    CONSULTATION AGREEMENT

    This Attorney-Client Fee Contract (hereinafter “Contract”) is entered into by and between:

    (hereinafter referred to as “Client(s),” “you,” or “your”) and Valencia Immigration Law, PLLC (hereinafter referred to as “Law Firm,” “Attorney(s),” “us,” “we,” or “our”).  This Contract sets forth the rights and obligations of both parties with respect to their Attorney-Client relationship.

    If you do not understand English, please review this contract with a translator.

    1.  SCOPE OF REPRESENTATION. You hereby retain our Law Firm for a consultation to review your immigration matter and discuss immigration options. The scope of this representation is limited to a review of your documentation and a single phone or video consultation, not to exceed two hours. At this time, we have not agreed to enter an appearance as your attorney of record, to act as your attorney before the Department of Homeland Security or Immigration Court, or to create any work product in this matter. After this consultation has concluded, we would be glad to discuss providing additional legal representation. Any additional representation will be the subject of a separate agreement. 

    2.  DUTIES OF PARTIES. You are retaining us solely for a consultation. We will fulfill our responsibilities to you by reviewing your immigration matter and evaluating any options that may be available to you.  You must provide us with a truthful and accurate version of the facts and provide all available information that may assist us in providing this consultation. You must pay for our services prior to the consultation. We will keep all information regarding your case confidential except as provided herein or as allowed by the relevant Rules of Professional Conduct.  We will not release documents pertaining to this Contract to anyone without your permission.

    3. LEGAL FEES. You agree to pay a flat fee of $250.00 for this consultation, which must be paid prior to beginning the consultation. If paying by check, checks should be made out to “Valencia Immigration Law, PLLC.” If paying by credit card, you hereby authorize us to charge this credit card for this amount.

    4. DISCHARGE AND WITHDRAWAL. You may discharge us at any time. We can terminate our Attorney-Client relationship if you fail to make a payment when due, if you breach any provision of this Contract, if you refuse to cooperate with us, if you refuse to follow our advice on a material matter, or if any other fact or circumstance occurs that would render our continuing representation unlawful or unethical.

    6. DISCLAIMER OF GUARANTEE. Nothing in this Contract and nothing in any Attorney’s statements to you will be construed as a promise or guarantee about the outcome of your matter. You understand that your legal options may be different than originally discussed if new information arises that changes our opinion regarding your options. Because of the uncertainties in the practice of immigration law, no Attorney can guarantee success, time required, or maximum cost of legal services. We make no such promises or guarantees. Any Attorney’s comments about the outcome of your matter are expressions of opinion only.

    7. FILE RETENTION POLICY. The Law Firm will maintain electronic or paper copies of any documents you provide for at least seven years. After that time, Clients will be contacted at their last known address to determine whether Clients wish to receive the contents of the file. If not, the closed file will be destroyed.

    8. RECORDINGS. When you leave a voicemail with us, we will save a recording of it, and there may be other occasions where we may need to make recordings of our meetings or phone calls. You consent to allow us to record these communications between us.

    9. ELECTRONIC DATA, E-MAIL, AND ELECTRONIC MESSAGING. Client understands and agrees that certain information pertaining to their matter will be stored electronically on the Law Firm’s computers and via the internet using “cloud storage.” Attorney will endeavor to take all steps necessary to preserve and maintain the confidentiality of all Client information; however, Client recognizes and agrees that such information may be subject to unauthorized access outside the control of the Law Firm and agrees to hold Attorney harmless from any non-Attorney caused breaches of confidentiality of Client information. It is understood that: (1) e-mail communication is not a secure method of communication; (2) any e-mail that is sent to Client or by Client might be copied and/or saved by any or all computers through which it passes as it is transmitted; and (3) persons not participating in our communication, including persons who may have an interest in the contents of the e-mail, may intercept our communications either improperly or properly, by accessing any of the computers through which an e-mail passes. Nevertheless, you agree that communication via e-mail is appropriate in this instance because you have expressly consented to receive communications via this medium. 

    11. EFFECTIVE DATE. This Contract will take effect when you have performed the conditions stated herein, but its effective date will be retroactive to the date we first provided legal services.  Even if this Contract does not take effect, you will be obligated to pay us the reasonable value of any services we may have performed for you.
