The frozen semen of the stallion {stallion} is made available under the following conditions:

• The semen is and will at all times be owned by Seller.
• The frozen semen is made available at {contractPrice}.
• The frozen semen will be sent or made available one dose at a time as needed to the veterinary or breeding facility indicated by Buyer.  In the event that the mare is not in foal, a non-gestation declaration assigned by the veterinarian must be provided before a next dose of frozen semen will be sent.  A maximum of 2 doses will be available for this contract unless otherwise agreed to by Seller.
• One dose of semen is for one insemination and may not be split under any circumstances.
• If the Buyer obtains several pregnancies with the use of one dose of frozen semen (twins in the case of ET), Buyer shall report these pregnancies to Seller or Seller’s agent.
• In the event that the Buyer gets more than one pregnancy (min. 90 days gestation) with the obtained dose, the Buyer shall notify Seller of such extra gestations and will be charged an amount of {contractPrice} for each additional gestation.
• In case the Breeder violates these terms and conditions, he or she is liable to pay a penalty fee corresponding to the damage Seller suffered as a result of the breach of contract, however at least $5,000. The penalty fee - and any other unpaid fee - shall be paid immediately upon request by Seller.
• The semen may under no circumstances be sold to third parties or be used for ICSI.
• The first dose will be made available after the signed agreement is in the possession of Seller or Seller’s Agent, and after receipt of the full invoice amount.
• The Buyer may use the semen for a mare of Buyer’s choosing in the year of purchase or the following year unless otherwise agreed with to by Seller or Seller’s Agent.
• After each insemination the Buyer shall provide the following details to Seller or Seller’s Agent: Mare name, UELN or registration number, insemination date, result of the insemination. A photo of the empty straws must be returned to Wellgrove Equine (text 561-398-9782) immediately after use.
• The semen may be requested at all times by Seller or Seller’s Agent. In this case, the Buyer shall return the semen to Wellgrove Equine within the requested time. The remaining value of this stock will be credited upon receipt.
• Buyer gives permission to Seller or Seller’s Agent to request gestation results from the veterinarian or clinic performing the insemination. Therefore, the veterinarian or clinic in question is hereby obligated to share this result with Seller or Seller’s Agent.
