Rental Agreement for Higher Elevation Events LLC
Responsibility and Use & Disclaimer of Warranties:
-The renter assumes responsibility for the proper use of all rented items and agrees to hold Higher Elevation Events LLC harmless from any claims arising from their use, regardless of cause.
Equipment Failure:
-In the event of equipment malfunction, the renter must cease usage immediately and notify Higher Elevation Events LLC. We will endeavor to repair or replace the equipment or adjust the charges accordingly.
Types of Equipment Rented:
-360° Video Photo Booth: Requires a $250 deposit, includes staff operation.
-Elevated Photo Booth: Requires a $100 deposit, includes staff operation.
-Audio Phone Guestbook and Other Rentals: Delivered and set up by our staff and picked up post-event within Weber County. These rentals do not include staff operation during the event. They are only available to locals unless combined with one of our photo booths.
Service Packages:
-Photo booth packages are available for 2 or 3 hours, with options to extend up to 5 hours.
Additional Fees for Extended Service:
-First additional hour: $150 ($175 for 3-hour packages).
-Second additional hour: $100 ($125 for 3-hour packages).
Idle Time Charges:
-Definition of Idle Time: Idle time refers to any period where the equipment is set up and ready for use but not actively in operation, due to restrictions or limitations imposed by the venue or event schedule. This includes any time taken outside of the standard 1.5 hours allocated for setup and takedown.
-Idle Time Fee: The idle time fee will be charged at half the cost of the package selected (2-hour or 3-hour) for each hour of idle time.
-For 2-hour packages: Idle time fee = $75 per hour.
-For 3-hour packages: Idle time fee = $87.50 per hour.
Use of Equipment:
-Equipment must be used solely for its intended purpose at the designated event location. Subleasing or improper use is strictly prohibited.
Liability for Damages:
-The renter is responsible for any damage to equipment, props, or other rented items caused by their guests during the event. If any prop or equipment is damaged, the renter will be charged in full for the replacement of the item. The cost of replacing damaged props can range up to $100 per item.
Payment and Cancellation Policy:
-Remaining Balance: Due on the day of the event. Or for late events, due by next day.
Cancellation and Date Changes:
-If cancellation or date change request occurs more than seven days prior to the event, the deposit will be applied to a rescheduled date.
-Date changes within seven days of the event incur a 35% inconvenience fee added to the remaining balance. Deposits are non-refundable.
Photography and Video Rights:
-By consenting to the use of your event’s photos and videos for marketing, you help promote our services. We understand and respect your privacy, and your decision to consent or not will not affect the service provided. No discount is offered for this consent.
Discounts and Promotions:
-Referral Discount: Customers referred by others will receive a 10% discount on their booking.
Equipment Safety and Compliance:
-Higher Elevation Events LLC is committed to maintaining the highest standards of safety and compliance. We conduct regular equipment checks to ensure all electronic items are safe for use, maintain clean and sanitized equipment, and comply with local fire safety and electrical safety codes.
Site Preparation and Access:
-The renter must ensure the event site is prepared and accessible for equipment setup. Additional charges may apply for delays or labor caused by inadequate site preparation.
Hold Harmless Agreement:
-The renter agrees to indemnify Higher Elevation Events LLC against all claims arising from the rented equipment's delivery, setup, use, and retrieval.
Regular Updates Clause:
-This agreement may be updated by Higher Elevation Events LLC at any time. Changes are effective upon posting to our website or delivery via email or written notice.
