Admission to the market is based on the prospective vendor providing a product compatible with the market's needs. Not all items listed may be approved for sale at the market.

Mobile Arts Expo Release Indemnification, & Hold-Harmless & Liability Disclaimer Agreement For The Term of January 1, 2024 – December 31, 2024

 In consideration of the undersigned being permitted to participate in the “Mobile Arts Expo”,  the undersigned does hereby release and forever discharge the Sponsors and each of their respective board member, council members, employees, officers, directors, contractors and agents and the City of Mobile, jointly and severally, from any and all actions, causes of action, claims and demands for, upon or by reason of any damage, loss, injury or death, or damage to or loss of property arising out of the undersigned’s and the undersigned’s staff, guests, visitors, participants, and invitees participation in the Mobile Arts Expo. 

This release extends, applies to, covers and includes all unknown, unforeseen, unanticipated and unsuspected injuries, damages, loss and liability, and the consequences thereof, as well as those now disclosed and known to exist. The provision of any state, federal, local and/ or territorial law, or statute providing in substance that releases shall not extend to claims, demands, injuries or damages which are unknown or not suspected to exist at the time, are hereby expressly waived.

 The undersigned agrees on behalf of itself, its successors, assigns, and sublicenses to indemnify and to hold harmless the Sponsors and their respective board member, council members, employees, officers, directors, and agents, jointly and severally, from and against any and all actions, claims, demands, liabilities, losses, damages, and expenses of whatever nature and kind, including attorneys’ fees, which may be at any time incurred by them or any of them in connection with the participation in the Mobile Arts Expo by the undersigned and the undersigned’s staff, guests, visitors, participants, and invitees. Sponsors and their respective board member, council members, employees, officers, directors, contractors and agents shall have no liability for any damage to property, or injury or death to persons arising out of the undersigned’s and the undersigned’s staff, guests, visitors, participants, and invitees participation in Mobile Arts Expo. 

The undersigned agrees to inform all its staff, guests, visitors, participants, and invitees that the undersigned and such staff, participants, guests, or invitees of the undersigned assume all risk of loss or injury arising out of participation in Mobile Arts Expo or related activities. 

The undersigned agrees to be responsible for any damage caused to the Sponsors, their respective board members, council members, employees, officers, directors, contractors, and agents by the participation of the undersigned and the undersigned’s staff, guests, visitors, participants, and invitees. The undersigned further agrees to abide by all policies established by the Sponsors in connection with the Mobile Arts Expo.
