I hereby release and agree to hold The Tox Holdings Corporation ("Tox Corp"), along with any agents, owners, partners, employees, affilifates or esteticians of Tox Corp ("Tox Agent", together with Tox Corp, "Tox") harmless from, and waive on behalf of myself, my heirs, and any personal representatives, any and all causes of action, claims, demands, damages, costs, expenses and compensation for damage or loss to myself and/or property that may be caused by any act, or failure to act, of the business or that may otherwise arise in any way in connection with any services received from Tox. I understand that this release discharges Tox from any liability or claim that I, my heirs, or any personal representatives, may have against the business with respect to any bodily injury, illness, death, medical treatment, or property damage that may arise from, or in connection with, any services received from Tox. I hereby acknowledge and agree that: (1) Tox's products and services are not inteded to diagnose, treat, cure, or prevent any medical condition(s) and are not in any way intended as medical advice or as a substitute for medical treatment, (2) The Tox Technique is not a massage technique and (3) The Tox Technique is a body sculpting technique that is performed primarily by estheticians. 

I understand and acknowledge the dangers and risks involved in my participation in services rendered by Tox including potential injuries/damages. These injuries/damages may be caused by actions or inactions of myself or the providers of services rendered by Tox and/or the conditions where the services rendered by Tox occur. I acknowledge that there may be other injuries/damages not known to me or not readily forseeable at this time. I fully accept and assume all risks of the injuries/damages resulting from my participation in services rendered by Tox. I have read and fully understood all written materials setting forth the requirements for my participation and I will observe, follow, and comply with all verbal and written instructions.

TOX DOES NOT PROVIDE MEDICAL SERVICES OR MEDICAL ADVICE. ONLY LICENSED HEALTHCARE PROVIDERS MAY PROVIDE MEDICAL SERVICES OR ADVICE.

*I have had the oppurtunity to consult a medically qualified professional and have all my questions answered to my entire satisfaction. Having considered all aspects, I have decided to participate in services rendered by Tox on my own accord with the sole intention the anticpated benefit from the same.

*I understand that Tox may not be able to anticipate and explain all possible risks and complications of the services, and I wish to rely on the Tox to exercise judment during the course of the services, which staff thinks at the time, based upon the facts then known, is in my best interest. I understand that results are not guaranteed.

*I represent that I have never had any of the following contraindications to the extent that will prevent me from participating in services rendered by Tox: 

Epilepsy/Convulsions 
Diabetes 
Lymphedema
Lymph Node Removal 
Heart Problem(s) 
Cancer 
Pregnancy 
Musculoskeletal Conditions
Cardiovascular Conditions 
Urinary Conditions 
Gastro-Intestinal Conditions 
Neurological Conditions 
Skin Conditions 
ENT Conditions 

*I understand that the risks associated with services rendered by Tox include, but are not limited to:

Bruising
Short-term muscle soreness
Nauseous
Headache 

*I understand the nature of the services rendered by Tox and I represent that I am in good physicial, mental, and emotional health and able to participate in the services rendered by Tox. If, at any time, I believe the conditions of my participation to be unsafe, I will immediatley cease further participation in the Tox's services.

*I understand that it is my responsibility to inform my technician of any discomfort I may feel during the session so he/she may adjust accordingly.

*I understand that my session(s) are non-refundable and in no circumstance will The Tox refund my prepaid session.

*I understand that The Tox is not responsible for any lost, stolen, or left items. I agree that if I leave a belonging, I have up to 14 days to collect it, or risk disposal.
