Seller Terms
1. Holding Fee, Payment of Purchase Price, Fees
Buyer will pay a non-refundable holding fee in which will be deducted from the total purchase price agreed upon.
In either event, Seller shall be free to sell the Dog to another party if signed party (buyer)fails to uphold the signed and agreed holding fee contract (see below).
In the event that the Dog is not available due to sickness, death, or any other circumstance owing to the fault of Seller, Buyer’s deposit will, at Buyer’s option, be either
- refunded, or
- transferred to the next litter of puppies.
2. Transfer of Ownership and Registration
Upon payment in full of the Purchase Price, Seller shall promptly take all actions required to officially transfer ownership and registration (if any) of the Dog to Buyer.
3. Seller’s Representations and Warranties
Seller represents and warrants to Buyer that:
- Seller is the legal and true owner of the Dog and that Seller has full right and authority to sell the Dog.
- The Dog is being sold free and clear of any lien, security interest, charge or other other encumbrance.
- The Dog is in good health and free of communicable diseases at the time of this sale.
- The Buyer must have the puppy/dog examined by a licensed veterinarian within 72 hours (3 days) of receiving it. If, during this period, a licensed veterinarian finds the puppy/dog to be unhealthy or unfit for sale, it may be returned to the Seller for a full refund. The veterinarian's written statement deeming the puppy/dog “unfit for purchase” must be sent to the Seller within 48 hours of the examination. Once the puppy leaves the Seller's possession, the Seller will not be liable for any of the aforementioned conditions. The Seller shall NOT reimburse any veterinary or other expenses incurred by the Buyer. If the Buyer chooses not to have the puppy checked by a vet, this warranty will be void.
- This guarantee excludes resulting from transportation from Seller to Buyer; upper respiratory infections, kennel cough, eye infections, ear infections,inguinal hernias, umbilical hernias, undescended testicles, as these are common and can be corrected during spaying or neutering. Cherry eye, Entropion, Ectropion, Allergies, loose knees or hips, Stenotic nares, elongated soft pallet, dermatitis, demodectic mange, curable common parasites, internal or external of any kind, such as fleas, mites, ticks, ringworm, giardia, coccidia (as both are proven to lie dormant and are brought on by external conditions such as stress,etc) Seller will NOT replace a puppy due to heat stroke, abuse/neglect, or improper socialization, environmental induced injury.
- The Seller provides a one year warranty from the puppy's date of birth against debilitating congenital conditions such as congenital heart defects hydrocephalus, portosystemic shunt (liver shunt), and or kidney issues. This does not include conditions common in the breed, such as luxating patella, Legg-Calvé-Perthes, and collapsed trachea. If a condition that is covered under this one year warranty is found, the Buyer must immediately inform the Seller and provide veterinary records from a licensed vet. The Seller has the right to have the puppy examined again by a veterinarian of their choosing. If diagnosed with the same exact one year warranted covered condition, the Buyer may keep the puppy and receive a replacement puppy in return whom cost is equal to the original purchase price. In the event of death, a necropsy must be performed within three business days at the Buyers expense to determine the cause. If it is determined to be a debilitating congenital condition covered under the one year warranty , the Buyer will again receive a replacement puppy in return equal to previous puppy's price. Failure to follow recommended medical advice or treatment will void this warranty. Failure to notify or follow steps to receive the one year warranty will cause the warranty to become voided. This warranty is valid ONLY up to one year from the puppy's birth date.
- To ensure that Buyer does not euthanize the Dog or take it to an animal shelter, Seller will take the Dog back to Pawfect PawPals at any time during the Dog’s lifetime. Seller will not issue a refund or provide another Dog to Buyer. No refunds will be given nor any travel expenses shall be covered by Ray Holder's Yorkies. Buyer will take full responsibilty for all incurred fees.
- Ray Holder's Yorkies shall not be responsible nor guarantee any results of any sold, traded or gifted puppy that is DNA tested. Ray Holder's Yorkies does not guarantee the accuracy of DNA tests nor purity and that you (the buyer) accepts the results as they are. You (the buyer) agrees to stand behind stated registered breed listed on each puppy's registered paperwork. Although we use dna to test our breeding dogs here at Ray Holders Yorkies our main focus is health and pair matching. We can not guarantee results due to DNA tests, while highly reliable, are not infallible and can sometimes produce errors or inconclusive results. As also stated on most DNA testing websites these DNA tests are used for entertainment purposes only and we here at Ray Holder's Yorkies are not affiliated with any of these DNA testing companies or sites.
- By placing a non refundable holding fee on any chosen puppy you are agreeing to have the chosen puppy delivered and or picked up by set date assigned by Ray Holder's Yorkies rather this is verbal or written and changes NOT approved by Ray Holder's Yorkies will be seen as an abandonment of puppy and breach of contract and will result in all monies paid to be withheld by Ray Holder's Yorkies and will not be refunded for any reason unless specified by Ray Holder's Yorkies.
