We need an accurate count of people who will need food for purchase of supplies. This will be a bagged lunch of a hot dog or hamburger, chips, and drink only. You are required to bring sufficient food, snacks, supplements, and hydration sufficient to keep yourself and your guests safe in the desert.

Activity: Detector Fest – Metal detecting and gold prospecting, hereafter known as the Activity.

Location: B-Kings Outdoors #1, 2-Rabbit Stew, Hornet’s Nest,

Description: Activity is conducted outdoors with various games and participants compete to find objects buried in and around the desert, which contains the following (not limited to) large and small rocks, cacti, bugs, snakes and many other flora and fauna. The activity can lead to injuries, including but not limited to, cuts, bruises, trip and falling hazards or other accidents, as well as consequences from heat and sun exposure.

Environmental hazards: Exposure to natural elements, such as uneven terrain, wildlife and weather conditions. I understand I must take precautions for myself, my guests and underaged individuals in my care. I must take reasonable measures to help other people.

Equipment use: The use of tools, equipment and machinery related to metal detecting and prospecting, e.g. shovels, picks, hammers, metal detectors, scoops, sledges, and other equipment supplied by myself or others.

Assumption of Risk: I, the undersigned participant, understand and acknowledge that participating in the above-mentioned activity involves these and other inherent risk. By signing this waiver, I voluntarily assume all risks associated with this activity and agree to release B-King Outdoors, LLC, JacobsBrand, Dylan Pritchard, James Jacobs, Janine Jacobs, organizers, volunteers, instructors and any other affiliated parties (hereafter known as the Organizers) from any liability for personal injury, property damage or loss of any kind, now and future claims. I hereby waive, release and discharge the Organizers from any and all claims, demands, actions or causes of action arising out of my participation, past, present and future. This includes, but not limited to, claims related to negligence, breach of contract, or any other legal theory. I understand that this waiver is binding and applies to myself, my heirs, executors, dependants, administrators and assigns.

I also certify that I am physically fit to participate in the activity and have no medical conditions that would prevent my safe participation.

I also agree to abstain from returning to the above location for the purpose of gold or mineral prospecting without express permission from the Organizers.
I acknowledge that I have read the waiver and certify I am aware of the inherent risk associated with this outdoor activity; I hereby release, waive and discharge the Organizers as outlined in the waiver from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, or injury, including loss of life, that may be sustained by me or to any property belonging to me, whether caused by negligence or otherwise. I agree to indemnify and hold harmless the Organizers from any loss, liability,damage, or costs, including court costs and attorney fees, that they may incur due to my participation in the event/activity.*
