RELEASE, WAIVER, INDEMNIFICATION, HOLD HARMLESS,
AND ASSUMPTION OF THE RISK AGREEMENT

In return for use of premises, instruction in firearms, and/or for other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledge, the Undersigned agrees to the following:

To indemnify, hold harmless and defend the ATSS Foundation, and any of its employees, directors, officers or agents from any and all fault, liabilities, costs, expenses, claims, demands or lawsuits arising out of, related to or connected with the discharge of firearms; the Undersigned’s participation in discharging firearms; observing the discharging of firearms, the range, buildings, land and premises used (the “Premises”); the Undersigned’s presence on or use of Premises; and any and all acts or omissions of the Undersigned.

Should any such claim, demand or lawsuit arise or be asserted in any way related thereto, whether arising under the laws of the United States, Florida or of any other State, or under any theory of law or equity, the Undersigned will indemnify, hold harmless and defend the ATSS Foundation, from any and all costs, expenses or liability including, but not limited to, the cost of any settlement or judgment made or rendered against the ATSS Foundation, whether individually, jointly, or in concert with the Undersigned, together with all costs of court and other costs or expenses incurred in connection with any such claim, demand or lawsuit, including attorney’s fees.

The Undersigned waives any and all rights and claims for damages, losses, demands and any other actions, which exist or which may arise against the ATSS Foundation, (including, but not limited to any and all injuries, damages or illnesses suffered by the Undersigned or the Undersigned’s property), which may, in any way whatsoever, arise out of, be related to or be connected with: discharging firearms, the Premises, including any latent defect in the Premises; the Undersigned’s presence on or use of Premises; the Undersigned’s property (whether or not entrusted to the ATSS Foundation); the ATSS Foundation shall not be liable for, and the Undersigned, hereby expressly releases the ATSS Foundation from any and all such claims. This waiver is both personal and on behalf of any minor for whom it is executed.

The Undersigned hereby expressly assumes the risk of entering the Premises and taking part in activities on the Premises which include but are not limited to the discharge of firearms and the firing of live ammunition; or observing individuals discharging firearms; and/or the use of the club or camping facilities.

The Undersigned furthermore hereby acknowledges and agrees that he/she has read, understands and will at all times abide by all Tenoroc Shooting Range range rules, procedures, safety rules, and any and all Range Officer instructions, whether communicated in writing, posted on the premises and/or communicated verbally.

This instrument binds the Undersigned and his/her executors, administrators, assignees or heirs and any minor for whom it is signed.

Participants must be over the age of 18 to participate in the event.

FWC Managed Shooting Range Release of Claims - Sign-in Sheet  Please Read Carefully

This is a release and waiver of claims which, when signed, contractually waives any claims against the Florida Fish and Wildlife Conservation Commission (FWC) that may arise in connection with your and/or your minor child/ward's participation in activities at any FWC managed shooting range. Please read it carefully before signing your name.

In consideration of the opportunity afforded to me and/or my minor child/ward to participate in activities at the FWC managed shooting range, I, the undersigned, on behalf of myself and/or my child/ward named herein do freely subscribe to the following contractual obligation:

I, on behalf of myself and/or my child/ward named below, fully understand the risks associated with participation in target practice at the FWC managed shooting range, and do hereby, and for my heirs, executors, and assigns, and for my minor child/ward's heirs, executors, and assigns, if applicable, knowingly, freely, and voluntarily assume all risk and liability for any damage or injury to person or property that may occur as a result of my and/or my child/ward's participation in activities at any FWC managed shooting range, and do hereby release, discharge, and covenant not to sue the FWC, its partners, officers, employees, agents, and volunteers, and do hereby waive and discharge all claims for damages that my minor child/ward or I might have against the FWC its partners, officers, employees, agents, and volunteers for any reason, including FWC's negligence, and agree to indemnify and hold harmless the FWC its partners, officers, employees, agents, and volunteers, from and against any and all claims, damages, and judgments, of whatever nature, including attorney fees, that may be asserted or entered against any of them in connection with my participation and/or my minor child/ward's or in any activity at any FWC managed shooting range.

I on behalf of myself and/or my child/ward, have read the Release and Waiver of Claims and fully understand its terms, and understand that I, on behalf of myself and/or my child/ward, have waived substantial rights by signing this Release, and I have signed it freely and without inducement, coercion, or assurance of any nature, and intend it to be a complete and unconditional release of any and all liability, and agree that, if any portion of this Release Waiver of Claims is held invalid by a court of competent jurisdiction, any portion not being held invalid shall remain in full force and effect.

I on behalf of myself and/or my child/ward, have also read the guidance for the use of these facilities and fully understand that if at anytime I, and/or my child/ward, fail to follow these guidelines my privilege to use these facilities may be denied.

You have the right to refuse to sign this form, and FWC has the right to refuse to let you participate if you do not sign this form.

ALL PERSONS ENTERING THE RANGE MUST SIGN AND COMPLY WITH ALL RANGE RULES

(MINOR CHILDREN MUST BE SIGNED IN BY A PARENT OR ADULT. Parents who desire their minor children to access to the shooting ranges/fields must also complete a Minor Child Waiver and Release Form
