BHR - Agreement for Reservation - Clubhouse

The Clubhouse is owned and maintained by the Beacon Hill Recreation Association and is available for rent to Beacon Hill Recreation Association Reservoirs in good standing for their private parties and functions. The BHR reserves the right to deny use for breach of the rules and regulations, destruction or theft of property, failure to maintain control of function, or for outstanding dues owed to the BHR.
Please review and initial the following BHRC rental terms and conditions, by initialing below you indicate you have read and understand all the following rules and regulations. Any breach of the following rules may result in a loss of the deposit.
1. The Clubhouse (BHRC) may be reserved by a Beacon Hill Recreation Association Reservoir in good standing, with dues or other financial obligations to the BHR paid in full.
2. Reservations are made on a first-come, first-served basis. To secure a specific date, Reservoirs must sign and return this Agreement for Reservation, submit the rental fee and a refundable security deposit.
3. Rentals are from either 8 am – 2pm OR 4pm – 11pm including set-up and clean-up time (except New Year’s Eve which is extended until 1:00 am).
4. The Reservoir agrees to remove any and all personal property, and leave the premises as originally received; performing the cleaning responsibilities. Failure to remove items or delayed cleaning may result in the security deposit forfeiture.
5. The Reservoir must be present in the Clubhouse at all times during their event and acknowledges that he/she is responsible and liable for the action of his/her guests. Security deposit will be forfeited if Reservoir is not on site during their event or any guest violates the rules stated in this agreement. Reservoirs are responsible for informing all guests of the rules and regulations.
6. The Clubhouse has a maximum occupancy of 80 persons. No functions or gatherings in excess of this amount will be allowed, including and not limited to the parking lot and surrounding areas.
7. Rental of the Clubhouse is limited to the main room, and the adjacent kitchen area. The outside upper deck is excluded, unless explicitly noted on the attached form that must be signed by the BHR manager. The showers and lavatories remain available to all Reservoirs and BHR employees during the pool season.
8. The pool cannot be reserved for a private function under any circumstances. The pool facility is available to all BHR Reservoirs and their registered guests within the confines of the guest policy. However, simultaneous use of the Clubhouse Facility and pool is prohibited. Any guest found to have illegally entered the pool area will forfeit the security deposit and result in a 1-year ban from BHRC rentals.
9. Sound systems are allowed inside the Clubhouse, but volume may not be excessive as to disturb homeowners using the pool facilities and/or homeowners living near the facilities. Usage must comply with the Wilkinsburg Code.
10. The BHRC and all BHR property is smoke-free, including but not limited to the parking lotand outdoor areas. The Reservoir hereby accepts responsibility for his/her guests in complyingwith this regulation. Deposits will be forfeited in event of smoking.
11. The Reservoir understands that the Clubhouse is located in an area surrounded by general "public" usage and that functions in no way may be lewd or obscene in nature.
12. The Reservoir must complete and sign the Waiver of Liability form (incorporated herein by reference), which removes any liability from the Association in the event of injury or accident to either the Reservoir or his/her guests while on the premises. The BHR shall not be liable to Reservoir or Reservoir’s guests for any damages arising out of any defect of the premises, natural disaster or act of God, or any accident or injury to Reservoir, his/her party or guests suffered in or about the premises.
13. Delayed cleaning of the facility or removal of rented equipment is not allowed without prior permission.
14. Any additional cleaning required, i.e. removal of stains to the furniture, floors, repair of damage to the building and/or furniture, etc. will be deducted from the security deposit.
15. The Beacon Hill Recreation Association allows the BHRC to be used for limited commercial use ( for home based businesses) for an increased fee ( see fee schedule) and reservations must be booked no earlier than 2 months in advance.
16. Lighted Candles are not permitted.
17. Any fees or costs incurred in excess of the security deposit are the responsibility of the Reservoir.
18. Usage arrangements include a walk-through of the facility and a review of the Agreement for Reservation. This is scheduled by appointment with the Association Manager.
19. The parking lot may only be used for parking cars and vehicles. The parking lot may not be used as an extension of the BHRC. There is no alcohol, smoking or loitering permitted in the parking lot or surrounding areas. All renters and their guests must park in the lot designated with the "Party Parking" sign. Disregarding the parking requirement will result in forfeiting your security deposit. Please advise all guests of this parking requirement.
20. Use of tape or tacks in order to decorate the Clubhouse is prohibited.
21. This written contract constitutes the entire agreement between the parties. Should any dispute arise concerning this Agreement, the undersigned agree to submit their dispute to binding arbitration.
FEES

1)    The Clubhouse is available to BHR Reservoirs per the following schedule of rental fees

a.    Monday – Thursday Events:

i.    $100.00 Rental Fee, (this includes the cleaning fee) $150.00 Refundable Security Deposit. (Deposit check to be shredded after inspection of the facility.)

b.    Friday – Sunday Events:

i.    $125.00 Rental Fee, (this includes the cleaning fee) $150.00 Refundable Security Deposit. (Deposit check to be shredded after inspection of the facility.)

2)    BHR Reservoirs may opt instead for a 3-hour event (including set up and clean) weekdays (Mon - Thurs), booked no more than 6 weeks in advance, for events such as team parties for a Rental Fee of $200.00.

3)    The Rental Fee includes an initial walk-through of the facility at time key is issued. Requests for additional viewings (i.e., caterers, musicians, florists) may be arranged by appointment.

4)    Beacon Hill Associations and Sub-Associations may use the facility at no cost for community meetings, weekdays (Mon - Thurs), booked no more than 6 weeks in advance, based on availability. Reservoirs of a non-profit organization (like Boys Scouts & Girl Scouts) may use the facility at no cost once per year on weekdays (Mon-Thurs), booked no more than 6 weeks in advance, based on availability.
Refund Policy

In the event of reservation cancellation, the Rental Fee and Security Deposit will be returned in full if notice is received 7 days prior to the reservation date. Cancellations received less than 7 days in advance will result in a forfeiture of half of the Rental Fee. The Security Deposit will be returned to the resident within thirty (30) days of the date of private usage of the facility less and legitimate deductions for repair of damage or cleaning. Cleaning will be charged at a rate of $ 20.00 per hour and damage repair will be charged at the rate of $ 25.00 per hour plus any material costs. Any damage or cleaning costs in excess of the $ 150.00 deposit will be assessed to the unit owner or apartment renter.

I, the undersigned, acknowledge reading the foregoing Agreement for Reservation prior to execution and hereby agree to abide by the above terms and conditions. In addition, by signing hereto I acknowledge that I am responsible for the actions of my guests while on the premises and acknowledge that I am a Reservoir in good standing with the BHR. I also hereby agree to hold harmless the Beacon Hill Recreation Association in the event of injury or accident to myself or my guests while utilizing the Clubhouse Facility or while present on any part of the Beacon Hill Clubhouse premises for the below mentioned date(s).
