Contractual Obligations:
Vendors shall indemnify and hold harmless (Worldwide Food Truck Tour, Unique Treasures or Winter Wonderland) and One Event at a Time, LLC, and all parent and Holding Companies and employees from and against any and all loss, liability, damage, cost, and expense, including but not limited to reasonable attorney fees, for injury, death, loss or damage caused by the negligence of the vendor or its officers, employees, agents, customers, licensees, invitees or any other person, while occupancy the premises. Furthermore, all vendors release the right to be used in Worldwide Food Truck Tour's subsequent marketing, advertising, and media coverage of the Festival by the (Worldwide Food Truck Tour, Unique Treasures, or Winter Wonderland) and One Event at a Time, LLC.
All food vendors must comply with all applicable local, state, and federal laws. All food vendors are responsible for obtaining all required business licenses, permits, and taxes for operation. All food vendors must submit all the supplementary documents as requested in the application instructions.
Right to use space, each food vendor must submit the site fee in full as outlined in application instructions. If the food vendor fails to get a City or County permit, the deposit will not be refunded, nor will the vendor be granted space at the Event. After the City or County Permit and supplemental documents are received, Worldwide Food Truck Tours will grant the food vendor the right to utilize space in accordance with all applicable state and city laws and the terms set out below.
The right to space is non-transferable. There are no warranties or guarantees as the Event is a rain-or-shine event. No refund shall be granted once the application is accepted, as the Event is rain or shine. Acts of God, terrorism, and war resulting in event cancellation will not warrant a refund.
~ The space is being rented as-is. Rental equipment is available at inquiry only as supplies are limited.
~ Vendors are recommended to bring their own power source, but an electric power supply outlet will be provided at cost if required. In this case, the vendor would be responsible for providing any and all extension cords.
~ All food vendors must stay within the bounds of the allocated spot.
~ All food vendor spaces will be assigned before the Festival in email communications.
~ No vendors may utilize amplified sound without prior written consent.
~ All food vendors must be set up and ready by 10 am and vacate two hours after the Event has ended. Furthermore, vendors may only vacate the premises once the Festival ends.
~ Only food trucks are allowed within the Event from 10 am until 7 pm. No exceptions.
~ All vendors must remove trash before departing and dumped into proper festival trash receptacles. A $200 fine is imposed on any and all trash remaining.
~ No hot coals may be dumped in festival trash dumpsters as fire may result. A $1200 fine will be imposed on any infractions.
~ All terms of use of the vendor application, instructions, notes, and communications are made applicable within this contract.
(Worldwide Food Truck Tour, Unique Treasures, Winter Wonderland) and its agents and employees reserve the right to inspect all vendor's merchandise to ensure the item is sold as specified in the application.
~ No vendor may sell items prohibited by State or Federal Law, such as baby formula, pharmaceuticals, drugs, etc.
~ No vendor may sell counterfeit and/or stolen merchandise.
~ DUE TO SOME SPONSORSHIP LIMITATIONS, CERTAIN ITEMS MAY NOT BE ALLOWED TO BE SOLD BY VENDORS. (ie. if Pepsi is an event sponsor, food vendors may be limited to sell only Pepsi product, or the event promoter could be the sole seller of soft drinks) PLEASE CONFIRM WITH YOUR EVENT REP PRIOR, TO CONFIRM IF THERE ARE ANY PRODUCT LIMITATIONS AT YOUR EVENT.
~ Any sponsor who evades payment of applicable fees, fines, or the like will result in termination of the contract.
~ No form of discrimination will be tolerated. Such acts will result in the termination of the contract.
~ Any vendor complaints with reasonable proof of misrepresentation of products, giving false information of the product type, consistency, origin, condition, or quality, will range from contract termination to actionable offense.
~ Any vendor who fails to comply with Federal, State, and/or Local Laws will immediately terminate the contract, which may result in legal action. One Event at a Time reserves the right to modify any/and all rules within a written notice to the vendor.
~ This Sponsorship Agreement (the "Agreement") is made and entered into as of the last signature date below (the "Effective Date") by and between One Event at a Time, LLC, with an address of PO Box 71211 Clive, IA 50325, and the Sponsor are identified below ("Sponsor").
ALL FEES MUST BE PAID IN FULL TO COMPLETE THIS APPLICATION, NO EXCEPTIONS. All Fees are Non-Refundable.
