I hereby release Northeast Opportunities for Wellness, Inc. (NOW) from any and all claims of liability, personal injury or property damage arising from participation in this program. I understand that participation in sports involves some element of physical contact and I certify that my child is in good health and able to participate in all activities. If any attention is required for illness or injury, I give my permission to NOW staff member(s) for such care. I give consent for my child to be photographed or videotaped during the program and release use of the images by NOW for promotional purposes.

As a voluntary participant in the Quinebaug Valley Community College Foundation “Tackle the Trail”, I understand that running and walking a trailrace is a potentially hazardous activity. Specifically, I understand that by the very nature of this event there are inherent risks involved in participating which include the risk of serious physical injury or death.  I understand that the trail race route is a trail which, for the most part is unpaved and unimproved and which crosses over several roadways with vehicular traffic lacking pedestrian warnings, crosswalks or traffic control signals at such crossings. By voluntarily participating in this event, I fully assume all risks associated with this event, even if due to any negligence, conduct, acts or omissions of the Quinebaug Valley Community College Foundation, its officers, directors, agents, servants and employees,race officials, volunteers, race participants, property owners, and/or race sponsors, including, but not limited to, the condition of the trail including the presence of unpaved, uneven,slippery or rough terrain, the crossing of the trail over roads with vehicular traffic, the effects of the weather including extreme temperatures and precipitation on both the trail itself and the participants, contact with other participants, the possibility of trips, slips, falls, and crashes, the lack of warnings or inadequate warnings, and the like.I further understand that a trailrace is, by its very nature, a strenuous physical activity and therefore I should not participate in this trail race event unless I am medically able and sufficiently trained to do so.Knowing these facts, for, and inconsideration of, my participation in this race, I, for myself and my heirs, assigns,successors, executors, administrators and legal representatives, agree I will defend, indemnify and hold harmless the Quinebaug Valley Community College Foundation, its officers, directors, agents, servants and employees, race officials, volunteers, race participants, property owners, and/or race sponsors, from ANY AND ALL actions, claims, suits and demands by anyone arising from my participation in the Quinebaug Valley Community College Foundation “Tackle the Trail” including but not limited to any and all claims against the Quinebaug Valley Community College Foundation, its officers, directors, agents, servants and employees, race officials, volunteers, race participants, property owners and/or race sponsors.Knowing these facts, for, and inconsideration of, my participation in this race, I, for myself and my heirs,assigns, successors, executors, administrators and legal representatives,hereby release, and agree I will not sue or otherwise bring a claim, action ordem and against the Quinebaug Valley Community College Foundation, its officers,directors, agents, servants and employees, race officials, volunteers, race participants, property owners, and/or race sponsors for money damages resulting from death, personal injury or property damage sustained by me arising from my participation in the Quinebaug Valley Community College Foundation “Tackle the Trail”, including but not limited to any and all claims against of the Quinebaug Valley Community College Foundation, its officers, directors, agents, servants and employees, race officials, volunteers, race participants, property owners and/or race sponsors.I represent that I am eighteen (18) years of age or older or, if I am signing this agreement on behalf of a person who has not reached the age of eighteen (18) years, that I have the legal authority to do so.  I have read this WAIVER, INDEMNIFICATIONAND HOLD HARMLESS AGREEMENT, AND RELEASE OF LIABILITY and fully understand and accept its terms.  I understand that by signing this agreement that I am giving up substantial legal rights. I have not been induced to sign this agreement by any promise or representation and Isign it voluntarily and of my own free will.I also grant full permission to sponsors and others to use photos or video of my participation in this event without requesting any additional consideration in return.
