  • 1. Summary of the Contract: The decorator is responsible for providing the Client(s) a decoration service as detailed in Section 2 (services).  The Client(s) agrees to contract the decorator for this service for the price as detailed in Section 2.

    1a. COVID-19 For safety, if Covid is deemed as high risk the decorator will be wearing a mask during setup.  Client(s) are also asked to wear a mask and remain 6 ft from decorator while the setup is completed.  Contactless payment options are preferred via zelle or cashapp during this time.

    3. Booking & Retainer A non-refundable retainer is required to secure the event date. Retainers are applied towards the total balance. The remaining balance must be paid in full no later than 1 day prior to the event. Failure to pay the remaining balance will result in cancellation of services without refund of the retainer

    Express Booking Fee: Events booked within 14 days before event are subject to a $50 express event fee. Retainier fee would be waiver and 50% payment is due immediately to be able to order required material. No events will be booked within a 3 day notice. 

    6. Design Details Client(s) are encouraged to submit inspiration photos and desired color palettes at least 2 weeks before event. DateNight & Beyond can also suggest ideas and provide custom graphic design services (welcome signs, Banners, Personalized items, and/or Photo backdrop)

    6a. Custom graphic design will not begin until all client images are approvals are recieved. Design services starts at $75 per item, with typical pricing range $75-$250 depending on size and complexity. Fees include original creative design, professional layout, and up to two rounds of edits. Additional revisions are billed at $25 per round

    6b. Printing and material all printed item (sign, banners, backdrops, etc.) will be ordered by DateNight & Beyond on behalf of the clients. Printing costs are billed separately and includes a 20% handling fee for sourcing, ordering, and coordination. Printed items will be delivered to the event location by DateNight & Beyond as part of the setup services. 

    6c. Digital-Only designs are also available if the client prefers to arrange their own printing

    7. Pick Up Order for client(s) who only purchase a pre-made balloon garland without installation or additional decoration service, full payment (non-refundable) is required in full at time of booking. Balloon Garland will not start without payment.

    Garlands must be picked up by the client at the agreed-upon location between 9:00 AM and 3:00 PM on the scheduled date. Once the garland is picked up, DateNight & Beyond is not responsible for transportation, handling, or any damages that may occur after pickup.

  • 8. Plan Modification: Client(s) may make reasonable modification to the contract up to 1 week before the Event date. All modification must be executed via email or text. The Decorator is not obligated to accept any modification, and any approved modification may result in additional charges, which must be paid before the event date.

    9. Appropriate Conduct/ Safe Working Environment: The Client(s) expressly agree(s) to take best efforts to provide the Decorator and staff with a safe and appropriate working conditions. Decor setup cannot be completed in unsafe or unsanitary environment (e.g., excessive clutter, pests, or hazardous conditions). In the event of circumstances deemed by either Decorator or staff a threat, or implied threat of injury or harm, the Decorator reserves the right to cancel all services remaining under this Agreement and leave grounds of services. The Client(s) shall be responsible for payment in full. 

    10. Weather: When booking your event date, please keep in mind the weather conditions.  Events during extreme weater conditions are encouraged to take place at an enclosed/ indoor location. During summer, it is sometimes not possible to retain the exact color of balloons if they are directly exposed to the sun.  Balloons may pop when exposed directly to sunlight for extended periods of time.  Similarly, when it is very windy, balloons may move more than expected and/or fly away regardless of how secure they are if they're outdoor/uncovered. DateNight & Beyond is not responsible for damages, deflation, or changes in appearance of balloons/decor caused by outdoor weathter conditions.

     

    11. Impossibility:

    a) Force Majeure. Either party may choose to be excused of any further performance obligations in the event of a disastrous occurrence outside the control of either party, such as, but not limited to: 1.)A natural disaster (fires, explosions, earthquakes, hurricane, flooding, storms or infestation); or 2.)War, Invasion, Act of Foreign Enemies, Embargo, or other Hostility (whether declared or not); or 3.) Any hazardous situation created outside the control of either party such as a riot, disorder, nuclear leak or explosion, or act or threat of terrorism. In such cases, payments made are non-refundable but may be credited towards a future event, at the sole dicreation of DateNight & Beyond

    b) Failure to Perform Services. In the event DateNight & Beyond cannot or will not perform its obligations in any or all parts of this Agreement, it will: 1.)Immediately give Notice to Client(s) via phone and email; and 2.)Issue a refund or credit based on a reasonably accurate percentage of Services rendered; and 3.)Excuse Client of any further performance and/or payment obligations in this Agreement.

    12. Attendance: Decorator requires 2 hrs to setup all decorations before the event starts and 30 minutes post event to break down setup and clean up. Client will keep banner and/or balloons as desired. Decorator will discard of any decorations/balloons the client does not wish to keep. In the unlikely event that the Decorator is unable to complete the coverage due to unforeseen circumstances, the Decorator shall notify the Client of the name and contact information of the person who will set up the decorations.   If the Client is unable to attend the event as outlined due to unforeseen circumstances he/she is responsible to notify the Decorator. 

    13. Cancellations/Rescheduling: If the client(s) cancels the event due to related illness, nonrefundable deposit may be applied to reschedule the event. Event can be rescheduled up to 14 days later based on decorator's availability.  

    14. Promotional Rights The Client(s) grants the Decorator full rights to use any photographs, video footage, or other media taken at the event for promotional purposes on DateNight & Beyond social media accounts and website. 

     

    The Client hereby releases DateNight & Beyond of all liability for injury and/or property damage to venue or event location.  The undersigned have read and understood the contract and agree to the terms and conditions in their entirety.
