Waiver of Liability

The Washtenaw Public Service Fitness Challenge is part of the Saline Food Truck Festival. This event is a fundraiser for Saline Area Social Service (SASS) which is a nonprofit organization that provides food, emergency aid, and support for those in need in the Saline Community.

INSTRUCTIONS: Before participating in the Public Service Fitness Challenge activities at the Food Truck Festival sponsored by SALINE AREA SOCIAL SERVICES, INC (“SASS”), you must read and sign this Waiver of Liability.

IN CONSIDERATION FOR being permitted to participate any of the above activities sponsored by SASS (“Activities”), I agree to the following Waiver of Liability (“Agreement”):

Waiver and Release of Liability: My participation in Activities is voluntary and subjects me and my guests to the possibility of physical injury (which could be minimal, serious, and/or result in death) and loss of or damage to my property (collectively, “Risks”). Accordingly, I agree to the following:

a) I release and hold harmless SASS, its officers, board of directors, employees, representatives, agents, volunteers, and contractors (the Released Parties) from any claim, demand, loss, liability, damages, attorney fees and costs whatsoever arising from, related to, or resulting from these Risks, including those caused by the negligent acts or omissions of any of the Released Parties.

b) I expressly assume the risk of participating in the Activities.

c) I am solely responsible for any and all medical and related bills that I may incur because of an injury, as well as costs related to loss or damage to my property, that I may sustain as a result of my participation in Activities.

d) This agreement shall be binding on my estate, heirs, next of kin, personal representatives, executors, administrators, successors, and assigns, as well as any other party asserting a claim on my behalf or on behalf of my estate and be binding on any of my guests.

e) I agree that this Agreement and, when applicable, the attached Parent/Guardian Waiver for Minors are intended to be broad and inclusive as permitted by Michigan law, and that if any provisions of this Agreement or the Parent/Guardian Waiver for Minors is held invalid or otherwise unenforceable, the enforceability of the remaining provisions shall be not impaired.

2. General Provisions:

a) I expressly agree that (1) this Agreement shall be governed and construed according to the laws of the state of Michigan and (2) any action or proceeding concerning any claim or the meaning or effect of any provision of the Agreement or the attached Waiver for Minors shall be conducted only in the federal or state courts located in Washtenaw County or the Eastern District of Michigan, and I expressly submit to the jurisdiction of such courts.

b) This Agreement contains the entire understanding between the parties concerning these matters. No waiver or amendment of any of the terms of this Agreement shall be effective unless made in writing and signed by the parties.

I acknowledge that I have read and understand this Agreement and sign it voluntarily. I further acknowledge and agree that I will abide by all rules and procedures stated by the Released Parties while participating in the Activities.

Parent/Guardian Waiver for Minors

When a minor is present, a parent or legal guardian must always sign this Parent/Guardian Waiver for Minors. The parent or legal guardian represents that he or she is acting in such capacity. The parent or guardian further agrees, on behalf of himself or herself and the minor, that all the terms and conditions of the above Waiver of Liability Agreement shall be incorporate herein by this reference and shall apply to the minor identified below during the child’s minor status or after he or she has reached the age of 18 The parent or guardian acknowledges that he or she has read and understands both the above-stated Agreement and this waiver, and he or she is signing both documents voluntarily.
