### Eclipse Kickboxing Membership Terms and Conditions
Welcome to Eclipse Kickboxing! We are excited to have you as a member of our martial arts academy. To ensure a smooth experience for all members, please review and adhere to the following terms and conditions.
Membership Requirements
1. **Membership Agreement**:
- By signing up for a membership at Eclipse Kickboxing, you agree to abide by the terms and conditions outlined in this document.
- Membership options include a one-year term and a month-to-month term.
2. **Payment of Fees**:
- All membership fees are to be paid via Direct Debit.
- For one-year term memberships, Direct Debit payments are required throughout the duration of the term.
After the completion of the one-year term, the membership will automatically continue on a month-to-month basis unless canceled by providing a 30-day notice.
- For month-to-month memberships, payments are due monthly, with a 30-day notice required for cancellation.
3. **Cancellation and Notice**:
- One-year term memberships cannot be canceled mid-term unless under exceptional circumstances approved by management.
- After the one-year term, the membership will continue on a month-to-month basis, requiring a 30-day notice for cancellation in writing.
- Month-to-month memberships also require a 30-day notice for cancellation. The final payment will be due during this notice period.
Cancellation requests can be made through the ClubRight app in the Members Area.
Participation, Injury Risk and Protective Equipment
Martial arts, kickboxing, boxing, Brazilian Jiu-Jitsu, sparring, fitness training and other combat-sport activities involve physical contact and an inherent risk of injury.
Participants and, where applicable, their parent or legal guardian understand that injuries can occur even when activities are properly supervised and reasonable safety precautions are followed. These may include bruising, cuts, strains, sprains and other minor injuries, as well as less common but potentially serious injuries.
By taking part, participants agree to:
- Follow all instructions and safety rules given by Eclipse instructors.
- Inform an instructor before participating about any injury, illness or medical condition that may affect their ability to train safely.
- Stop training and notify an instructor if they become injured, unwell or unable to continue safely.
- Obtain, wear and properly maintain the protective equipment required for their activity, including boxing gloves, shin guards, a mouthguard, groin guard and headguard where instructed.
- Refrain from sparring or contact training without the protective equipment required by the instructor.
Eclipse may prevent a participant from taking part in sparring or any other activity if the required protective equipment is not being worn or is considered unsuitable.
For participants under 18, the parent or legal guardian is responsible for ensuring that the child has suitable protective equipment and understands the relevant safety rules.
Eclipse maintains appropriate insurance; however, this does not mean that compensation will automatically be available for every injury. Participants accept responsibility for the ordinary minor injuries and inherent risks reasonably associated with combat sports.
Nothing in these terms excludes or limits Eclipse’s legal responsibility for death or personal injury caused by its negligence, or any other liability that cannot legally be excluded.
#### Consequences of Non-Compliance
1. **Direct Debit Cancellations**:
- If a member cancels their Direct Debit without authorization, we will make three attempts to contact the member to reinstate their Direct Debit.
- Failure to respond or comply after three contact attempts will result in the matter being escalated to a collections company.
2. **Collections Process**:
- If your account is sent to collections due to non-payment or unauthorized Direct Debit cancellation, additional charges will apply.
- These charges will include any fees imposed by the collections company in addition to the outstanding membership fees.
- Once the debt is with the collections agency, Eclipse Kickboxing will no longer be able to manage or settle the debt directly.
- Having a debt sent to a collections agency may negatively affect your credit score.
3. **Legal Action**:
- Persistent non-compliance with payment terms may result in legal action to recover the owed amounts, including any additional legal fees incurred.
#### Keeping Track of Debts
- Members can keep track of their payment status through the ClubRight app.
- If you have any questions or concerns about your payments, please contact us promptly to avoid escalation.
