It is a private form between myself, Marcie Muensterman with The Travel Advisor Marcie, LLC and you, the Escorted Guest. When you fill out this booking form, you are agreeing to all Terms and Conditions for the trip to Tuscany, the deposit amount, final payment date and cancellation policy. Please READ AND REVIEW the details below. If you cannot agree to this information, DO NOT proceed with filling out the form. I have a knack for finding hidden gems even when they sleep 30 people! I truly enjoy hosting mid-size groups exploring the world and sharing incredible experiences together. Part of the beauty of going on an escorted adventure is that you are with me. I INVITE YOU to JOIN ME on this Tuscan Adventure!I have chosen an immaculate 12th century villa an hour northeast of Florence and 25 minutes outside of Rufina, a tiny Tuscan village. The estate is set within a 900-acre estate in the hills above Rufina within easy reach of Florence and resides three stunning residences, the elegant 12th century Villa and the two stone farmhouses. The perfect balance has been created by their owner, a professional caterer and event designer for the wealthy, preserving original features while incorporating 21st-century comforts.The Borgo; main house with guest house, just along the way have lovingly been restored with a new lease of life. Like the Villa the same concept has been applied, air-conditioned bedrooms with en suite bathrooms, large, bright and airy living areas not to mention the all-important en plein air living area and al fresco dining. On a hillside within a working 300ha/900-acre farm, which guests are free to explore at leisure. Acone 3km/2 miles, is the nearest village and offers a mini supermarket and a good pizzeria. The town of Rufina with its wine museum and lots of shops is 7km/4 miles away, and the centre of Florence can be reached in 40 minutes. Nice, handy and very well equipped new summer kitchen for the outdoor dining area of the main garden of the Villa. Three barbecues: one gas and two charcoal. Bluetooth music sound system available in the open plan kitchen/dining room on the first floor of the East guest wing and in the garden of the Villa. Onsite football/soccer pitch, astro-turf tennis court, beach volley court, pickleball and bocci court. For 30 guests (11 verbally confirmed as of July 3, 2024) - PRICE: $4877 per person with a $1000 per person nonrefundable deposit needed ASAP!👉 If you are a single, we will need to find you a roommate, which I'm happy to help with otherwise the cost is $6500 with a limit of 3 total singles (1 single has already booked as of July 10, 2024). FINAL PAYMENT will be due June 30, 2025.You may pay as you go each month if you wish. INCLUDED: Bedroom with ensuite bathroom attached ALL gratuities for onsite staff, tour guides and drivers during tours. 7 breakfasts 2 lunches 6 dinners (we are figuring out the last dinner) Michelin trained chef: The resident chef Francesco has worked in Florence, London and America, as well with Michelin-starred celebrity chef Tom Aikens, in the Estate's kitchen. 1 bottle of wine or prosecco FROM THE VILLA collection Some other alcoholic beverages (until they run out) Bartender service daily for 2 hours Bartender service for 1 of the villa days Full housekeeping / tidying and cleaning around the villa / one full change of sheets and towels mid-week. Daily: 3 maids for 2 hours a day. 4 tours with a mixture of FOOD, WINE (this is a big one), UNESCO, a couple of walking tours, pizza making at the villa, a variety of ideas but nothing specifically fleshed out yet but these are INCLUDED in the price b/c I know averages for most of the options I'm considering. 2 full villa days with activites at the villa. It has been advised that this villa IS THE EXPERIENCE and we want to spend a good amount of time relaxing and enjoying it. This is not a GO GO GO vacation. VAT tax per person per day High Speed Wi-Fi Onsite football/soccer pitch, astro-turf tennis court, beach volley court and bocci court. Several riding stables in the area. Credit Card / Deposit / Late Fee / Insurance Agreement and Cancellation Policy* This field is required.Please Read and Review: Credit Card Authorization for the Tuscany Escorted Adventure is $1000 per person non-refundable Deposit. TOTAL COST depends on if you are in a double occupancy room, single occupancy room or bringing a guest. You will receive and invoice with all cost details, payments and policies within 48 hours of placing a deposit or payment. PAYMENT SCHEDULE --$4877 total per person with the deposit coming off the balance --$1000 nonrefundable deposit: Due ASAP - link to pay will follow this screen --Remaining balance: Due June 30, 2025 Payment and Fees: Email marciemuensterman@gmail.com to pay in full anytime before payments are due. Deposit: A non-refundable deposit of $1000 is required to secure your spot. This deposit is due at the time of registration and applied towards the total cost, including holding your room space with the villa. Payment Methods: We accept all major credit cards, but prefer no Amex due to the highest fees. Late Payments: Any payment received after the due date will be subject to a late fee of $50 per person per day after 3 days of nonpayment. If payment is not received, reservation will be canceled and all payments will be forfeited. INSURANCE: Insurance for the Tuscan Adventure is mandatory to cover the cost of the villa and your travel to Italy. Insurance ranges in cost based on entire trip total and age. If you wish to purchase your own policy, you'll need to forward to Marcie by Feb. 1, 2025 Non-Payment: If your final payment is not received by June 30, 2025, your registration may be canceled, and you will forfeit your all payments made. Cancellation Notice: If a Guest chooses to cancel, Guest must email in writing your request to cancel and a cancellation form will be required to be filled out at the time of cancellation. Please read all of the terms and conditions carefully. The terms and conditions below along with our privacy policy and any other documents that we provided to you and the terms of the suppliers of the travel services constitute the entire agreement between the parties (hereinafter the Agreement). Please be aware that these terms and conditions contain waivers of liability as well as waiver of class action and venue selection and notice clauses. By booking a tour with us, you are agreeing to be bound by the Agreement. From time to time, we may make changes to the terms and conditions, which changes are effective immediately. You agree that you will be bound to the terms and conditions that are in effect at the time of your travel. The term "you" “participant” “client” or “customer” refers to the customer booking a reservation through us and all the members of your group. Reference to “Independent Operators” and “Service Providers” means all third parties who provide services to you including airlines unless otherwise specified. You must not make any booking with us unless you are at least 21 years of age and possess the capacity to enter into a contract. By making reservations for anyone other than yourself you represent that you will inform that person(s) about the Agreement along with the terms and conditions and obtain their consent to be bound by the Agreement. You confirm that all of the information that you supply to us regarding yourself and other members for whom you make reservations is true, complete, and accurate and that you are not making any reservations for an unaccompanied minor. By booking with us, you are agreeing to be financially responsible for the bookings that you or anyone under your direction or control makes. Booking on behalf of others: By booking on behalf of other participants, you are deemed to be the designated contact person for every participant included on that booking. This means that you are responsible for making all payments due in connection with the The Travel Advisor Marcie LLC, LLC and Marcie Muensterman, owner/manager of The Travel Advisor Marcie LLC, independent travel agent booking, notifying The Travel Advisor Marcie LLC, LLC and Marcie Muensterman, owner/manager of The Travel Advisor Marcie LLC, independent travel agent Travel or your travel agent if any changes or cancellations are required and keeping your party informed. By booking on behalf of another person or persons, you represent and warrant that you have obtained all required consents, you have shared these Terms and Conditions with all members of the party, and all members of the party agree to be bound to these Terms and Conditions. If Agency fails to provide the client with the Terms and Conditions for review and acceptance, Agency shall indemnify The Travel Advisor Marcie LLC, LLC and Marcie Muensterman, owner/manager of The Travel Advisor Marcie LLC, independent travel agent for any and all claims made against The Travel Advisor Marcie LLC, LLC and Marcie Muensterman, owner/manager of The Travel Advisor Marcie LLC, independent travel agent . If the client breaches any part of the Terms and Conditions, Agency may be held liable to the extent of the damages incurred, plus reasonable attorney’s fees as a result of the client's breach. You are responsible for verifying that any information you provide on behalf of another participant is complete and accurate and the The Travel Advisor Marcie LLC, LLC and Marcie Muensterman, owner/manager of The Travel Advisor Marcie LLC, independent travel agent Travel will under no circumstances be liable for any errors or omissions in the information provided to complete a booking. ‌‌ Payment Terms To confirm and book an itinerary, Client must submit: (1) A fully completed Reservation Form, (2) A non-refundable deposit payment of $1000 towards your itinerary price to The Travel Advisor Marcie LLC, LLC and Marcie Muensterman, owner/manager of The Travel Advisor Marcie LLC, independent travel agent and The Estate of Petroio for the Tuscan Villa Experience. (3) Full payment of travel insurance if purchased through The Travel Advisor Marcie LLC, LLC and Marcie Muensterman, owner/manager of The Travel Advisor Marcie LLC, independent travel agent or providing proof of purchase with medical coverage on your own. Upon receipt of your Reservation Form and deposit, The Travel Advisor Marcie LLC, LLC and Marcie Muensterman, owner/manager of The Travel Advisor Marcie LLC, independent travel agent Travel will make best efforts to attempt to secure and contract the requested itinerary on behalf of its Client. A nonrefundable deposit to The Travel Advisor Marcie LLC, LLC and Marcie Muensterman, owner/manager of The Travel Advisor Marcie LLC, independent travel agent will be required to secure your reservations at the time of booking. The remaining balance of the Travel Package and Services will then be due on June 30, 2025 to keep the villa in our possession. If booking is on or after June 30, 2025, full payment is due at the time of booking. If we do not receive any payment due in full and on time, we reserve the right to treat your booking as canceled by you in which case the cancellation charges set out below will become payable. We reserve the right to refuse a booking without giving any reason and shall in that event return any deposit received. Once a booking has been confirmed to us, we will change the booking’s status from “provisional” to “confirmed” on condition that we have a non-refundable deposit AND a completed copy of the Reservation Form and Terms and Conditions. Airfare quotes are estimates only and are subject to change until the ticket is issued. Certain operators/suppliers quote rates in foreign currencies and as these rates fluctuate relative to the US Dollar, all quotes prices are estimates only. The final invoice will reflect a tour price based on the then current exchange rate. Cancellations & Changes by the Client Deposit: The amount of the deposit is kept is non-refundable*. Final payment: · Due November 15, 2024 = 100% of the The Travel Advisor Marcie LLC, LLC and Marcie Muensterman, owner/manager of The Travel Advisor Marcie LLC, independent travel agent along with The Estate of Petroio Travel Package and Services is nonrefundable. In case of cancellation, non-refundable prepaid expenses associated with the trip such as tickets or fast track entrance fees to sites, shows, experiences or transport that require advance-purchase, 100% cancellation fee may apply. Accommodation reservations (hotel, apartment and/or villa) and airline tickets are subject to the properties and carriers’ refund policies). Suppliers may choose to offer a travel credit in lieu of monetary refund. We are not liable for a supplier’s failure to provide a refund or for supplier insolvency or bankruptcy. (**) Please note that in the case of cancellation of one or more travelers, trip cost will vary accordingly and may incur additional costs for the remaining travelers. All cancellation notices need to be emailed to marciemuensterman@gmail.com. No cancellations will be accepted over the phone or via messaging services. If the cancellation notice is sent via standard mail, please request a “return receipt of delivery” from the postal service, as The Travel Advisor Marcie LLC, LLC and Marcie Muensterman, owner/manager of The Travel Advisor Marcie LLC, independent travel agent, are not responsible for any lost mailed cancellation notices. Cancellations by phone still require a written notification from the client. There are no exceptions to our cancellation policy. It is for this reason that The Travel Advisor Marcie LLC, LLC and Marcie Muensterman, owner/manager of The Travel Advisor Marcie LLC, independent travel agent mandate trip insurance at the time of deposit. No refunds are made for unused meals, tours, services, or lodging. Everything will be confirmed by final payment and no changes or refunds will be offered. Changes made after deposit may incur additional fees to be determined at the time of the change. Concierge Services while in Italy Cancellation by The Travel Advisor Marcie LLC, LLC and Marcie Muensterman, owner/manager of The Travel Advisor Marcie LLC, independent travel agent The Travel Advisor Marcie LLC, LLC and Marcie Muensterman, owner/manager of The Travel Advisor Marcie LLC, independent travel agent Travel will not cancel a tour, holiday or other travel arrangement once the client has paid in full unless it becomes necessary to do so as a result of a group tour that does not have the minimum number of required participants. IIn the event of any cancellation by The Travel Advisor Marcie LLC, LLC and Marcie Muensterman, owner/manager of The Travel Advisor Marcie LLC, independent travel agent Travel, the Client will be informed without delay and The Travel Advisor Marcie LLC, LLC and Marcie Muensterman, owner/manager of The Travel Advisor Marcie LLC, independent travel agent Travel will make every effort to offer suitable and comparable alternatives. Credit Card Payments: While we do accept major credit cards including Visa, Mastercard, American Express and Discover, travelers must pay a 3% total and add it to the transaction. Your authorization is an agreement for us to charge your card and an acknowledgement and agreement to these terms and conditions including the cancellation terms. If you provide the credit card number to Marcie Muensterman, an owner/manager of The Travel Advisor Marcie LLC, LLC, you are agreeing to allow her to charge the appropriate amount to the balance of your Tuscan Villa Experience. As such you agree not to make any improper chargebacks. In certain cases, you have the ability to dispute charges with credit card companies ("chargebacks"). Before initiating a chargeback, we ask you first to call us to discuss any questions or concerns about our charges. We will work with you in attempting to resolve your concerns. If the Client initiates an improper credit card chargeback, the Client consents to jurisdiction of a Florida court, agrees to waive the right to a jury trial, and shall be responsible for all costs of collection, including attorneys’ fees and cost. Additionally, in the event of an improper chargeback, we retain the right to cancel any travel reservation related to that improper chargeback. If client submits a chargeback against a charge or charges authorized by the travel agent, or travel agency, the travel agent and agency shall be liable to The Travel Advisor Marcie LLC, LLC and Marcie Muensterman, owner/manager of The Travel Advisor Marcie LLC, independent travel agent for all chargeback amounts. Travel agent or agency shall make full payment for all chargebacks within 10 business days of electronic receipt of The Travel Advisor Marcie LLC, LLC and Marcie Muensterman, owner/manager of The Travel Advisor Marcie LLC, independent travel agent ’s chargeback request invoice. The following chargeback scenarios are improper, and we retain the right to investigate and rebut any such chargeback claims: Chargebacks resulting from non-cancellable reservations, whether or not the reservation is used. Chargebacks resulting from charges authorized by family, friends, associates or other third parties with direct access to your credit card. This does not include credit card fraud. Chargebacks arising from inconsistency or inaccuracy with regard to the supplier’s product description. Chargebacks resulting from force majeure or other circumstances that are beyond the control of The Travel Advisor Marcie LLC, LLC and Marcie Muensterman, owner/manager of The Travel Advisor Marcie LLC, independent travel agent or the Supplier. Chargebacks resulting because you do not agree with the cancellation policy. Responsibility The responsibility of The Travel Advisor Marcie LLC, LLC and Marcie Muensterman, owner/manager of The Travel Advisor Marcie LLC, independent travel agent and/or its agents is limited. The Travel Advisor Marcie LLC, LLC and Marcie Muensterman, owner/manager of The Travel Advisor Marcie LLC, independent travel agent hereby gives notice that it acts only in the capacity as an agent of the tour participant in all matters, including payment connected with lodging and meal services, sightseeing tours and other suppliers of service and transportation. If it becomes necessary or advisable for any reason whatsoever to alter the itinerary or arrangements, such alterations shall be made. Should a traveler be removed from a trip, they will not be refunded any unused portions of the Vacation Package and Services provided by The Travel Advisor Marcie LLC, LLC and Marcie Muensterman, owner/manager of The Travel Advisor Marcie LLC, independent travel agent . They may also be subject to any cost differential the remaining travelers might incur due to the traveler’s removal. Removed Traveler will also be responsible for the costs/expenses associated with making new arrangements related to returning home and/or other travel arrangement changes. The Travel Advisor Marcie LLC, LLC and Marcie Muensterman, owner/manager of The Travel Advisor Marcie LLC, independent travel agent ’s obligations with respect to any funds received shall be those of a debtor and not a trustee. The Travel Advisor Marcie LLC, LLC and Marcie Muensterman, owner/manager of The Travel Advisor Marcie LLC, independent travel agent reserve the right to cancel your trip and resell your space if your final payment has not been received by the due date. Each participant is expected to act responsibly and adhere to all behavior guidelines established by Us and by any or our Providers. We and our Providers reserve the right to remove you from any trip if you endanger yourself or others or disrupt the general well-being of the trip itself. In any such case, there will be no refund. When you book with us, you accept responsibility for any damage or loss caused by you. Full payment for any such damage or loss (reasonably estimated if not precisely known) must be paid direct at the time to the accommodation owner or manager or other supplier. You must indemnify us for the full amount of any claim (also including legal costs) made against us. Changes to the Itinerary The Travel Advisor Marcie LLC, LLC and Marcie Muensterman, owner/manager of The Travel Advisor Marcie LLC, independent travel agent and its providers reserve the right to make additions and deletions as believed advisable or necessary for the well-being of the traveler in their sole discretion. Tour Guides are not employees of The Travel Advisor Marcie LLC, LLC and Marcie Muensterman, owner/manager of The Travel Advisor Marcie LLC, independent travel agent . While we try to limit changes to the itinerary, changes may be made due to national holidays, closure of certain sites, emergency or safety concerns of participants or Force Majeure events. This list is exemplary and does not include every reason for which we may choose to make changes to itineraries. Changes made by us or a supplier shall not be cause for cancellation or refund. Insurance We mandate that you take out fully comprehensive travel insurance to cover any cancellation fees, loss or damage to baggage and personal possessions. It is very important that you take this out at time of booking, and we would be delighted to quote for you. In addition, we strongly recommend the purchase of additional cancel for any reason coverage. If you decline to purchase travel insurance through The Travel Advisor Marcie LLC, LLC and Marcie Muensterman, owner/manager of The Travel Advisor Marcie LLC, independent travel agent Travel, we will ask that you will provide a copy of the insurance you chose to Marcie Muensterman prior to final payment on November 15, 2024. The Travel Advisor Marcie LLC, LLC and Marcie Muensterman, owner/manager of The Travel Advisor Marcie LLC, independent travel agent will not be held responsible for denied entry if a guest is unable to provide details to authorities of insurance or denial of entry for any reason. If you choose to travel without adequate travel insurance, we will not be liable for any of your losses however arising, which would have been covered by adequate travel insurance. You will not be able to travel with the group and all payments will be nonrefundable. COVID 19 Release of Liability: By booking a tour at this time, you acknowledge the highly contagious nature of COVID-19 and voluntarily assume the risk for yourself and any minors traveling with you, that you or they may be exposed to or infected by COVID-19 by traveling and that such exposure or infection may result in personal injury, illness, permanent disability, and death even if such injuries or losses occur in a manner that is not foreseeable at the time you book your tour. You acknowledge that due to the uncertainty of travel at this time, your tour may be postponed or canceled, or changes may be made to itineraries due to closures of certain sites or activities, for which there may be no refund. You may also be required to quarantine upon arrival in some locations. Some locations may require you to have a vaccination or proof of a negative test. There may be additional requirements upon your return home. You are responsible for understanding these requirements and must not rely on The Travel Advisor Marcie LLC, LLC and Marcie Muensterman, owner/manager of The Travel Advisor Marcie LLC, independent travel agent to provide these details. You understand that you may become sick before, during, or after the tour and may not be able to travel and such cancellation or interruption will be subject to our cancellation terms below, for which we will not be liable. You, for yourself, and any minors traveling with you, and on behalf of your and their heirs, assigns, personal representatives and next of kin (The Releasors), HEREBY RELEASE, AND HOLD HARMLESS The Travel Advisor Marcie LLC, LLC and Marcie Muensterman, owner/manager of The Travel Advisor Marcie LLC, independent travel agent , its members, officers, agents, and/or employees, suppliers, and other tour members (RELEASEES), of from and against any and all claims, damages, demands, losses, and liability arising out of or related in any way, in whole or in part to any POSTPONEMENT, CANCELLATION, CHANGES, INJURY, DISABILITY, DEATH OR ANY OTHER LOSS you may suffer due to exposure, infection, spread, closure, and travel restrictions related to COVID- 19, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, to the fullest extent permitted by law. The terms of this HOLD HARMLESS AND RELEASE OF ALL LIABILITY paragraph, shall survive any termination or cancellation of this Contract, whether by operation of law or otherwise. Responsibility/Liability: The Travel Advisor Marcie LLC, LLC and Marcie Muensterman, owner/manager of The Travel Advisor Marcie LLC, independent travel agent Travel act only as booking agent with respect to services provided to the Client(s), included but not limited to hotels, villas, B&B’s, restaurants, wineries and cooking schools, and any and all forms of transportation provided by or from various independent overseas ground operators, and all other services providers. (the “Independent Operators”). Each of these Independent Operators has its own management and procedures and is not subject to the control of The Travel Advisor Marcie LLC, LLC and Marcie Muensterman, owner/manager of The Travel Advisor Marcie LLC, independent travel agent Travel. Client bookings are accepted by The Travel Advisor Marcie LLC, LLC and Marcie Muensterman, owner/manager of The Travel Advisor Marcie LLC, independent travel agent travel solely as agent for the Independent Operators. The Travel Advisor Marcie LLC, LLC and Marcie Muensterman, owner/manager of The Travel Advisor Marcie LLC, independent travel agent is not owner/managers with any tour operator. All Independent Operators are independent contractors and are not agents or employees or representatives of The Travel Advisor Marcie LLC, LLC and Marcie Muensterman, owner/manager of The Travel Advisor Marcie LLC, independent travel agent. 1. Although The Travel Advisor Marcie LLC, LLC and Marcie Muensterman, owner/manager of The Travel Advisor Marcie LLC, independent travel agent Travel has made its best efforts to choose the best suppliers available, it does not control the Independent Operators. 2. The Travel Advisor Marcie LLC, LLC and Marcie Muensterman, owner/manager of The Travel Advisor Marcie LLC, independent travel agent Travel deals with third party operators that sometime can experience problems in vehicle breakdowns, lack or damage in the air conditioning during excursions and/or at hotels, loss of power, etc. Also, changes in the details and timing of an itinerary can vary from time to time, depending on weather, conditions prevailing and facilities available. 3. Nothing herein or in the activities contemplated by The Travel Advisor Marcie LLC, LLC and Marcie Muensterman, owner/manager of The Travel Advisor Marcie LLC, independent travel agent Travel, Inc. and the Client(s) hereunder shall be deemed to create an agency partnership, employment or joint venture relationship between either party, the Independent Operators, or their representatives. All tickets, receipts, coupons, and vouchers are issued subject to the terms and conditions specified by each supplier, and by accepting the coupons, vouchers, and tickets, or utilizing the services, all customers agree that they are subject to that suppliers terms and conditions and that neither The Travel Advisor Marcie LLC, LLC and Marcie Muensterman, owner/manager of The Travel Advisor Marcie LLC, independent travel agent , nor its employees, agents, or representatives are or may be liable for any loss, injury, or damage to any tour participant or their belongings, or otherwise, in connection with any service supplied or not supplied resulting directly or indirectly from any occurrence beyond the control of The Travel Advisor Marcie LLC, LLC and Marcie Muensterman, owner/manager of The Travel Advisor Marcie LLC, independent travel agent . The Travel Advisor Marcie LLC, LLC and Marcie Muensterman, owner/manager of The Travel Advisor Marcie LLC, independent travel agent assumes no responsibility or liability for any delay, change in schedule, loss, injury or damage or loss of any participant that may result from any act or omission on the part of others; We will provide you with the Terms and Conditions of the suppliers for your trip. Please read any and all terms as it will be your responsibility to be familiar with the terms and conditions of any and all suppliers for your trip. The Travel Advisor Marcie LLC, LLC and Marcie Muensterman, owner/manager of The Travel Advisor Marcie LLC, independent travel agent accepts no responsibility for lost or stolen items. Considering the foregoing, Client has voluntarily entered into this agreement on behalf of him/herself and any minor children traveling with him/her. Force Majeure: The Travel Advisor Marcie LLC, LLC and Marcie Muensterman, owner/manager of The Travel Advisor Marcie LLC, independent travel agent assumes no liability for, any loss, damage, delay, or cancellation resulting in whole or in part from an Act of God or any other force majeure condition, including, without limitation: fire, volcanic eruption, hurricane, environmental pollution or contamination, inclement weather, earthquake, low or high water levels, flood, water or power shortages or failures, tropical storms or hurricanes, riots or civil commissions or disturbances, and any other acts of a similar nature, sabotage, arrests, strikes or labor disruptions, restraint of rulers or peoples, expropriations, acts of terrorism, war, insurrection, quarantine restrictions, government health advisories, epidemics, pandemics, or warnings or alerts of any kind of nature, government seizures, refusal or cancellation or suspension or delay of any government authority or any license, permit or authorization, damages to its facilities or the travel supplier and its facilities, or any other unforeseen circumstances or any other factors unforeseen by The Travel Advisor Marcie LLC, LLC and Marcie Muensterman, owner/manager of The Travel Advisor Marcie LLC, independent travel agent that impacts negatively on, or hampers, its ability to fulfill any of its contractual conditions. In the circumstances amounting to force majeure, we will not be required to refund any money to you, although if we can recover any monies from our suppliers, we will refund these to you without any charge by The Travel Advisor Marcie LLC, LLC and Marcie Muensterman, owner/manager of The Travel Advisor Marcie LLC, independent travel agent. Release of Liability: All travel includes risks. In fact, part of the excitement of any journey is derived from the risk involved. By booking a trip with us you are acknowledging that there is risk involved and that you accept these risks. Additional risks and dangers may arise including, but not limited to, hazards of travel by train, automobile, motor coach, aircraft and other means of conveyance, animal interactions, forces of nature, political unrest, other unrest, risks associated with water, food, plants, insects and differing animal regulation, and acts of national and local governments and unrest and acts of others against governments. These risks are not an exhaustive list but are examples of many kinds of risks. You are voluntarily participating in these activities with the knowledge that there are significant dangers involved, and you hereby agree to accept any and all risks. As lawful consideration for the agreement with The Travel Advisor Marcie LLC, LLC and Marcie Muensterman, owner/manager of The Travel Advisor Marcie LLC, independent travel agent to participate in such trips and activities you agree you will not make a claim against The Travel Advisor Marcie LLC, LLC and Marcie Muensterman, owner/manager of The Travel Advisor Marcie LLC, independent travel agent , its related companies or its personnel or sue for bodily injury, emotional trauma, death, property loss or damage or other loss, cost or expense, however caused, as a result of or related to your contracting for, traveling to or from, or in any and every other way participating in the trip. You release The Travel Advisor Marcie LLC, LLC and Marcie Muensterman, owner/manager of The Travel Advisor Marcie LLC, independent travel agent , its related companies and its personnel from any and all claims, known or unknown, arising from contracting for, traveling to or from, and in any and every way participating in a trip. This release of liability and assumption of risk agreement is entered into on behalf of you and all members of your family and party, also including minors. This agreement also binds your heirs, legal representatives and assigns. Where the guest occupies a motor coach seat, or any vehicle seat, fitted with a safety belt, neither The Travel Advisor Marcie LLC, LLC and Marcie Muensterman, owner/manager of The Travel Advisor Marcie LLC, independent travel agent nor the Operator nor its agents or co-operating organizations or service providers will be liable for any injury, illness or death or for any loss or damages or claims whatsoever arising from any accident or incident, if the safety belt is not being worn at the time of such an accident or incident. This exclusion and limitation of liability shall not be used to imply that The Travel Advisor Marcie LLC, LLC and Marcie Muensterman, owner/manager of The Travel Advisor Marcie LLC, independent travel agent , the Operator or its agents or owner/managed entities are liable in other circumstances. The Travel Advisor Marcie LLC, LLC and Marcie Muensterman, owner/manager of The Travel Advisor Marcie LLC, independent travel agent Travel reserves the right to accept or decline any passengers from either participating or continuing on any of our tours. Land, Sea and Air Transportation Carriage by land, sea and air is subject to the terms and conditions of the carrier with whom you travel and to international conventions, which may limit liability. Temporary or permanent loss of baggage is the responsibility of the carrier and the Client. Italian immigration requires United States Citizens to present a valid passport upon entering the country. The passport must be valid for at least six months beyond the intended period of stay in Italy. If a participant is unable to obtain travel documents or is prohibited from entering the destination country, our standard cancellation policy will apply, and we will not be responsible in any way. If the name on the ticket is spelled incorrectly, a new ticket will need to be purchased and applicable refund charges will apply. No travel is without risk. While we will advise you of known travel risks and travel advisories that are in effect for your destination, you should take steps and are responsible to be aware of any travel advisories or travel warnings, including COVID 19 requirements, that are in effect at the time of travel and prepare according inly. The ultimate decision on where to travel is up to you. Should you choose to travel to a destination when warnings and advisories are in effect, we will not be liable for any personal injury, loss, theft, or damages of any kind that result from travel to any such destination. Accuracy of Printed and Online Material We make every attempt to be accurate in our printed materials whether online or on paper, however on occasion errors do occur. Notifying us of such errors is your responsibility and will assist in a smooth tour. We also reserve the right to make changes to any typographical errors including pricing errors and may adjust the price of your trip accordingly. Use of Your Photograph or Likeness The Travel Advisor Marcie LLC, LLC and Marcie Muensterman, owner/manager of The Travel Advisor Marcie LLC, independent travel agent Travel may take photographs or video of its trips. Trip participants grant The Travel Advisor Marcie LLC, LLC and Marcie Muensterman, owner/manager of The Travel Advisor Marcie LLC, independent travel agent Travel permission to do so and for any photographic, film, video likeness, or audio recordings of participants while on tour to be used by The Travel Advisor Marcie LLC, LLC and Marcie Muensterman, owner/manager of The Travel Advisor Marcie LLC, independent travel agent Travel for promotional or commercial use without any notification or compensation to the participant. Enforceability If any portion of this agreement is unenforceable, the remaining portions shall remain in full force and effect. Jurisdiction and Applicable Law/Waiver of Class Action/Limitation of Damages/Notice These Booking Conditions and any agreement to which they apply are governed in all respects by the laws of the state of Florida without regard to conflicts of law principles. Any claims must be made in a court of competent jurisdiction located in Florida. You agree that you will only bring claims against The Travel Advisor Marcie LLC, LLC and Marcie Muensterman, owner/manager of The Travel Advisor Marcie LLC, independent travel agent in your individual capacity and not as a plaintiff or class member in any purported class action or representative proceeding. The Travel Advisor Marcie LLC, LLC and Marcie Muensterman, owner/manager of The Travel Advisor Marcie LLC, independent travel agent shall not in any case be liable for other than compensatory damages, and your payment of a deposit on a trip means that you agree to these conditions of sale and expressly waive any right to punitive damages. All guest claims must be submitted in writing and received by The Travel Advisor Marcie LLC, LLC and Marcie Muensterman, owner/manager of The Travel Advisor Marcie LLC, independent travel agent no later than ninety (90) days after the completion of the The Travel Advisor Marcie LLC, LLC and Marcie Muensterman, owner/manager of The Travel Advisor Marcie LLC, independent travel agent vacation. Guest claims not submitted and received within this time shall be deemed waived and barred. By filling out the booking form for your vacation and providing your credit card information,, you are agreeing to not hold Marcie Muensterman or The Travel Advisor Marcie LLC, LLC liable for the charges assessed for the contracted vacation by the vendors, airline, excursions, tour operators for any penalties and/or cancellation fees assessed should you choose to cancel or change your vacation. You agree not to do a chargeback to your credit card on your vacation once this form is filled out. It will be used to prove you agreed to the charges in the case of a charge back should you decide to take that course of action at any time. RESPONSIBILITY OF THE TRAVELING PERSON: Any act or omission (including, but not limited to, inability or failure to provide services and/or products) by any customer, supplier or third party including, but not limited to, the airlines, transportation companies, coach tour operators, car rental organizations, excursion providers, hotel/resort properties, or anyone for whom such suppliers or third parties may be in law responsible; an act of God or Event of Force Majeure; Equipment failure; Sickness/illness (including, but not limited to, contracting food-borne illnesses, viruses, diseases, etc.), family emergencies, theft or any other circumstance affecting you beyond our direct control; Failure of the passenger to obtain the necessary documentation or meet the required health regulations in order to complete their travel arrangements; Failure of the passenger to follow instructions including, but not limited to, airport departure times, baggage handling and check-in time frame stipulated by Marcie Muensterman, The Travel Advisor, Marcie LLC in these Terms and Conditions on the day of departure whether due to missed connections, adverse weather conditions, mechanical failures or any other reason whatsoever;Voluntary participation in an optional tour, excursion or activity; The need for us to cancel services, change itineraries or substitute accommodation or services, provided that efforts are made to supply comparable services and accommodations available; orCancellation of an optional tour, excursion or activity. The Travel Advisor Marcie, LLC, its parent, subsidiaries, affiliates, agents (including independent travel agents), subagents, suppliers and each of their respective officers, directors, employees, agents and representatives' liability for any loss, damage or injury, whether to property, physical or mental, arising from their own acts, omissions or negligence, is limited to the amount you paid to Marcie Muensterman, The Travel Advisor, Marcie LLC for the services with respect to which you are claiming. All travel related issues are the responsibility of the traveling passenger. The sole and exclusive responsibility and liability of any airline used in The Travel Advisor, Marcie LLC services shall be in accordance with and limited by the contract of carriage on your ticket, the applicable tariffs, and the provisions of Italian governing deciders. The customer agrees to indemnify and save harmless The Travel Advisor Marcie, LLC, Marcie Muensterman, its parent, subsidiaries, affiliates, agents (including independent travel agents), subagents, suppliers and each of their respective officers, directors, employees, agents and representatives against any liability, actions (including legal fees), claims, losses, costs and damages, and may incur, sustain or pay arising out of or in connection with the customer's acts or omissions, in relation to any incident alleged to have occurred in destination and/or in relation to services provided by The Travel Advisor Marcie, LLC, Marcie Muensterman, or The Estate of Petroio. COVID-19 is an extremely contagious communicable disease that can lead to severe illness and death. No precautions can eliminate the risk of exposure to COVID-19, and the risk of exposure applies to everyone. According to the Centers for Disease Control and Prevention (“CDC”), older adults (people 65 years and older) and people of any age who have underlying medical conditions are at higher risk for severe illness and death from COVID-19. Relevant public health authorities, including but not limited to the CDC, are referred to herein as “Public Health Authorities.” You acknowledge that the risk of exposure to COVID-19 and any other communicable or infectious disease includes the risk that you will expose others that you encounter, even if you are not experiencing or displaying any symptoms of illness. You acknowledge and agree to voluntarily assume any and all risks in any way related to exposure to COVID-19 and any other communicable or infectious disease, including illness, injury, or death of yourself or others. You acknowledge that your embarkation and participation in this vacation, internationally or domestically, is entirely voluntary. By embarking and participating in this vacation you attest you are knowledgeable about your individual risk of developing severe illness if you are infected with COVID-19; you have made an informed decision about traveling, both domestically and internationally, based on your individual risk; and you have decided whether to consult with a health care provider based on your individual risk.You further acknowledge and agree to abide by and consent to all COVID-19 rules, regulations, mandates and safety protocols issued by airlines, countries, cruise lines/resorts and/or Public Health Authorities including but not limited to: (a) Submission to mandatory COVID-19 testing at such times and frequency as required by Public Health Authorities or airlines, countries, cruise lines/resorts, which may include testing before and after your cruise; (b) submission to enhanced health screening for signs and symptoms of COVID-19 or known exposure to COVID-19; (c) denial of boarding or participating in activities throughout the resort due to signs and symptoms of a possible COVID-19 infection or known exposure to COVID-19 as determined by the airlines, countries and cruise lines/resorts at its sole discretion, in accordance with technical instructions or orders by Public Health Authorities; (d) participation in contact tracing and data collection for COVID-19 surveillance; (e) mandatory shipboard or resort isolation and/or quarantine at the sole discretion of the shipboard or resort on location physician; (f) mandatory disembarkation and/or evacuation from cruise ship or resort due to a suspected COVID-19 infection by you or someone else onboard your cruise or in your room/suite at a resort (Evacuation and disembarkation may occur in a foreign port or a port outside your original cruise itinerary); (g) post-cruise or resort and country quarantine instructions; (h) mandatory daily temperature checks; (i) mandatory use of face coverings/face masks in accordance with guidelines by Public Health Authorities and (j) following the airlines, countries and resorts physical distancing requirements. The airlines, countries and resorts reserve the right to change any health and safety protocols, including, but not limited to, requirements on vaccinations, masks, and physical distancing related to COVID-19 at its sole discretion, without notice, both prior to and during your presence on the cruise ship. It is your sole responsibility to confirm any changes to any health and safety protocols that may be applicable and ensure compliance with all health and safety protocols in effect, vaccination requirements, testing before or during your vacation, on the cruise ship, at the resort and / or the country or countries you will be traveling to. You further acknowledge and agree to review any CDC travel advisory, warning, or recommendation relating to international or domestic travel prior to making your reservation. Marcie Muensterman, your travel consultant with Cruise Planners, LLC, an American Express Travel Company, Luxury Travel by Marcie and Cruise Babe, LLC is in no way responsible for any issue, additional financial burden, long term medical stays or quarantining related to COVID-19 and any other communicable or infectious disease, including illness, injury, or death of yourself or others while traveling.
