CONSIGNMENT AND SALES AGREEMENT INFO

The Artist hereby warrants that the Artist created and possesses unencumbered title to the works of art listed and described below and has the right to loan these works for purposes of exhibition.
Artist warrants and represents that each Work consigned under the Agreement is or will be original to Artist, that Artist does or will own each Work at time of consignment, and that each Work and its display does not and will not violate any law or legal or moral right of any person or entity. Artist agrees to defend and indemnify Gallery from any claim that, if proven, would constitute a breach of Artist’s warranties and representations.
Important Dates and Content Needed for The NHPG Biennial Show Hands on Earth
For press and publicity, the Artist will provide Kimball Jenkins with; three to five representative images, accompanied by a digitized list that includes the title, year, media, and dimensions (in inches); and digitized material, including a bio and/or CV and artist’s statement, by September 6th, 2024.
All art works must be scheduled for pick up or drop off by September 20th, 2024 at Kimball Jenkins Art and Community Center - 266 North Main St, Concord NH 03301

Each JPG uploaded should be clearly identified and a digitized list that includes the Title, Date, Media, Dimensions, Retail Price or if not for sale, Insurance Value.

Consignment
All sales as a result of the exhibition have a 25% sales commission (Kimball Jenkins receiving 25% and the Artist receiving 75%) which shall be paid to Artist within 30 days of close of The Biennial Show. Any shipping costs as a result of sales are the responsibility of the buyer. Gallery shall not discount the retail price of a Work without Artist’s express permission, except that Gallery may, at its own expense, offer a discount of up to ten percent (10%) of the retail price to facilitate a sale of the Work. Gallery shall collect and be responsible for sales taxes and such delivery fees as it may elect to charge. Gallery shall provide to Artist available contact information for each purchaser of Artist’s Work.
Upon delivery to Gallery
Gallery assumes risk of damage to or loss of Work until either delivery upon sale or return to Artist. Gallery represents that it maintains commercially reasonable insurance to cover damage to or loss of the Work. Title to the Work shall at all times prior to sale remain with the Artist and the Works shall not be subject to claim by Gallery’s creditors. No sale of a Work shall include transfer of any copyright in the Work. This Agreement shall constitute the entire agreement of the parties and may not be amended except in writing signed by the party to be charged. This Agreement shall be construed according to the laws of New Hampshire WHEREFORE, intending to be bound by this Consignment Agreement, the parties have caused it to be executed effective as of the date of time-stamped signature submission.
