Statement of Consent & Waiver
In consideration of my desire that my minor child participate in this Skilled Trades Summer Camp, I, the undersigned, hereby execute this Waiver and Release From Liability in favor of Kingdom Overflow Ministries, Kingdom Overflow Properties, both the for-profit and non-profit corporations, and their respective directors, officers, employees and agents (known collectively as "Kingdom Overflow").
Assumption of Risk: I hereby agree and declare that I am the legal parent/guardian of the above-named minor and hereby consent to the minor's participation in the activities expected on a construction job site, including the use of power tools and heavy machinery. I am aware that activities with Kingdom Overflow involve a certain degree of risk, that the amount of risk will vary significantly depending upon the activity, and that the activities may result in physical injury to my child. I am aware of the nature of the activities to be performed by the Minor at this camp, which could include, but are not limited to: framing of floors and walls, setting trusses, roofing, building porches and stairs, installing windows and doors, installing electrical, HVAC, or plumbing systems, painting and staining, or trim and flooring. I have carefully considered the risks and hereby acknowledge and accept these risks on behalf of my minor child, including the risks inherent in being on a construction site, as applicable.
Medical Treatment: If the above-named minor requires any emergency medical treatment or procedures during the activities, I hereby consent to activity supervisor(s) to make any decision and take any action to arrange for such procedures or treatments in the discretion of the activity supervisor(s). I hereby release Kingdom Overflow from any claim arising now or later from first aid, treatment or service rendered in connection with my minor child's activities with Kingdom Overflow.
Photographic Release: I hereby grant to Kingdom Overflow all right, title, and interest in any and all photographic images and video or audio recordings made by Kingdom Overflow during my minor child's activities with Kingdom Overflow including, but not limited to, any royalties, proceeds or other benefits derived from such photographs or recordings, understanding further that these images could be used in marketing materials, on Kingdom Overflow's website or by the media.
Waiver and Release: I, the parent/guardian, hereby agree and declare that I have carefully read and understand the scope of construction activities and I consent to the participation of the above-named minor in these activities. In consideration for being allowed to participate in the event listed, above, I agree as follows:
1. I agree and understand that the Minor must comply with the rules and regulations established by Kingdom Overflow and that failure to do so may result in the Minor’s immediate removal from the camp.
2. I understand the possible risks and dangers associated with my child's participation in the event. I assume all risk of injury, death, property damage, or loss from any cause whatsoever, including, but not limited to the failure of anyone to enforce rules and regulations or inspect equipment or facilities, and the negligence of anyone else; and
3. I hereby release and indemnify, defend, and hold harmless Kingdom Overflow from any and all liability, losses, costs, damages, claims or causes of action of any kind or nature, whatsoever, sustained as a result of or in connection with participation in the event.
4. I recognize that this release means I am giving up, among other things, the right to sue Kingdom Overflow for injuries, damages, or losses that may occur in the course of this activity, and understand that this release covers liability, claims and actions caused entirely or in part by any act or failure to act by Kingdom Overflow including, but not limited to, simple negligence, fault or other misconduct on the part of Kingdom Overflow. I also understand that this release binds my heirs, executors, administrators and assigns as well as me.
5. North Carolina law governs the determination of all issues related to this Agreement.
If the participant is under eighteen (18) years of age, this document must be signed voluntarily on behalf of the participant by his or her parents or guardian.
Parent/Guardian Statement: I am at least 18 years old and have read this entire release. I fully understand it and agree to be legally bound by it. No oral representations, statements or inducements have been made with regard to this release or the activity itself. I hereby certify that I have legal custody of this minor child, and that the minor child is not less than 16 years old. I hereby consent to allow my minor child to volunteer his/her services to Kingdom Overflow, and to receive emergency medical treatment as necessary.
