1) Purpose:
This rental is to provide the borrower with a NeurOptimal® system that will permit the borrower to provide NeurOptimal® Sessions to him/herself, family and friends. The renter may share the costs and use of this equipment with another, but the individual signing this contract accepts full responsibility for the safety and return of the equipment.
2) Duration: This loan is for a period of 30 days, starting from the date listed above, however, the lender reserves the right to request return of the equipment at
any time. In such an event, the borrower will be refunded the unused number of days. If the borrower wishes to return the equipment prior to completion of the contract there will be no refund for unused time.
3) Cost and Fees:
a) $900 per 30 day rental period. Fees are due at the time of pick-up. Acceptable forms of payment are credit, debit, HSA, and FSA.
b) There is a $50 fee per day for overdue system returns.
c) Should the equipment incur repairable damage during rental, the patient will be responsible for the cost of repair if applicable.
d) Failure to return the equipment in it's original condition (whether lost, stolen, or broken beyond reasonable repair) by the agreed upon date will result in the client’s credit card being charged for the replacement costs:
Individual Replacement Parts:
- Replacement zAmp: $2000
- Replacement Sensors: $150
- Replacement Tablet & Software: $2000
Complete Replacement:
- Should the entire device and its components require replacement, the patient will be charged $10,995.00 USD as full legal payment for the system. At this point the borrower becomes a full legal owner of the license and equipment with all privileges thereto. These fees are separate and additional to the contracted rental rates and late fees listed above.
4) Pickup/Drop Off:
a) The device should be picked up in person at our office located at 31100 Pinetree Rd Suite #218, Pepper Pike, OH 44124.
b) At the end of the 30 day rental term, or when this agreement is terminated, you must return all equipment to our office, including:
- Laptop or tablet
- Power supply
- zAmp with Sensors
- USB Cable
- 10/20 Paste
5) Limitations:
a) The device is the property of Healing Family Functional Medicine.
b) The device cannot be sold, loaned, or gifted. During rental, it must remain in the possession and care of the above named individual.
c) The purpose of the rental of this equipment is to permit the borrower to conduct Neurofeedback training at home. It shall not be used for any other purposes.
d) No income may be generated by the borrower from the use of the equipment.
e) Lender reserves the right to request equipment return at any time.
f) If the device is not returned by the agreed upon date, the lender can charge a rate of $50 per day rental for time overdue.
g) The Borrower is responsible for maintenance and care of the equipment during rental.
h) No alterations or additions may be made to the device or software at any time.
i) Should technical problems arise due to additional software/hardware being installed, Lender will return the system to its original state and charges will be posted to the Borrower’s credit card for technical service charge reimbursement.
j) Lender guarantees equipment functionality, however we cannot guarantee the types, degrees and order of shifts the borrower and anyone else who uses the system may or may not experience.
6) Use and Maintenance of Equipment:
You must:
a) Use the equipment at your address and keep the equipment safely locked up at room temperatures at your address when not in use.
b) Keep the equipment in first class working order, repair and condition.
c) Follow all of the manufacturer and physician instructions.
d) Notify Healing Family Functional Medicine immediately if it is damaged, lost or destroyed.
e) Keep the equipment under your control in a safe environment.
f) Only allow property trained people to use the equipment.
You must not:
a) Sell or attempt to sell the equipment, give possession of it, transfer or assign this agreement to any person.
b) Make any alteration or addition to the equipment.
7) Internet Connection and Windows Updates:
Borrower understands that an Internet connection is required for NeurOptimal®
to run and agrees to regularly perform windows updates while this unit is in their possession.
