TERMS
2 Year Live Foal Guarantee
A. 2 year “Live Foal Guarantee”; a live foal by definition, will stand and nurse within 48 hours after birth. This contract is only valid for the year that this contract is dated and the following year and will not be extended into a third year. The LFG does not extend to accidents which result in the death of the foal, such as aggression from the mare or paddock accidents.
B. A maximum of 3 semen shipments will be provided per year to fulfill this contract.
C. After the first collection, additional semen will only be provided if the Mare Owner has provided a completed Breeding passport confirming the mare is not in foal. This must be signed by the Mare Owners veterinarian.
D. The “Breeding Season” is defined as commencing April 1 and concluding on the 1st of October of each calendar year.
E. The breeding fee covers only one (1) live foal.
F. The semen provided under this Agreement shall only be used to inseminate the Mare identified herein, and for no other purpose whatsoever. Mare Owner shall not use, retain, or sell any unused Stallion semen for any purpose whatsoever without written and signed consent by Stallion Manager.
G. Contract can be transferred to another mare of the same Mare Owner with written consent from Stallion Manager. The contract period is not extended.
H. Contract is transferable to new owner or Buyer of mare, should contract mare be sold in foal. The contract period is not extended.
I. Embryo Transfer and ICSI is allowed; however under these specific conditions:
i. Mare Owner must notify Stallion Owner if Mare is to be bred for Embryo Transfer/ICSI.
ii. Contract only allows for one live foal. If additional foals or vitrified embryos are produced, 50% of the stud fee is due within 14 days of birth or vitrification.
iii. No LFG is offered on embryos that are vitrified before transferring to recipient or vitrified embryos intended to be implanted in the future.
N. A clean uterine culture and cytology is required on the mare by a licensed veterinarian if a mare fails to conceive after 2 cycles before a third collection will be shipped. Proof must be provided to the Stallion Manager.
O. If by the end of the breeding season for the first year of this contract the Mare has not settled, or has failed to maintain a pregnancy, Mare Owner agrees to provide written confirmation that the mare is barren, that the mare has a clean uterine culture & cytology, & that the mare has been properly cared for signed by a Veterinarian within 30 days of the end of the aforementioned Breeding Season. The Agreement may then be carried forward to the following year. This contract may not be extended for a third year.
P. If the Mare gives birth but fails to produce a “live foal” as previously defined, Mare Owner must notify Stallion Manager within 48 hours of the foal’s death and provide written certification from a Veterinarian within 5 days. This certification must include verification of the death of the foal, an explanation for the foal’s death, and confirmation that the mare has been properly cared for & monitored during all stages of her pregnancy & foaling. Once this confirmation has been received, the Mare may be rebred to the Stallion, or Mare Owner may substitute a different mare after approval from Stallion Manager.
Q. If the stallion dies or is no longer available during the contract period, one dose of frozen from the same stallion will be made available for each mare if available. Alternatively, the mare owner will be refunded the stud fee.
R. Keystone Farms assumes absolutely no responsibility for any loss or damage to the mare. The Mare Owner shall assume all responsibility for the condition of the Mare and shall bear all risk of loss or damage to the Mare whether by death, disease, injury, infection, or otherwise.
