Entertainment Release

Property Entity: PCH PROPERTY, LCC

In consideration of the Property Entity, allowing performance group/charity partner (“Performer”) a revocable license to access 6400, 6420, 6430, 6440, 6460, 6480 East Pacific Coast Highway, Long Beach CA 90803 (the “Property Entity”), Performer agrees to release, indemnify, hold harmless and defend Owner and Owner’s Entities, and all their respective directors, officers, trustees, beneficiaries, owners, to CenterCal Properties, LLC, tenants, invitees, employees, agents and representatives (“Indemnitees”), from and against all losses, damages, liabilities, claims, demands, causes of action, judgments, and other costs and expenses, including attorneys' fees and court costs, which Owner may suffer or incur, arising in any manner from: (i) any damage, howsoever and wheresoever caused, or theft of Performer’s personal property, (ii) any and all acts or omissions committed by Performer, its agents or employees, in the performance of Performer’s use, performance, obligations or services at the Property; or (iii) any active or passive negligent act or omission by Performer or any person or entity hired or employed by Performer in the performance of Performer’s services or use at the Property. The performer shall not be required to indemnify the Owner for claims found to have arisen out of Owner's gross negligence or willful misconduct. The Owner reserves the right to immediately terminate Performer’s access to the Property at any time upon notice to Performer.
