  • RIGHT OF ENTRY AND RELEASE FOR LEAD SERVICE LINE REPLACEMENT

    The Borough's records reflect that the water service line from the Borough's water main to your home may be made of lead, or other materials containing lead such as brass or galvanized iron/steel. Although the lead service line is owned by you (as the property owner), the Borough believes that providing clean, lead-free drinking water to its residents is a public purpose beneficial to the Borough. The Borough enacted Ordinance 2024-014 to implement the mandatory replacement of lead service lines to lead-free service lines within the Borough. You can choose to have the Borough fully replace your lead service line with a new one at no cost to you. You also have the option to replace the lead service line at your own cost and expense. Whichever option you choose, under the Ordinance, the lead service line must be replaced. If you would like to participate in the lead service line replacement program, then you must complete this form per the instructions provided below. The Borough's Contractor and other Representatives will need access to your property to perform the work associated with the Lead Service Line Replacement ("Replacement Work" This Replacement Work includes access to the water meter inside your home, and involves: shutting off your water service for approximately eight (8) hours; removing your existing lead service line; replacing the lead service line with a new line (from the street to your home, and through your basement wall to the existing water meter); connecting the new service line to the Borough water main and flushing the new service line. Before beginning work, the Borough's Contractor will notify you when they will be on your property to perform the work. It is your responsibility to provide reasonable access and a working area for the Contractor at the service line and water meter location as requested by the Contractor. The Contractor and Borough Representatives may continue to enter onto your property until construction is completed, and both you and the Borough accept the work. The Borough's Contractor and Representatives will suitably identify themselves prior to entering the property.

    complete lead service line replacement work on the Property.I

    authorize the Borough and its contractors, agents, and employees to: take photographs and videos of the interior and exterior of the Property in the area of the water service line before and after installation; bring workers, material, equipment, and supplies onto the Property, and; utilize the Property for the purpose of performing the work necessary to replace the lead service line.

    TENANTS, PLEASE PROVIDE A COPY OF THIS RIGHT OF ENTRY TO YOUR LANDLORD TO

    AUTHORIZE AND SIGN. If your property is a rental property, then please notify your tenant(s) of your participation in the Lead Service Line Replacement Program and the scheduled work.

    Pursuant to Borough Ordinance, Chapter 275-27 (B), the owner of a dwelling, building, or structure shall replace their lead service line by any of the following methods: Grant the Borough and its Representatives and Contractor the right to enter your property to replace your lead or galvanized iron/steel service line.

    Agree to replace your lead service line on your own and at your own expense within 180 days and submit proof of the completed work to the Borough Water Department.

    REPLACEMENT, YOU, THE UNDERSIGNED, HEREBY RELEASE AND FOREVER DISCHARGE, HOLD

    HARMLESS AND INDEMNIFY THE BOROUGH AND ITS EMPLOYEES AND REPRESENTATIVES

    (COLLECTIVELY THE "BOROUGH") FROM ALL LIABILITY FOR INJURY, DEATH, DAMAGE, OR LOSS TO PERSONS, REAL PROPERTY, OR PERSONAL PROPERTY IN CONNECTION WITH OR ARISING

    FROM THE PERFORMANCE OF THE LEAD SERVICE LINE REPLACEMENT. YOU AGREE TO HOLD

    ONLY THE BOROUGH'S CONTRACTOR, ACTUALLY PERFORMING THE WORK, RESPONSIBLE TO PAY

    ANY CLAIM IN CONNECTION WITH OR ARISING FROM THE PERFORMANCE OF THE LEAD

  • SERVICE LINE REPLACEMENT FOR ANY SUCH INJURY, DEATH, DAMAGE OR LOSS TO PERSONS,
