Dog Training Liabilty Waiver:

This agreement between the owner/handler (hereinafter referred to as "Client") and Ultimutt Dog Sports LLC, Sunpaws Pet Services LLC, Melissa Wallace, and Frances Dauster (hereinafter referred to as "Trainer") pertains to the training of the dog registering for this class (hereinafter reffered to as "Dog").

Services: Trainer agrees to provide group lessons for Client and Dog with the goal being to teach Client how to train and work with Dog. These lessons will take place at Sunpaws Pet Services LLC unless otherwise specified. Trainer will make every reasonable effort to help Client achieve training goals but makes no guarantee of Dog’s performance or behavior as a result of providing professional dog training for Ultimutt Dog Sports LLC and Sunpaws Pet Services LLC. Client understands that he/she and members of the household must follow Trainer’s instructions without modification, work with dog daily as recommended, and constantly reinforce training being given to Dog.

Liability: Dog’s behavior now and in the future is solely the responsibility of the owner of the dog. If Dog causes property damage, or bites or injures any dog, animal or person (including but not limited to Trainer and Trainer’s agents), during or after the term of this Agreement, then Client agrees to pay all resulting losses and damages suffered or incurred, and to defend and indemnify Trainer/s and Ultimutt Dog Sports LLC, Sunpaws Pet Services LLC,and Trainer’s agents from any resulting claims, demands, lawsuits, losses, costs or expenses, including attorney fees. If Dog is injured in a fight or in any other manner during or after the term of the Agreement, Client assumes the risk and agrees that Trainer, Ultimutt Dog Sports, LLC, Sunpaws Pet Services LLC, Trainer’s Agents, and other participants should not be held responsible for any resulting injuries, losses, damages, costs or expenses. The Trainer and other participants are not responsible for damage from disease, death, running away, theft, fire, injury to persons, other dogs, other animals, or property by said dog, or other causes. 

Trainer cannot guarantee each individual dog’s ability to learn and/or understand signals, commands, or cues. The owner acknowledges that the dog in class is healthy and able to perform all exercises without detriment. The owner acknowledges that the owner and/or handler(s) are able to participate in all class activities without detriment. 

At Trainer's sole election, Trainer's duties hereunder shall terminate if in Trainer's sole judgment (a) Dog is sick; (b) Dog shows aggressive tendencies, is dangerous or vicious to Trainer or any other person or animal, or extreme fear; (c) Dog interferes with the training of other dogs; or (d) Client breaches any term or condition of this Agreement. Upon termination in accordance with the foregoing, Trainer's duties shall terminate but all other provisions of this Agreement shall continue in full force and effect. 

Adults are responsible for their minors and their behavior. Trainer is not responsible for any loss or damage resulting from the minor's presence or behavior in class.

Client acknowledges that dog training activities involve inherent risk and dangers that may cause damage or injury to dog(s) and/or persons. Client will assume full financial / moral responsibility for the action(s) of themself, minors, and Dog(s). Client fully understands the risks and dangers associated with their participation in the training and dog sports and accept same entirely at Client's own risk.

Client understands that this document contains a promise not to sue Ultimutt Dog Sports LLC, Sunpaws Pet Services LLC, Melissa Wallace, Frances Dauster, and other agents/participants and that it constitutes a release of liability and an indemnity for all claims.

REFUND POLICY: No refunds given unless classes and or lessons are permanently cancelled by Sunpaws Pet Services LLC, Ultimutt Dog Sports, Melissa Wallace, and Frances Dauster. No refund if owner and or handler misses or drops out of classes and or lessons. No pro-rates given for missed classes and or lessons.

Media Policy: By signing this release form, I authorize Trainer to use the following personal information: (1) Client picture and Dog’s picture – including photographic, motion picture (video), and digital images and (2) Client voice – including sound and video recordings.

I hereby grant to Trainer, its subsidiaries, licensees, successors and assigns, the right to use, publish, and reproduce, for all purposes, my name, pictures of me in film or electronic (video) form, sound and video recordings of my voice, and printed and electronic copy of the information described in any and all media including, without limitation, cable/broadcast television, and the Internet, and for exhibition, distribution, promotion, advertising, sale, press conferences, meetings, hearings, educational conferences and in brochures and other print media. This permission extends to all languages, media, formats, and markets now known or hereafter devised. This permission shall continue forever unless Client revokes the permission in writing.

I further grant Trainer all right, title, and interest that Client may have in all finished pictures, negatives, reproductions, and copies of the original print, and further grant Trainer the right to give, sell, transfer, and exhibit the print in copies or facsimiles thereof, for marketing, communications, or advertising purposes, as it deems fit. Client hereby waives the right to receive any payment for signing this release and waive the right to receive any payment for Trainer's use of any of the material described above for any of the purposes authorized by this release. I also waive any right to inspect or approve finished photographs, audio, video, multimedia, or advertising recordings and copy or printed matter or computer-generated scanned image and other electronic media that may be used in conjunction therewith or to approve the eventual use that it might be applied.
