Agreement Terms
This Release of Liability Waiver ("Waiver") is made and entered into on this Date by and between Just Better Living™ Concierge / Just Better Delivery LLC ("Company") and the name of customer ("Customer").
1. Rental Equipment and Items
The Company rents a variety of items, including but not limited to water toys, kids' toys, baby equipment, tables, chairs, umbrellas, and similar outdoor event rental items. The term "Rental Equipment" refers to any and all items provided by the Company to the Customer.
2. Assumption of Risk
The Customer acknowledges that the use of Rental Equipment involves inherent risks, including but not limited to, physical injury, property damage, or other harm that may arise from the use, misuse, or malfunction of the Rental Equipment. The Customer assumes all risks associated with the use of the Rental Equipment.
3. Release of Liability
The Customer agrees that the Company, including its owners, employees, agents, and affiliates, shall not be held liable for any injuries, damages, or losses of any kind that may occur as a result of using the Rental Equipment. This includes, but is not limited to, personal injury, property damage, or any other type of loss or damage.
4. Indemnification
The Customer agrees to indemnify and hold harmless the Company, its owners, employees, agents, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising out of or in connection with the Customer's use of the Rental Equipment.
5. Responsibility for Equipment
The Customer agrees to use the Rental Equipment in a careful and proper manner and to return the Rental Equipment in the same condition as it was received. The Customer is responsible for any damage to or loss of the Rental Equipment. In the event of damage or loss, the Customer agrees to pay for the repair or replacement of the Rental Equipment at the Company's discretion.
6. Governing Law
This Waiver shall be governed by and construed in accordance with the laws of the State of California. Any legal action arising out of this Waiver shall be brought in the appropriate court in the State of California.
7. Acknowledgment
The Customer acknowledges that they have read and understood this Waiver, and that they are fully aware of the legal consequences of signing this document.
