The following terms and conditions shall apply to this agreement and are binding upon the parties hereto:
1. Space assignments will be made on a first-come, first-served basis and only on receipt of the full payment of booth fees and completed vendor application contract packet. Any payments are not refundable. Applications received without payment or all of the required paperwork will be deemed as INCOMPLETE and the booth space WILL NOT be reserved.
2. Love Out Loud Festival is a family friendly event, therefore, vendor space is open for sale of food, beverages, and other non-food products. Festival staff reserves the right to determine eligibility of exhibitor for inclusion in the festival, prior to or after execution of the agreement.
3. Booth setup must be done during targeted move-in time between 12 AM- 2 PM Saturday MAY 2ND, 2026. If the assigned move-in times are missed, festival management reserves the right to assign that space to another vendor. If the booth is not installed and ready for show opening by 1 PM on Saturday MAY 2ND, 2026, festival management reserves the right to assign that space to another vendor, or make such other use of the space as deemed necessary or appropriate with no refund eligible to the vendor. Setup hours are subject to change by festival management and notice to vendors.
4. Festival hours are as follows:Saturday MAY 2ND, 2026 from 3pm-10pm. Show hours are subject to change by festival management.
5. All booths are to be kept intact until 8 PM on Saturday MAY 2ND, 2026. Move-out begins at 8PM. It is also specifically noted that all booth contents must be removed by 11PM, Saturday MAY 2ND, 2026, unless prior approval has been granted by festival management. It is also agreed that material not removed by this time and date will be declared abandoned and removed by festival management at exhibitor's expense and disposed of at festival management's discretion.
6. Tents are the sole responsibility of the vendor. They must be clean, fireproof, weighted down and free of structural damage. Additional restrictions may be required based on your category. You must submit a picture of your sample products, tent, & set up with this application.
7. Food Vendors are allowed 30 minutes to unload vehicles during move-in. Vehicles remaining in the festival space longer than 45 minutes may be subject to a $250 fine. Plan otherwise to transport items from parking to vendor location.
8. Any Vendors who commit a Grass Infraction will be subject to pay $500+ and will be prosecuted to recover damages.
9. It is agreed that High Risk Vendors (those that use grease & charcoal), will remit to festival management a deposit of $200. At the conclusion of the event, festival management will inspect the booth and provide written confirmation The deposit will be returned 5 days post event.
10. This event is scheduled as a "Rain or Shine" event. If Vendor decidesparticipation in the show described by this agreement shall be adjudicated under Georgia law. to no longer participate due to weather, there will be no refund of payments.
11. Festival management reserves the right to decline to permit a vendor to conduct and maintain a booth if, in the sole judgment of festival management, said vendor or booth, or proposed booth, shall in any respect be deemed unsuitable. This reservation relates to persons, conduct, articles of merchandise, printed materials, souvenirs, catalogs, and any other thing, without limitation, which affects the character of the booth and, therefore, the festival. The use of loudspeakers and radios or the use of operating machinery which is sufficient volume to annoy neighboring exhibitors will not be permitted.
12. Exhibitor agrees to protect, save, and hold the Love Out Loud Festival, Loving Arms Cancer Outreach, Schoolhouse Brewing, and all agents and employees thereof (hereinafter collectively called Indemnitees) forever harmless for any damages or charges imposed for violation of any law or ordinance, whether occasioned by the negligence of the vendor or those holding under the vendor, and save, and hold harmless the Indemnitees against and from any and all losses, costs, damage, from or out of or by reason of said vendor's occupancy and use of the festival grounds, or any part thereof. If insurance is desired, it must be secured by the vendor. It is recommended that vendors take individual precautionary measures such as, securing easily transportable articles of value and the removal of the same to a place of safekeeping while the booth is not manned. It is further agreed that all material brought by the vendor is the responsibility of the vendor and that festival management hereby disclaims all responsibility for these articles. The parties hereto acknowledge that the foregoing disclaimer of liability has been negotiated between the parties and is reflected in the charges applicable to this agreement.
13. It is agreed that if the acts of the vendor's staff, employees, assigned representatives conducting business with the vendor's company and/or booth cause damage to event facilities, the vendor's company will be held responsible and will pay for damages as assessed from Schoolhouse Brewing Marietta, Love Out Loud Music Festival and Loving Arms Cancer Outreach. These charges will be enforced in accordance with State of Georgia law. For this reason, it is a good practice for the vendor to carry their own insurance.
14. It is specifically agreed that festival management has the right to amend or alter the terms and conditions of this agreement from time to time as need arises provided show management gives adequate notice (5 days) to the exhibitor. Each exhibitor, for himself, his agents and employees, agrees to abide by the Contract Conditions/Rules & Regulations as published by festival management and noted herein and any future alternations or modifications as described by this paragraph and all rules and regulations published in the official Festival Vendor Packet.
15. It is agreed that all disputes arising from this agreement or participation in the show described by this agreement shall be adjudicated under Georgia Law.
I have reviewed this vendor application contract and agree to abide by the rules, regulations, ordinances of the Love Out Loud Music Festival as mandated from Loving Arms Cancer Outreach and Schoolhouse Brewing Marietta. I understand that if I do not abide by these rules, regulations, ordinances and deadlines, my business/organization will not be allowed toparticipate during the festival, asked to vacate and forfeiture of any fees paid. I hereby declare that all information herein provided is accurate, agree to participate in this event at our own free will with no liabilities to Love Out Loud Music Festival or its agents. I understand this application becomes a binding contract when accepted by Festival Management. I understand that the High Risk Vendor deposit of $200 (if applicable) will be returned after 5 days, if no damage is found by Festival Management. I understand that our payments are not refundable. I agree to remit all fees in full when submitting this application.
