Statement on Personal Data Protection
As the administrator of the KF Exchange Program to the United States, the Kosciuszko Foundation is committed to protecting the personal data of all program applicants in compliance with United States regulations. This statement outlines our approach to ensuring the security and privacy of applicant information.
Data Collection and Use: We collect personal data from applicants solely for the purpose of administering the KF Exchange Program in the US. This includes the application process, conducting selection interviews, processing grant payments, and promotion of the Program. The Kosciuszko Foundation representative office in Warsaw will act as a co-administrator of the data specifically to conduct selection interviews.
Legal Compliance:
US Regulations: We comply with US data protection laws, including but not limited to the Privacy Act and any applicable local state laws, to ensure the protection and confidentiality of personal data.
Polish Regulations: We adhere to the General Data Protection Regulation (GDPR) as implemented in Poland, ensuring transparency, data minimization, and the secure handling of personal information. This includes fulfilling statutory obligations such as retaining financial records or educational documentation as required by law, based on Article 6(1)(c) of the GDPR.
Data Security: We employ technical and organizational measures to safeguard personal data against unauthorized access, disclosure, or misuse. This includes encryption, access controls, and regular security assessments.
Data Retention: Personal data will be retained for the period necessary to fulfill the purposes for which it was collected, in accordance with archival and IRS laws.
Rights of Applicants: Applicants have the right to under applicable data protection laws, including the right to: access their personal data held by the organization, request correction of inaccuracies in their data. Request deletion of their data when it is no longer necessary for the purposes for which it was collected.
Data Sharing: Personal data may be shared with entities that process data on our behalf and public bodies under separate legal provisions, excluding public authorities receiving data in specific proceedings according to applicable EU or member state law.
Automated Processing: Personal data will not be processed in an automated manner or subject to profiling and will not be transferred to a third country.
