Maternity Session

Your Session fee is due prior to completion of this form and on comfirming availability.

Your Session fee does not include any products, images or prints. Your collection package will be chosen and paid for at your viewing appointment which will be arranged with you following your session. If you have chosen to buy the digital package, this will be paid for in full at your session.

Commencing your session, your images will be edited within the agreed timeframe. You will have been provided with a price list showing pricing for additional products and wall art.

Session fee amount may vary depending on offers advertised and session booked. Please refer to Photographers instructions for payment.

*If you are signing for model work initiated by the Photographer, all session fee's are waivered.

COPYRIGHT: As a client of Rose&Cale Photography, I acknowledge and understand that the images taken by Rose&Cale Photography, PHOTOGRAPHER; Diana Zaccaria, are owned in full by Rose&Cale Phtography and protected by Copyright Laws.

COPYRIGHT: I understand it is ILLEGAL to copy or reproduce these photographs elsewhere without the PHOTOGRAPHER's permission, and violaters of this Law will be subject to its civil and criminal penalties. A limited PRINT RELEASE is supplied with the purchase of my digital files, to print your portraits for your own personal use. The print release does not allow publication of your portraits (i.e. entering in contests), selling or altering your images without the PHOTOGRAPHER's permission. Reproduction includes, but is not limited to scanning, downloading, right-clicking, emailing, saving to harddrive, posting on websites or blogs, photocopying, obtaining screen shots, or printing in any manner. I agree to honor the copyright laws as stated in this agreement.

PORTRAIT AGREEMENT & MODEL RELEASE: I have read and agree to the following statement: I commission Rose&Cale Photography, the photographer, to photograph myself and/or my underage children.

PORTRAIT AGREEMENT & MODEL RELEASE: I hereby grant Rose&Cale Photography, the right to use and publish photographs of myself, family, and/or child(ren), or in which myself, family, and/or children will be included, for editorial, trade, advertising, and any other purpose and in any manner or medium; to alter the same without restriction; and to copyright the same. I hereby release Rose&Cale Photography, Diana Zaccaria and her legal representatives and assigns from all claims and liability relating to said photographs.

RESCHEDULING/ILLNESS: Due to the nature of the business, we try to create a strict timeline that will be enforced to ensure that all schedules run smoothly. The session will start at the scheduled start time, even if the Client is late. The session end time will remain the same. Clients arriving more than 30 minutes late may forfeit their session and no refund will be given. If an illness or situation prevents a photo session from taking place, client may reschedule their session at least 24 hours prior to their shoot without penalty. Should client fail to give 24 hours notice, or decide to completely cancel the shoot, this session fee is forfeited and will not be refunded. Photographer reserves the right to reschedule due to illness, weather, equipment malfunction, or other circumstances beyond their control. Re-shoots are determined at the discretion of the photographer. Re-shoots and refunds will not be given for poor choices of clothing, make-up, hair or weather related issues, or by not following the recommendations of the photographer. The Session fee will not be refunded should a client cancel their session and fail to reschedule

IMAGE ARCHIVE: After six (6) months, all images will be purged from photographer’s hard-drive, except as needed for promotional purposes, to be determined by photographer at photographer’s sole discretion. Photographer is not responsible for loss or damage to the digital files due to circumstances beyond photographer’s control.

LIABILITY: Photographer is not responsible for any injuries inflicted upon any participating parties that is no fault of the Photographer. Client(s) will be responsible for their children and for themselves and release photographer from any claims against their person or their business. In the unlikely event that photographs have been lost, stolen, or destroyed for reasons within or beyond studio control, studio liability is limited to the return of all payments received for the session. The limit of liability for a partial loss of originals will be a prorated amount of the exposures lost based on the percentage of total number of originals.

SESSION FEES: Your session is confirmed by payment of the non-returnable session fee. The fee is required to book and secure the time and services of the photographer for the session, and until it is paid the session is not confirmed. Additional editing is available at additional expense to be determined by photographer. There is a session fee due when booking your newborn/maternity/glitter/birthday session. This session fee covers ONLY your studio session and use of props, outfits and boutique dresses. Please be familiar with this in Package Payment terms. Your images can be purchased as part of a package when you attend your viewing session. Additional products and prints can be purchased in addition to a package.

PACKAGE PAYMENT: There is a session fee due when booking your newborn/maternity/glitter/birthday session. All payments of packages and products/digitals/prints are due in full at your photo session. Orders will not be processed until payment in full is received. Additional prints or wall products may be available for purchase subject to image archive restrictions.

IMAGE RETOUCHING/EDITING: Rose & Cale Photography shall be entitled to use their judgement regarding the style and artistic input in the production of the images. This includes, but is not limited to locations, poses and number of images taken. All images are edited before being presented to the Client. Additional edits are carried out at the discretion of Rose & Cale Photography. The Photographer also reserves the right to charge the Client for requested additional editing requested to cover time involved.

By signing below you certify that You are at least 18 years of age. You have read this portrait agreement/contract and fully understand the contents thereof. You agree that you have the legal authority to grant these permissions and accept all responsibility for such.
