Acuerdo de diseño, desarrollo y alojamiento de sitios web

Este Acuerdo de Diseño, Desarrollo y Alojamiento de Sitios Web ("Acuerdo") se celebra de acuerdo a la fecha ingresada con Nicoya Tech DBA, un DBA registrado en Florida ( en adelante denominada “Empresa”) y el cliente. 

 

1. Diseño y Desarrollo de Sitios Web. El Cliente acepta pagar a la Compañía la suma de $599 USD (el “Precio del Contrato”) para diseñar y desarrollar un sitio web para el Cliente (el “Sitio web del Cliente”). Un sitio web de 5 páginas se estará creando para el cliente. Se requiere proveer toda la información que se requiere via una sesión telefónica, via WhatsApp o llenar el formulario en linea. Tendrá 5 días después de este contrato para realizarlo. Proveer información sobre su empresa, información para incluir en su página, imágenes, etc.

1a. Cambiar órdenes. Antes de entregar su sitio web usted va a tener la oportunidad de revisarlo. Pudiéramos realizar cualquier revisión antes de la entrega final.
1b. Pendiente Fechas y retrasos. Nosotros vamos a tener listo su sitio web en 14 días hábiles. Para evitar retrasos necesitamos la cooperación del cliente como proveer información de su empresa, imágenes, etc.
1c. Derechos de autor. El cliente confirma y acepta que el logotipo que proporciona, el texto escrito y las imágenes son propiedad del cliente. Nosotros, la empresa, no somos responsables de la infracción de derechos de autor de ningún material que usted nos proporcione para colocar en el sitio web. Usted acepta eximirnos de toda responsabilidad en caso de cualquier reclamo por infracción de derechos de autor en el futuro.

2. Dominio y hosting. Incluimos el dominio si el costo es menos de $10, si es más Ud. lo tuviera que pagar. El hosting, versión gratis está incluido. Si Ud. quiere un hosting privado el costo mensual fuera de $38 mensuales.
3. Derechos de propiedad. Eres dueño de tu sitio web. No somos dueños de su sitio web. Tu sitio web siempre estará en Internet si tienes un plan de hosting gratuito pagado con dominio/subdominio. Ud. tendrá acceso a su página, igual nosotros.

6. Atención al Cliente o Reclamaciones. Las preguntas sobre hosting y dominio deben dirigirse a wix.com. Antes de presentar una queja o una reseña negativa, le pedimos que primero aborde el problema con nosotros escribiéndonos a: contact@nicoyatech.com Por lo general, podemos solucionar cualquier queja.
7. Confidencialidad Toda la información que usted nos provee sobre su negocio, información personal o financiera será confidencial. Igual cualquier información que nosotros le proveemos sobre nuestra empresa.
8. Ley aplicable a la resolución alternativa de conflictos Este Acuerdo se regirá e interpretará de conformidad con las leyes de Florida. Cualquier disputa o diferencia que surja de este Acuerdo o esté relacionada con él se someterá a arbitraje o mediación/negociación de conformidad con las leyes de Florida y sujetas a ellas.
9. Acuerdo completo Este Acuerdo contiene el acuerdo completo y el entendimiento entre las Partes con respecto a su tema.
10. Renuncia de garantías y otras políticas La empresa de desarrollo web o el diseñador garantiza completar los Servicios enumerados en este Acuerdo según los requisitos y especificaciones del Cliente. Si el cliente no coopera con la información que pedimos pudiera a ver atrasos o no poder finalizar el sitio, no asumimos la responsabilidad por falta de cooperación del cliente.
11. Firma y fecha Las Partes por el presente aceptan los términos y condiciones establecidos en este Acuerdo y así lo demuestran sus firmas a continuación. Una firma digital o recibir este documento electrónicamente por correo electrónico, mensaje de texto o WhatsApp vincularán mutuamente este acuerdo.

This Website Design, Development and Hosting Agreement ("Agreement") is entered into on

Nicoya Tech DBA, a DBA registered in Florida (hereinafter referred to as “Company”

1. Website Design and Development. The Client agrees to pay the Company the sum of $599 USD (the “Contract Price”) to design and develop a website for the Client (the “Client Website”) in accordance with the attached Scope of Work which is a 5 page website will be created for the client. It is required to provide all the information required via a telephone session, via WhatsApp or fill out the online form. You will have 5 days after this contract to carry it out. This means provide info about your company, images, content you want to include, etc.
1a. Change orders. Before submitting your website you will have the opportunity to review it. We could make any revisions before final delivery
1b. Pending Dates and delays. We will have your website ready in 14 business days. To avoid delays we need the customer's cooperation such as providing information about your company, images, etc.
1c. Copyright. The client confirms and agrees that the logo provided, written text and images are the property of the client. We, the company, are not responsible for copyright infringement of any material you provide to us to place on the website. You agree to hold us harmless in the event of any future copyright infringement claims.
2. Domain and hosting. We include the domain if the cost is less than $10, if it is more you will have to pay it. Hosting, free version is included. If you want private hosting the monthly cost would be $38 per month.
3. Property rights. You own your website. We do not own your website. Your website will always be on the Internet if you have a free paid hosting plan with domain/subdomain. You will have access to your page, as will we.
4. Payment Conditions. By signing this Agreement, Customer agrees to pay Company a total of $599USD. The client must prepay $299 upon signing this agreement, which is 50%, and pay the remaining $299 two weeks later or upon completion of the Scope of Work. The 1st payment is non-refundable. We can credit that payment for other services or when you have the money to pay the 2nd payment to finalize the services of this contract, you will have 4 months to use said credit.

Confidentiality All information you provide us about your business, personal or financial information will be confidential. Same as any information that we provide you about our company. 8. Law Applicable to Alternative Dispute Resolution This Agreement shall be governed by and construed in accordance with the laws of Florida. Any dispute or difference arising out of or related to this Agreement shall be submitted to arbitration or mediation/negotiation in accordance with and subject to the laws of Florida. 9. Entire Agreement This Agreement contains the entire agreement and understanding between the Parties with respect to its subject matter. 10. Disclaimer of Warranties and Other Policies Web development company or designer warrants to complete the Services listed in this Agreement to Customer's requirements and specifications. If the client does not cooperate with the information we request, you could see delays or not be able to complete the site, we do not assume responsibility for the client's lack of cooperation. 11. Signature and Date The Parties hereby agree to the terms and conditions set forth in this Agreement as evidenced by their signatures below. A digital signature or receipt of this document electronically via email, text message or WhatsApp will mutually bind this agreement.
