1. The parties agree to the following terms and conditions:
a. Client is engaging Company for fitness and/or nutrition coaching services to be provided by INYO Fit by Carmen Rosa.
b. Trainer will create an exercise and/or nurtrition program geared to Client’s fitness level and experience in order to meet Client’s objectives.
2. Training Sessions. Training Sessions may include, but are not limited to, the following activities: testing of physical fitness; exercise; aerobics and aerobic conditioning; cardiovascular training; weight lifting and training; and stretching.
3. Training Package and Payments.
a. All payments for sessions must be made in advance (for direct debit or standing orders this will usually be the first working day of each month, if cash payments are being made then this will be in-person on the first training session of each month). For specific packages payment will be made upfront, in whole, for the cost of the package.
4. Monthly Sessions. All Training Sessions must be used within 30 days of billing cycle. All sessions must be booked within reasonable notice (usually week prior). This gives time to arrange time slots. All Block Packages must be completed within 11 weeks - allocating an extra week to accommodate sickness or time off.
**** Missed sessions will need to be reallocated to upcoming weeks: ie. If a client is doing 2 sessions a week and misses 1 week the follwing weeks they will be doing 3 sessions a week to catch up.
5. If clients are unable to attend sessions then they must be notify in advance (this is typically 24 hours in advance). If clients are unable to attend sessions and there’s no reasonable notice then the cost of the session will be charged in full.
6. If due to reasons of a serious nature such as a serious medical/personal issue or bereavement of a close family member then any relevant cost will be refunded in full via the original payment method. I must give 1 month’s notice of cancel my online coaching programme/services to cover time spent researching and developing my programme.
7. Freezing - Purchases may be held for a maximum of 4 weeks and packages can be re-booked as usual.
8. If I am on holiday and my programme needs adjusting to suit my location I will give my trainer 1 weeks notice.
9. The results of any programme are depended on my effort and cooperation in and outside of the sessions. No particular result is guaranteed by the trainer.
10. If you don’t attend check ins then you will need to be responsive via messaging showing evidence of progress by providing any measurable data, whether these are videos for your coach to offer you form correction, bullet points of how activities felt, time/duration of training, voice notes, etc…
11. Any medical conditions or disabilities are expected to be explained in full to the trainer and noted in the PAR-Q form (this will be completed at the initial/consultation stage) so reasonable action/precautions may be taken. I understand and agree that it is my responsibility to inform my trainer of any changes in my health now and on going.
12. Indemnity. There are inherent risks participating in a programme of strenuous exercise. If I sustain or claim to sustain an injury while participating in a training programme I acknowledge that the trainer and business name are not responsible.
13. Clients must allow the use of before and after pictures. These pictures will be used to gauge progress with the possible use of website/promotional materials. This also applies to video footage of training sessions for the same purpose.
If this waiver is delivered by any electronic means whatsoever and said delivery shall be of the same force and effect as the delivery of an original signature.
