1. Introduction
1.1 This Bicycle Rental Agreement ("Agreement") is entered into between Michigan Nature Co. LLC, referred to as "Rental Company," and the party renting the bike herein referred to as "Renter." The purpose of this Agreement is to establish the terms and conditions under which the Rental Company will provide bicycle rental services to the Renter.
1.2 This Agreement also outlines the obligations and responsibilities of each party concerning the rental, use, and return of the bicycle(s) and any additional equipment ("Rental Equipment").
2. TERMS AND CONDTION OF RENTAL
2.1 RENTAL EQUIPMENT SUBJECT TO THIS CONTRACT: The Company shall rent the bike equipment listed above.
2.2 ELIGIBILITY: Bicycles can be rented by any individual 18 years of age and older.
2.3 PAYMENT TERMS: The rental payments shall be due before the rental term starts. The payment terms and fees of the rental are listed above. The Renter agrees to the terms and pay a rental fee as outlined above. Rental fees are due in full before the start of the Rental Period.
2.4 RISK OF LOSS OR DAMAGE: The Renter assumes all risks of loss or damage to the equipment from any cause, and agrees to return it to the Company in the condition received from the Company, with the exception of normal wear and tear. The Company or their appointed agent will determine normal wear and tear. All determinations made by the Company are final.
2.5 RENTAL TERM: This Rental shall begin on the above effective date and chosen duration, and shall terminate on return in fully working condition to the Company’s facility.
2.6 EQUIPMENT INSPECTION: Upon receiving the Rental Equipment, the Renter agrees to inspect the equipment for any damages or issues and to immediately report such findings to the Rental Company. Failure to do so will assume the Renter's acceptance of the equipment in its existing condition.
2.7 CARE AND OPERATION OF EQUIPMENT: The equipment may only be used and operated in a careful and proper manner. The Renter agrees to use the Rental Equipment responsibly and in accordance with all local laws and regulations. The Renter assumes full responsibility for any citations received related to the use of the Rental Equipment.
2.8 DAMAGES AND REPAIR: The Renter is responsible for any damage to the Rental Equipment beyond normal wear and tear. The Renter will either repair the equipment to its original condition or pay the cost for such repairs, as determined by the Rental Company. Such costs shall include labour, material, parts, and similar items. The Company will perform any service on the equipment related to reasonable wear and tear.
2.9 RETURN OF EQUIPMENT: The Rental Company assures that all Rental Equipment is in good condition and commits to providing equipment that is safe for use. The Renter shall return the Rental Equipment in the same condition ath the end of the Rental Period, barring normal wear and tear.
2.10 ACCEPTANCE OF EQUIPMENT: The Renter shall inspect each item of equipment delivered pursuant to this Rental. The Renter shall immediately notify the Company of any discrepancies between such item of equipment and the description of the equipment in the Equipment Schedule. If the Renter fails to provide such notice in writing within 2 day(s) after the delivery of the equipment, the Renter will be conclusively presumed to have accepted the equipment as specified in the Equipment Schedule. Any subsequent claim that the equipment was not provided in fully functional order will not be considered.
2.11 WARRANTY: The Company will warranty the equipment against normal wear and tear. Any issues beyond normal wear and tear will be the Renters responsibility.
2.12 INDEMNITY OF COMPANY FOR LOSS OR DAMAGES: If the equipment is damaged or lost, the Company shall have the option of requiring the Renter to repair the equipment to a state of good working order, or replace the equipment with like equipment in good repair, which equipment shall become the property of the Company and subject to this contract.
2.13 LIABILITY AND INDEMNITY: If the Renter chooses to undertake bicycling, The Renter knowingly assumes all inherent risks, and that the Rental Company not warrant the fitness of the rental property for bicycling. Liability for injury, disability, and death caused by operating, handling, or transporting the equipment during the term of this Rental is the obligation of the Renter, and the Renter(s) shall indemnify and hold the Company harmless from and against all such liability.
2.14 INDEMNIFICATION: The Renter agrees to indemnify, defend, and hold harmless the Rental Company from any claims, lawsuits, or liabilities arising out of the Renter’s use, operation, or possession of the Rental Equipment.
2.15 ENTIRE AGREEMENT AND MODIFICATION: This contract constitutes the entire agreement between the parties. No modification or amendment of this contract shall be effective unless in writing and signed by both parties. This contract replaces any and all prior agreements between the parties.
3. TERMINATION AND PENALTIES
3.1 TERMINATION BY RENTER: The Renter may terminate this Agreement by returning the Rental Equipment in the same condition as received, subject to normal wear and tear, and by settling any outstanding payments.
3.2 TERMINATION BY RENTAL COMPANY: The Rental Company reserves the right to terminate this Agreement with immediate effect if the Renter fails to adhere to the terms set forth in this Agreement, including but not limited to late payments or misuse of the Rental Equipment.
3.3 LATE RETURN FEES: If the Renter fails to return the Rental Equipment by the agreed-upon date and time, late fees may be applied at a rate defined by the Rental Company.
3.4 PENALTIES FOR DAMAGE OR LOSS: The Renter will be liable for the full cost of repair or replacement for any lost, stolen, or damaged Rental Equipment due to misuse, neglect, or violation of this Agreement.
3.5 GOVERNING LAW: Any disputes arising from or relating to this Agreement shall be resolved in accordance with the laws of the jurisdiction where the Rental Company is located.
3.6 ADDITIONAL COSTS: Late returns will incur additional fees as outlined below:
-Up to 1 hour late: $25
-Up to 2 hours late: $45
-More than 2 hours late: Full daily rate of $55
