Terms and Conditions
The undersigned will be a participant in The Wintrust Magnificent Mile Lights Festival® scheduled to be distributed initially by WLS-Television, Inc., license of WLS-TV ("WLS Television") on November 23rd, 2024 and re-distributed by WLS Television and its licensees thereafter.
The undersigned understands that The Wintrust Magnificent Mile Lights Festival®, Parade and ancillary events (collectively, the "Parade") is being given for the entertainment of children and the public, and no consideration is being paid to the undersigned. The Parade is being given as a public service.
The undersigned agrees that the Parade (including, without limitation, undersigned's name, likeness, performance, appearance, photograph, voice, depiction and biographical information, as incorporated into the Parade and materials promoting the Parade, collectively, "undersigned materials") can be distributed by WLS-Television in any and all media, throughout the world, in perpetuity, and that WLS-Television may (but is not obligated) to give credit to the undersigned in that regard. In consideration of participation by the undersigned in the said Parade, the undersigned hereby releases the City of Chicago, Chicago Department of Transportation, The Magnificent Mile Association, Wintrust Financial Corporation, WLS-Television, Inc., JM Best Entertainment Inc., and Under the Sun Productions Inc. (including the parent, subsidiary and affiliated entities of each of the foregoing), and each of their respective employees, officers, directors, contractors and agents from any responsibility or liability if the undersigned does not appear over television, radio and/or other media, or if for any reason the undersigned does not receive any publicity there from.
The undersigned agrees to relinquish editorial control and final approval of information, text, undersigned materials, and images provided by or used by the undersigned during the Parade. The Magnificent Mile Association and WLS-Television retains all final editorial review, approval, and control in all media of the Parade, including without limitation, with respect to the undersigned materials, provided by undersigned.
The undersigned will defend and releases, holds harmless and indemnifies WLS-Television, Inc., The Magnificent Mile Association and Wintrust Financial Corporation
(including the parent, subsidiary and affiliated entities of each of the foregoing), and each of their respective employees, officers, directors, contractors and agents and any sponsors of the Parade against any and all liability, costs, and expenses arising in any way as a result of the undersigned’s participation in the Parade.
The undersigned hereby accepts sole responsibility for the conduct and operation of its entry in the Parade.
The undersigned agrees to assume all risk and liability associated with volunteers and other individuals participating with your organization and liability resulting from participation in the Parade.
The undersigned also agrees to submit to a full security review at the discretion of The Magnificent Mile Association by any party directed by The Magnificent Mile Association including hired security, Chicago Police, and any other law enforcement authority, including but not limited to equipment, vehicle, and personal searching prior to or at any point during or after the Parade. The undersigned agrees to be legally bound hereby.
The undersigned assumes all liability related to, but not limited to, trademark, copyright, patent, defamation, liable, inappropriate behavior of its volunteers, employees, agents and contractors, or any other cause or action which does or might arise as a result of the undersigned actions whether foreseeable or not and whether controllable or not before, during, or after the Parade.
