Assumption of Risk
Participant and Parent/Guardian (collectively, “Participant Parties”) understand the nature of lacrosse activities, the physical demands of participation, and the types of injuries, illnesses, and risks—known and unknown—that may arise from participation or from treatment of any related medical condition. Participation in lacrosse activities, events, and the use of any associated facilities is voluntary. By taking part, the Participant Parties knowingly and expressly assume all risks of participation.
Defined Parties
For purposes of this agreement, Snipers Lacrosse Inc. and SoFlo Tournaments are referred to collectively as the “Event Operators.” The Event Operators, along with their members, directors, officers, employees, volunteers, sponsors, agents, and affiliated facilities, are referred to collectively as the “Released Parties.”
“Claims” refers to all claims, demands, actions, suits, damages, losses, liabilities, and expenses (including attorney fees). “Participant Affiliates” refers to the Participant’s guests, relatives, or family members.
Waiver and Release of Liability
In consideration for the Participant’s involvement in any Event Operators’ activity or event, the Participant Parties, on behalf of themselves and Participant’s heirs, next of kin, personal representatives, assigns, and/or unborn child(ren), hereby waive, release, and covenant not to sue the Released Parties for any and all Claims arising out of or related to the Participant’s participation in lacrosse activities or events, the condition of any facilities, property, or equipment, the actions of third persons, and the active or passive negligence of the Released Parties. This waiver includes, but is not limited to, Claims involving personal injury or illness (including death), property damage, theft, loss of personal belongings, or invasion of privacy. This waiver remains in effect for the entire duration of participation and each time the Participant uses any Event Operators’ facilities or attends any Event Operators’ sanctioned event.
Indemnification
The Participant Parties agree to defend, indemnify, and hold harmless the Released Parties from any and all Claims brought by any third party—including Participant Affiliates—arising from the Participant’s participation in any Event Operators’ activity or event, the conduct of the Participant or Participant Affiliates (including negligent, intentional, or criminal conduct), or any damage caused to persons or property. This indemnification obligation extends to all losses, damages, and attorney fees incurred by the Released Parties.
Acknowledgment of Rules & Conduct
Participant agrees to abide by all Competition Rules, Codes of Conduct, and policies published by the Event Operators at www.soflotournaments.com. Failure to comply may result in removal from the event without refund.
Severability
This agreement is intended to be as broad and inclusive as permitted by applicable law. If any portion is held invalid, the remainder shall continue in full force and effect.
Acknowledgment of Understanding
The Participant Parties affirm they have read this agreement, fully understand its terms, and acknowledge that they are giving up substantial legal rights, including rights to recover damages from the Released Parties. They sign the agreement freely and voluntarily and intend it to be a complete and unconditional release of liability to the maximum extent allowed by law.
NOTICE TO THE MINOR CHILD AND NATURAL GUARDIAN
READ THIS FORM COMPLETELY AND CAREFULLY. YOU ARE AGREEING TO LET YOUR MINOR CHILD ENGAGE IN A POTENTIALLY DANGEROUS ACTIVITY. YOU ARE AGREEING THAT, EVEN IF SNIPERS LACROSSE INC. AND/OR SOFLO TOURNAMENTS USE REASONABLE CARE IN PROVIDING THIS ACTIVITY, THERE IS A CHANCE YOUR CHILD MAY BE SERIOUSLY INJURED OR KILLED BY PARTICIPATING IN THIS ACTIVITY BECAUSE THERE ARE CERTAIN DANGERS INHERENT IN THE ACTIVITY WHICH CANNOT BE AVOIDED OR ELIMINATED. BY SIGNING THIS FORM, YOU ARE GIVING UP YOUR CHILD’S RIGHT AND YOUR RIGHT TO RECOVER FROM SNIPERS LACROSSE INC. AND/OR SOFLO TOURNAMENTS IN A LAWSUIT FOR ANY PERSONAL INJURY, INCLUDING DEATH, TO YOUR CHILD OR ANY PROPERTY DAMAGE THAT RESULTS FROM THE RISKS THAT ARE A NATURAL PART OF THE ACTIVITY. YOU HAVE THE RIGHT TO REFUSE TO SIGN THIS FORM, AND SNIPERS LACROSSE INC. AND/OR SOFLO TOURNAMENTS HAS THE RIGHT TO REFUSE TO LET YOUR CHILD PARTICIPATE IF YOU DO NOT SIGN THIS FORM.
Parent/Guardian Consent
By signing below, the Parent/Guardian confirms consent for the Participant to engage in the Event Operators’ activities and acknowledges that all risks are expressly assumed and all related Claims are waived in advance.
Electronic Signature Agreement
By submitting this form electronically, I acknowledge that my electronic signature is legally binding, that I have read and agree to all terms of this waiver, and that I am voluntarily registering myself or my child to participate in an Event Operators’ activity. I confirm that the participant is in good health and physically able to participate safely, and I authorize Event Operators’ staff to seek emergency medical care if necessary and accept responsibility for any associated costs. I also grant permission for the use of event photographs or video recordings for promotional purposes, including websites, marketing materials, and social media.
