GENERAL INFORMATION

Thank you for your interest in joining us as a Novelty/Info Vendor for the 16th Annual Dia De Los Muertos Festival at the Avondale Goodyear Farms Historic Cemetery. Our festival is a one of a kind artistic and cultural event that honors the memory of our deceased loved ones. Our family-friendly festival provides free live entertainment, arts & crafts, and cultural education to our community. Vendor space is limited, submit your application today!

 

APPLICATION PROCESS

Please submit completed Vendor Application to be considered for selection by September 15, 2024.* 

*Unfinished applications will not be accepted.*

PAYMENT

Vendor Registration Fee payment is due upon submission of application.

1. Novelty/Info (Non-Food) Vendor Space: $60*

2. Non Profit Orgs & Government Agencies (Non-Food) Vendor Space: $30*

   *Vendor Tent Space is (10 ft x 10 ft). Due to limited space, tents larger than (10 ft x 10 ft) will not be accomodated. 

 

DISCLAIMER

• Vendor fees will not be refunded if the festival must be cancelled due to inclement weather, acts of God, or any other circumstance deemed necessary by Festival and City Officials.
• The Vendor, upon payment, understands that Ballet Folklorico Esperanza, Inc. reserves the right to refuse any vendor applications, payments, or reservations at any time and for any reason. If your vendor application is declined, you will be contacted by event coordinators for a refund prior to the event. 
• Ballet Folklorico Esperanza, Inc. reserves the right to select Festival Vendors based on event type, targeted guests, or limit the number of Festival Vendors in a certain category or based on sale products. 
  

VENDOR SPACE

• This event is held outdoors in the parking lot of a historical cemetery. All Vendors will be assigned a space on the asphalt parking lot and not inside the grave area. 
• NO ELECTRICAL POWER OR WIFI WILL BE AVAILABLE AT THIS VENUE.
• Fee includes one (1) 10 ft x 10 ft Tent Vendor space. We will not accomodate larger tent space. 
• All Vendors are required to have a 10x10 tent set up in their space. 
• Vendors are responsible for their own tent, tables, chairs, and displays. 
• Event organizers will not provide any materials for the vendor to set up their space.
• Vendors are not permitted to take chairs, tables, or other items owned by event organizers for their vendor space.
• If using a generator, please include in your vendor space layout diagram/photo.
• Use of generators must be approved by Ballet Folklorico Esperanza, Inc.
• Vendors are responsible for bringing any necessary display equipment and signage.
• Signage must be neat, legible, professional and suitable for family audiences. 
• Event organizers reserve the right to assign all vendor spaces.

PROHIBITED ITEMS

• All food, merchandise and services must be suitable for family audiences.
• Vendors may not sell food, merchandise and services that are of the mature audience content (including literature, imagery, and other media) depicting nudity or explicit sexual acts, smoking or drug paraphenalia. Neither any merchandise be sold that may imply, suggest, or support this type of activity.
• Vendors may not sell food, merchandise and services that are racist or culturally insensitive, political in nature with trademarked slogans or phrases, or items promoting a particular political candidate for any political seat.
• Vendors may not sell food, merchandise, and services that have been recalled.
• Only Food Vendors with Food and Cottage licenses are eligible to sell Food items.
• Vendors may not sell Food, Drink, Concession items, or merchandise unrelated to the vendor's business that have not been pre-approved by Ballet Folklorico Esperanza, Inc. 
• NO ALCOHOL or items containing alcohol may be sold at any time.
• Vendors will be asked to leave and not be given a refund if they violate any of the prohibited items & regulations.

VENDOR SETUP/BREAKDOWN

• Set Up: Saturday, November 2, 2024 (1 pm – 3 pm)
• Break Down: Saturday, November 2, 2024 (9:00 pm - Midnight)
• Vehicles must exit the venue BY 3 pm.
• All vendor spaces must be set up BY 5 pm.
• Vehicles will be permitted back into the venue at 9:30 pm.
• Vendors must stay throughout the duration of the event. Vendor space must be attended at all times.
• Vendors may not break down their vendor space or discontinue sales prior to 9 pm. 
• Vendors must complete breakdown and vacate venue by Midnight. 

SANITATION

• Vendors must leave the venue area clean and in an orderly condition.
• Vendors must remove all refuse and unsold goods from the venue.
• All trash must be placed inside trash bags and disposed in the provided large dumpster located alongside the Western wall of the cemetery.
• Vendors may not use the provided attendee trash containers to dispose trash (vendors must use large dumpster mentioned above).
• Grease and Greywater disposal are prohibited at the venue. Failure to comply will result in a fine to cover the cost of the extra clean up.
• All Vendors must dress appropriately. Shoes and shirts are required.
• Failure to leave the vendor space area in the condition it was provided will forfeit future participation.

FIRE & SAFETY

• Vendors must obey all AZ fire codes, laws and regulations pertaining to health, fire prevention and public safety.
• Food Vendors are required to be equipped with a 2S10BC fire extinguisher.

CODE OF CONDUCT

• Vendors and their guests are expected to conduct themselves with courtesy and in an orderly, professional manner. Argument, harrasment of any kind, profane language, or fighting are grounds for revocation of the vendor permit.

• Vendors who misrepresent themselves or their products for the purpose of securing a vendor space will forfeit participation in future events. 

• Vendors may not share vendor space for the purpose of reducing application fees.

• Vendor Space may not be loaned or sublet to anyone other than the applicant.

• Vendor Space must be attended at all times.

• Vendors must refrain from playing loud music within their vendor space.

• Vendors are not permitted to sell alcoholic beverages inside the venue.

• Smoking is not permitted near the entrance or near any place where food is served and eaten. 

• Vendors agree to abide by rules and regulations set forth by nearby businesses, government officials, Ballet Folklorico Esperanza, Inc., and the City of Avondale.

Photo/Video Release

The vendor agrees to release the rights to any photos or videos taken of his or her person, likeness, and/or merchandise/food/services while at the 16th Annual Dia De Los Muertos Festival, which may be used for promotional purposes, marketing, and/or paid advertising. 

GENERAL RELEASE OF CLAIMS & HOLD HARMLESS AGREEMENT

Vendor agrees to indemnify, defend, save and hold harmless Ballet Folklorico Esperanza, Inc., the City of Avondale and its officers, officials, agents, volunteers, employees and festival sponsors (hereinafter referred to as “Indemnitee”) from and against any and all claims, actions, liabilities, damages, losses, or expenses (including court costs, attorneys’ fees, and costs of claim processing, investigation and litigation) (hereinafter referred to as “Claims”) for bodily injury or personal injury (including death), or loss or damage to tangible or intangible property caused, or alleged to be caused, in whole or in part, by the negligent or willful acts or omissions of Vendor or any of its owners, officers, directors, agents, employees, volunteers or subcontractors. This indemnity includes any claim or amount arising out of or recovered under the Workers’ Compensation Law or arising out of the failure of such vendor to conform to any federal, state or local law, statute, ordinance, rule, regulation or court decree. It is the specific intention of the parties that the Indemnitee shall, in all instances, except for Claims arising solely from the negligent or willful acts or omissions of the Indemnitee, be indemnified by Vendor from and against any and all claims. It is agreed that Vendor will be responsible for primary loss investigation, defense and judgment costs where this indemnification is applicable. In consideration of the award of vending rights, the Vendor agrees to waive all rights of subrogation against Ballet Folklorico Esperanza, Inc., the City of Avondale, its officers, officials, agents, volunteers, employees and festival sponsors for losses arising from the vending performed by the Vendor at the 2024 Dia De Los Muertos Festival. Ballet Folklorico Esperanza, Inc., the City of Avondale, and the City of Avondale Police Department reserve the right to remove any misrepresented or inappropriate material or persons from any Ballet Folklorico Esperanza, Inc. and the City of Avondale event, including but not limited to, Avondale Goodyear Farms Historic Cemetery.
