    Intellectual Property Usage Guidelines for Academic Users

    Approved Use:

    1. Academic Purposes: You are authorized to use the approved intellectual property for educational and non-commercial research purposes within accredited educational institutions.

    2. Classroom Presentations: Incorporate the approved materials into classroom presentations, lectures, and educational workshops, provided it aligns with the educational objectives.

    3. Research Projects: Utilize the approved intellectual property in non-commercial research projects and academic publications, ensuring proper citations and acknowledgments.

    4. Educational Events: Organize and participate in educational events, conferences, and seminars using the approved materials, promoting academic discourse and knowledge dissemination.

    5. Non-Commercial Exhibitions: Display the approved intellectual property in non-commercial exhibitions related to academic activities, showcasing educational achievements, and fostering academic collaboration.

    6. Collaborative Projects: Collaborate with fellow students, faculty, or academic institutions in projects that involve the approved intellectual property, ensuring all collaborators adhere to these guidelines.

    7. Translation: Translations of intellectual property are not permitted.


    Usage Guidelines:

    1. Proper Attribution and Disclaimer: Always provide proper attribution when using the approved intellectual property. Follow the specified guidelines for crediting the source, including copyright notices and trademark symbols where applicable.

    For copyright, include the following disclaimer:
    a. “© American Nurses Association. Reprinted with permission. All rights reserved”
    b. “© American Nurses Credentialing Center. Reprinted with permission. All rights reserved.”

    For trademark, include the following disclaimer:
    a. “[Trademark Name] ® is a trademark of American Nurses Association (ANA) registered in the United States of America and other jurisdictions and is being used under license from ANA. All rights reserved.”
    b. [Trademark Name] ® is a trademark of American Nurses Credentialing Center (ANCC) registered in the United States of America and other jurisdictions and is being used under license from ANCC. All rights reserved.”

    2. Non-Commercial Use: Ensure that the use of intellectual property is strictly non-commercial. Any potential commercial application requires a separate approval process and may involve additional fees.

    3. No Modification without Approval: Do not modify, alter, or adapt the approved materials without prior written approval from ANA. If modification is necessary for academic purposes, seek permission in advance.

    4. Scope Limitation: Use the intellectual property only within the scope specified in your approval request. Any deviation from the approved scope requires reevaluation and additional approval. No derivatives may be created beyond the original approval scope.

    5. Limited Duration: The approved use is limited to 5 years from the date of your request. Seek reapproval for any extension or continued use beyond the initial period.

    6. Preservation of Integrity: Preserve the integrity of the approved intellectual property by ensuring it is used in a manner consistent with the intended educational context and not distorted or misrepresented.


    Prohibited Use:

    1. Commercial Use without Approval: You are prohibited from using the approved intellectual property for any commercial purposes without prior written approval. Seek separate approval for any commercial applications.

    2. Unauthorized Modifications: Do not make any modifications, adaptations, language translations, or alterations to the approved materials without express written consent from ANA or ANCC. Unauthorized modifications infringe on ANA’s or ANCC's intellectual property rights.

    3. Misrepresentation: Do not use intellectual property in a way that misrepresents the source or implies endorsement by ANA or ANCC. Clearly state the context of use to avoid any potential confusion.

    4. Distribution without Permission: You may not distribute the approved intellectual property to third parties without obtaining permission from ANA or ANCC. If collaboration involves sharing materials, ensure all parties are aware of and agree to these guidelines.

    5. Reproduction Limits: Do not reproduce the approved intellectual property beyond the specified limits in the approval. Seek additional approval for large-scale reproduction or distribution.


    Legal Compliance:

    1. Adherence to Automated Approvals: Automated approvals are bestowed exclusively for specific uses and cannot be used commercially. If an automated approval was provided and you seek to commercialize the content a new submission must be submitted. Failure to comply may result in legal action.

    2. Adherence to Legal Agreements: If legal agreements were signed during the approval process, ensure strict adherence to the terms outlined in those agreements. Failure to comply may result in legal action.

    3. Prompt Compliance: Promptly comply with any additional requests or conditions communicated by the ANA or ANCC as the copyright and trademark owners. Timely communication ensures the smooth continuation of approved use.


    Record Keeping:

    1. Documentation of Use: Keep detailed records of how the approved intellectual property is used, including dates, context, and any associated documentation. Proper documentation supports transparency and accountability.

    2. Communication Archive: Retain copies of all communication related to the approval, including emails, approvals, legal agreements, and any subsequent correspondence. This archive serves as a reference for future inquiries or audits.
