5. Once submitted you will receive a pop-up "Thank you" message with a link to select your preferred method of funding, should you decide to move forward with a rental or purchase.  No rush, the same Funding link will be sent in the Auto-response email verifying your submission. 

6. We will contact you to verify your submission to discuss any questions or considerations you may have.

7. Once approved your Rental order will be processed and shipped.

Current ship dates are 3 to 10 business days after receipt of funding. Remember, shipping fee will e added to the order total, prior a request for Funding.

MAGNUS MAGNETICA, LLC DOES NOT OFFER ANY BUY BACK SERVICE ONCE THE ORDER IS PURCHASED. ALL PRODUCTS ARE ASSEMBLED PER ORDER. ONCE THE PRODUCT HAS BEEN FUNDED OR SHIPPED, IT IS NOT RETURNABLE EXCEPT FOR WARRANTY WORK.

A RESTOCKING FEE OF 25%, IS BASED UPON THE PRODUCT’S AND ACCESSORY’S FULL MSRP (NOT ANY DISCOUNTED PRICE), WILL BE INCURRED IF RETURNED WITHIN 30 DAYS. PRODUCTS ARE NON-RETURNABLE AFTER 30 DAYS.

Warranty:

Shoud you decide to purchase this PEMF device, we provide a basic Factory Warranty to operate properly for a period of three (3) years from the date of the of delivery, if the device is eventually purchased and Titled through the execution of this document.  Buyer is responsible for all freight cost and shipping insurance for any warranty work and for the use of any Loaners. ● Loaners are provided at no cost for the first six months of ownership of new HERO devices only. After six months a nominal daily fee will apply (certain conditions apply).

● There is an Optional 7 year Extended Limited Warranty available for purchase:  

• On new PEMF devices that have been initially been rented then purchased
• If the Buyer fails to fill out and remit the Final Checklist, within 60 days actual delivery of a PEMF device, any Extended Limited Warranty will be voided.
• Mag Discs and paddles are warrantied against manufacturing defects for 6 months from date of delivery.
• In addition to our 3 year Factory Warranty an Extended Limited Warranty is handled as a maximum out of pocket expense of $750.00 in any given year for maintenance or repairs.
  This means any repairs, after the original 3 Year Factory Warranty period expires, will never cost more than $750.00, in any given Extended Warranty year.
• This Extended Warranty does not cover mag discs, power bank, power cords, wall adapters, hoof pro bindings or any accessories.
• An Extended Limited Warranty included with the purchase of a new device cannot be transferred to a new owner, if the original buyer sells the device.

The described equipment is a Magnetic Pulse Generator ("MPG"), model and serial number listed above and/or on separate Rental Order/Invoice submitted online.
Parties to this agreement:

• Owner: Magnus Magnetica, LLC
• Renter: {shipTo}

Renter agrees to the terms and conditions of this Agreement and to the rental of an MPG beginning on the date appearing to the right of Renter's signature.
Monthly rental cycle: Not necessarily a calendar month—each subsequent monthly rental cycle shall commence on the date of delivery and conclude in 30 days, unless otherwise noted.

• Usage fees paid to Owner: 
  Renter agrees to pay rental fees of ${monthlyRental139} per month for a minimum of six months. At the commencement of the 7th month, Renter may exercise the option to extend on a month-to-month basis for a maximum of thirty (30) additional months, provided that funding for the subsequent month, at the agreed-upon monthly rental rate,  is automatically debited from the Renters checking account of credit card.
• The Monthly Rental Rate for any month past month six, shall be calculated at ${monthlyRental139} plus ${rentalpremium}, equalling ${7plusrent},an additional 25% of the Base Rental Fee. Renter agrees to pay for such additional months of usage at the new monthly rental rate upon demand.
• By purchasing the device prior the 7th month, Renter shall  preserve a 100% credit the first 6 months of rental payments. Failure to fund a purchase withing 3 days from the last date of the 6th month will result in loss of credits. See Rental Credits below.
• There are no “partial months” or “pro-rated months” for unused days in any subsequent monthly rental cycle, past 6 months. Once a new monthly rental cycle has commenced, Renter shall be obligated to pay the monthly rental fee for that monthly rental cycle. 

• Delivery / Return of MPG: Delivery / Return of MPG: Renter agrees to ship via Fedex or UPS Ground service, direct signature required, at the sole cost of the Renter. Alternatively, the renter shall pay a minimum  rate of $95.00  for ground service throughout the USA for all necessary shipments, when the MPG owner is required to handle return shipping . Renter understands that shipping rates to and from certain geographical areas may be higher and agrees to pay the actual shipping rate.

• Payment/Funding/Security:  
  Renter agrees to pay all fees that Renter becomes obligated to pay by signing this Rental Agreement.
  Renter must provide a Refundable Security Deposit (by way of ACH or wired funds or credit card authorization). The refundable security deposit is $1000.00
• By using a credit card, Renter will incur a surcharge and agrees to pay a 3.5% surcharge.
  During the term of this agreement, Renter has the option of purchasing an MPG or entering into a formal “Finance to Buy” Agreement through a financing  contract with a third-party leasing or finance company at the full retail price listed in Magnus Magnetica’s then current product page found  at www.magnusmagnetica.com  If Renter opts to convert this Rental Agreement to a purchase or “Finance to Buy'' agreement, the following shall apply:
• Renter shall provide written notice to the owner of his/her/its intent to convert, in the form of a signed purchase order/invoice, detailing specific durable goods, where the Title in the identified durable goods shall be transferred to Renter or a third-party leasing/finance company. 
• If the Conversion is a “Finance to Buy," a credit application must be submitted by Renter, and an approval must be granted by a third-party leasing/financing company.  If the Conversion is an outright purchase, Title shall be transferred upon receipt of funds by Magnus Magnetica, LLC.

• Rental credits: If during the initial 6 month term of this Rental Agreement Renter exercises the right to purchase the MPG or enter into a financing agreement, a credit shall be applied to the purchase of the MPG as follows:
  • Credit for 100% of all rental fees paid for a maximum of  six (6) rental months in this Rental Agreement, if and only if the option to convert to a purchase is exercised no later than one(1) day from the end of the final month 
  • If the above option to convert to a purchase is not exercised within the 6 month Rental Term, then the allowable credit (applied to a purchase only) will be reduced to Zero Percent (0%) of all paid rental fees generated under this agreement.
  • If no written notice to the owner of Renter's intent to convert is received by the end of the 6 month term the Renter hereby agrees to forfeit any right to monetary credits listed under this Agreement.
  • Should Renter extend the rental agreement past six  (6) months, all rental fees are not eligible as credits to be applied toward the purchase of the PEMF model. 

• Termination:
  • Termination of this Rental Agreement shall be based upon one of the following occurrences:
  • Upon seven (7) days' written notice by either party, the MPG shall be returned to the Owner and a final audit and payment of any refund from teh Security Deposit shall be made  to the Owner within 72 hours of the date the MPG is received by the Owner.
  • Each party shall have the option to terminate this Rental Agreement. If Renter terminates the Agreement,  Renter will still be charged the applicable rental fee for the 6 month minimum term and additional all months during which the MPG remains in Renter's possession or under his/her/its control. Written notice must be sent to the Owner by email to: sales@magnusmagnetica.com.
  • Breach or uncured default by Renter of either this Rental Agreement or Reseller Agreement, whereby the Rental Agreement will immediately terminate upon notice by the Owner and the MPG will be returned within 48 hours of such notice.

• Additional terms and conditions:
  Renter additionally agrees:
  • Magnus Magnetica, LLC is hereby designated as Renter's exclusive distributor of all devices manufactured by PEMF Systems, Inc, should Renter exercise the option to purchase, or “Finance to Buy” or finance, an MPG that Owner distributes.
  • To protect and be responsible for the safekeeping of the MPG and accessories. Effective upon delivery and until the MPG and accessories are returned, Renter relieves Owner of responsibility for all risks of physical damage to or loss or destruction of the MPG and accessories  and agrees to insure, protect, and be responsible for the device and to return it in good physical condition (not including internal electrical condition, which Renter is not responsible for, provided, however, that Renter is responsible for water damage and damage from dropping the device or mishandling it).
  • To indemnify and hold harmless PEMF Systems, Inc., its resellers, distributors, and agents, from any and all legal claims or actions made, filed, or taken as a result of providing PEMF application or  treatments to, or otherwise using the rented device or accessories in any way, to any and all third parties during or after the rental term, except for those covered by the manufacturer’s product liability policy.
  • That the rented device and/or accessories will not be used to treat any persons by anyone other than the undersigned or his/her/its current employees or other persons authorized in advance in writing by the Owner.
