Entire Agreement
This agreement contains the entire understanding between Aubri Poon Photography and {clientFull}. It supersedes all prior agreements between the parties. Any changes must be in writing and signed by both parties. A waiver of any portion of this agreement does not waive the agreement in full, and any waiver must be in writing.
Reservation & Retainer
. A signed contract and a non-refundable retainer of $100 are required to reserve the session date. The retainer is applied to the session fee. Products must be paid in full before orders are placed.
Cooperation & Safety
Both parties agree to open communication and cooperation for the best results. Aubri Poon Photography does not and will not tolerate any behavior that harms people or animals, physically or mentally. This includes, but is not limited to, verbal abuse, threats, harassment, intimidation, aggressive handling of pets, or any unsafe actions toward property or the environment. If such behavior occurs or if the photographer feels safety is compromised, the session will be ended immediately at Aubri Poon Photography’s discretion, without refund or liability.
Client Responsibilities
{clientFull} is responsible for their pet’s behaviour during the session. Any property damage, excessive clean-up needs, or incidents caused by the pet are the client’s responsibility.
{clientFull} is responsible for ensuring pets are under control, safe, and healthy during the session.
Pets should be current on vaccinations and in good health.
The only exception to this is Legacy sessions where the pet's immediate health and liveliness is compromised.
{clientFull} is responsible for ensuring pets are properly leashed where the law permits.
{clientFull} is responsible for bringing any desired props.
Forgotten props or concerns over appearance (hair, makeup, wardrobe, etc.) are not grounds for a free reshoot. A new session may be scheduled at the regular rate.
{clientFull} is liable for their pet. If the pet causes injury to the photographer, other people, animals, or property, {clientFull} assumes full responsibility for associated costs.
Substitute Photographer
In the unlikely event Aubri Poon Photography cannot perform the session, every effort will be made to find a suitable substitute photographer. Substitution is based on availability and is only considered for one-time events such as weddings or travel-based sessions with limited timelines. For other sessions, rescheduling will be the first option. If rescheduling is not possible, a refund will be issued before considering a substitute.
Copyright & Usage
All photographs remain the copyright of Aubri Poon Photography under the Federal Copyright Act, c. C-42. Clients may not reproduce, sell, or profit from the images without written permission.
Personal Use: Upon purchase, {clientFull} receives a print release for personal use (sharing with friends/family, personal social media).
Social Media: {clientFull} may share images online and should visibly credit Aubri Poon Photography (@aubri_poon_photography or aubripoon.com). Images may not be altered, filtered, or cropped in a way that misrepresents the work.
Modifications: Only Aubri Poon Photography may crop, edit, or alter the final images. RAW files are never provided.
Portfolio Rights: Aubri Poon Photography retains the right to use images for portfolio, marketing, contests, publications, and exhibitions.
Model/Property Release
: {clientFull} grants Aubri Poon Photography and its representatives the unrestricted right to use and publish photographs of {clientFull}, their pets, and anyone present at the session for editorial, trade, advertising, and promotional purposes. All attendees at the session are considered included in this release.
Limit of Liability
Every effort is made to ensure safe, proper handling, and image quality. In the unlikely event of loss, theft, or destruction of images due to technical failure, accident, or other circumstances beyond control, liability is limited to the return of payments received or, when possible, a reshoot.
Editing Policy
Standard Editing includes color correction, lighting adjustments, leash removal, and minor blemish fixes.
Extensive Editing (e.g., adding/removing people, head swaps, background changes, advanced retouching) may be available starting at $150 and must be paid before work begins. Some requests may be declined if they are unrealistic or compromise artistic standards.
Travel & Location Fees
Travel up to 100km round trip is included in the session fee. Additional travel is billed at $0.70/km.
If the chosen location requires admission, parking, or photography fees, {clientFull} is responsible for those costs and for securing any necessary permits. Aubri Poon Photography covers Alberta Provincial and Canadian Federal Park passes as well as photography permits required for Kananaskis and Banff National Park.
Weather, Cancellation & Rescheduling (including Force Majeure)
Sessions may be rescheduled due to unsafe or unsuitable weather (e.g., thunderstorms, hail, extreme cold/heat, high winds). The photographer decides if conditions are unsafe.
For the safety of everyone involved, pets showing signs of aggression or if there is any question to the pet's or photographer's health and safety that cannot be safely managed may result in an immediate end to the session. Session fees are non-refundable in this circumstance.
Cancellations or reschedules must be requested at least 72 hours before the session. Less notice may result in forfeiting the retainer, except in cases of illness, death, or serious emergency.
Image reveal/purchasing appointments must be cancelled 24 hours in advance. Missed appointments without notice will incur a $50 rescheduling fee.
Force Majeure: Neither party shall be held liable for events beyond their reasonable control, including but not limited to natural disasters, illness, strikes, accidents, acts of war, or government restrictions. In such cases, sessions will be rescheduled at the earliest possible date or refunded.
Session Conduct
Sessions are limited to members and pets of the same household. Additional households may be added for $100 each, after the session the $100 will be used as a product credit for members of that household.
Sessions begin and end at the scheduled time regardless of late arrival. If {clientFull} is more than 30 minutes late, the session will be considered a no-show and must be rebooked at a full session fee.
Completion & Delivery Timeline
Proofs: Delivered within 2 weeks of the session via an in-person or online reveal and purchase appointment. All parties involved in household purchases must be in attendance to choose the images and review the purchase cost.
Final Digital Images: Each artwork purchase includes the corresponding digital file. If the total purchase price exceeds $3,000, all high-resolution gallery images from the session will be included. Final digital images will be delivered within 2 weeks of final artwork/image selection and full payment via a secure online gallery.
Artwork: Artwork is ordered once payment is made in full. Delivery times vary by product, typically 4–8 weeks. All sales are final. Final orders must be placed at the purchase appointment, and full payment is due no later than 24 hours afterward.
Archiving: Images are kept for 1 year. A $50 fee applies to reactivate any expired galleries within 60 days. After 60 days, a $250 fee is required to unarchive images or for a minimum product order of $250.
{clientFull} is responsible for downloading and backing up purchased files within 1 month of delivery.
Prints and Products
One mounted 5x7 print is included in the $100 session fee. Additional digital images, prints, and products are not included in the session fee and must be ordered separately through Aubri Poon Photography.
Any print or album credits expire one year from the session date. Gift Certificates do not expire; however, they are subject to the pricing policy stated below.
Pricing Policy
All quotes, invoices, and price lists provided by Aubri Poon Photography are valid for 30 days from the date issued. Payments made within this period will be honoured at the quoted rate. Any unpaid balances after 30 days are subject to the current pricing in effect at the time of payment.
All sales are subject to 5% GST. All balances must be paid prior to product ordering.
Satisfaction Guarantee
Aubri Poon Photography is committed to providing a professional experience and high-quality artwork. If {clientFull} is not satisfied with the images from their session, a complimentary re-shoot may be offered at the photographer’s discretion and limited to 1 re-shoot and are scheduled based on the photographer’s availability. The re-shoot will be limited to the original session type and does not include additional locations, people, or pets. No refunds will be issued once a session has taken place, but Aubri Poon Photography will make every reasonable effort to deliver images that {clientFull} loves.
