioritized based on accessibility and priority areas in the watershed and is not guaranteed to occur on my property on any given year. I understand that I will be notified of date range of knotweed treatment for each year I grant permission to access my property, and will be notified of whether treatment took place on my property at the end of each treatment season. I do hereby, for myself, and my heirs, executors and administrators, waive, release, and forever discharge any and all rights and claims against Program Funders, Mid Sound Fisheries, and their officers, agents, and/or assigns for any and all damages claimed to have been caused by any activity related to the foregoing knotweed control, except that resulting in whole or in part from the gross negligence of Mid Sound or any of the aforementioned parties, their successors, or assigns.
